The Constitutionality Of Prolonged Administrative Segregation For Inmates Who Have Received Sex Reassignment Surgery, Eric T. Fleischaker

In 2012, a Massachusetts district court judge issued a controversial decision in Kosilek v. Spencer when he ordered the state to pay for a transgender inmate's sex reassignment surgery. The court ruled that denying sex reassignment surgery to an inmate with Gender Identity Disorder is a violation of the Eighth Amendment. However, the court did not answer the question of where to place the inmate after the surgery. That decision was left up to the prison administrators.

This dissertation was inspired by difficult decisions patients of chronic diseases have to make about about treatment options in light of uncertainty. We look at rheumatoid arthritis (RA), a chronic, autoimmune disease that primarily affects the synovial joints of the hands and causes pain and deformities. In this work, we focus on several parts of a computer-based decision tool that patients can interact with using gestures, ask questions about the disease, and visualize possible futures. This study investigates the determinants that influence adult Kentuckians’ preference to buy organic and/or locally grown food based on their age, gender, income, education level and metropolitan versus nonmetropolitan living status. Ajzen’s theory of planned behavior (TPB) provides the conceptual framework of the research and the appropriateness of the theory. Data for this analysis are from a 2009 Kentucky statewide survey. The analysis shows that: There is a significant difference in food purchasing habits of Metropolitan and Nonmetropolitan adult Kentuckians; the factors associated with the purchase of organic and locally grown foods are different; and, those who purchased locally grown …

Before You Begin
Every aspiring gardener should follow seven steps to have a successful gardening season:
- Plan your garden on paper before you begin.
- Select a good gardening site that is:
a. in full sun for at least eight hours each day,
b. relatively level,
c. well‑drained,
d. close to a water source,
e. not shaded. - Prepare the soil properly and add fertilizer and lime according to soil test recommendations.

Insufficient physical activity is a serious concern for the youth of this nation. In 2008, more than one third of children and adolescents could be classified as either obese or overweight (Centers for Disease Control and Prevention, 2011). Poor nutrition and lack of physical activity are two major factors contributing to this epidemic. A physically active lifestyle during youth not only improves physical health, but has also been shown to improve emotional health, behavior, and academic performance. There is evidence that cholesterol presents an important risk factor for Alzheimer’s disease (AD), but the direction of this relationship is modified by age. High cholesterol during midlife and low cholesterol during late life are both associated with an increased risk for AD. This dissertation research engaged a life span approach to study the relationship between cholesterol, AD and cognitive functioning among older adults. The purpose of this research was to determine if trajectories of cholesterol from midlife through late life differ according to AD status and if these trajectories are associated with cognitive functioning during old age.

It is well established that for aerobic growth E.coli requires either Menaquinone (MK), Ubiquinone (Q) or 2-octaprenyl-3-methyl-6- methoxy-1,4-benzoquinone (MMQ) as electron carrier to grow on glycerol minimal medium (GMM). Therefore, a double mutant strain blocked in both the MK and Q pathways shouldn’t grow on GMM. The following double mutant strains were tested for growth on GMM (A ubiE Amen A, AubiH Amen A, AubiF Amen A, AubiB AmenA and AyigP AmenA). Surprisingly, it was found that the AubiB AmenA mutant grew after a long lag and AubiF AmenA mutant grew as expected due to the Q pathway intermediate MMQ …

Within the paucity of literature regarding older adult sexuality, a larger dearth exists concerning biases of long-term care facility staff toward gay and lesbian older adult residents. Prior literature has documented that LGBT (lesbian, gay, bisexual, and transgender) individuals' perceive that they do not receive the same quality of care as that of heterosexual individuals within long-term care facilities. Thus researchers aimed to evaluate whether these biases truly exist within care facilities that can prevent holistic care from being comprehensively provided to everyone regardless of sexual orientation. 153 residential care facility staff members from two separate facilities read one of …

The crystal structure and superconducting properties of samples of YBa2Cu3O7-x with oxygen contents 0.21 ≤ x ≥ 0.67 were investigated. The crystal structure and magnetic properties change with oxygen content. All samples were found to have orthorhombic crystal structure. The lattice parameters a and c were observed to monotonically increase while b nearly monotonically decreases with decreasing oxygen content. The unit cell volume increases with decreasing oxygen content as well. The critical temperature, Tc, and the superconducting volume fraction of the samples decreased with decreasing oxygen content.

Vision is perhaps the most important of all our senses, and gives us an immense amount of information regarding the outside world. The initial format in which this information reaches the retina are photons; particles of energy radiation of a given wavelength emitted or reflected from our surroundings. The brain itself however, perceives information in electrical signals via action potentials and changes in electrochemical gradients. The processes involved in the transduction of photons into electrical potentials will be the focus of this article. In this study we used the parametric survival approach to analyze the survival time of African American breast cancer patients. In research about the survival time of patients, the Cox Proportional Hazard model, a semi-parametric method, is primarily used, but this approach does not rely on the distributional assumptions. The parametric method is more consistent with a theoretical approach compared to a semi-parametric approach. We observe that the survival time of African American breast cancer patients follows the Weibull Probability Distribution. This project responds to an ongoing discussion in scholarship that identifies and analyzes the ideological functions of computer interfaces. In 1994, Cynthia Selfe and Richard Selfe claimed that interfaces are maps of cultural information and are therefore ideological (485). For Selfe and Selfe and other scholars, these interfaces carried a colonial ideology that resulted in Western dominance over other cultures. Since this early scholarship, our perspectives on interface have shifted with changing technology; interfaces can no longer be treated as having persistent and predictable characteristics like texts. I argue that interfaces are interactions among dynamic information that is constantly being …

Wetlands provide many functions to the environment including flood storage, water filtration/purification, foraging, nesting, and recreation opportunities. Wetland mitigation is the practice of replacing wetlands that are impacted by development. Wetland mitigation may take place on-site, off-site, or through a mitigation bank. Many authors including Dahl (2013), Robb (2002), Hallwood (2006), and Kihslinger (2008) report that wetland mitigation is not functioning as it was intended as wetland acreage is still being lost. Dahl (2013) found that freshwater vegetated wetlands in the lower 48 United States declined by 300,000 acres between 2004 and 2009. Many argue this continued loss is due …

The universality of the impact of daylight is a common thread that defines humanity. Day light affects us in a variety of ways –visually, psychologically and biologically. Artificial lighting research has explored ways in which artificial lighting may substitute for daylight and enhance human health and wellbeing. Recently, a study by Mott et al. 2011 found that the usage of high intensity, yet glare free lighting, (referred to as Focus light setting) during reading instruction increased grade 3 students’ oral reading fluency (ORF) scores, a key index of reading comprehension. I investigate the general astrobiological significance of F-type main-sequence stars with special consideration to stellar evolutionary aspects due to nuclear evolution. DNA is taken as a proxy for carbon-based macromolecules following the assumption that exobiology is most likely based on hydrocarbons. The DNA action spectrum is utilized to represent the relative damage of the stellar UV radiation. Planetary atmospheric attenuation is taken into account in the form of parameterized attenuation functions. My work is motivated by previous studies indicating that the UV environment of solar-like stars is one of the most critical elements in determining the habitability of exoplanets and …

This thesis investigates the problem of similarity search in large and noisy sequence databases. A key application domain of interest in this work is the very challenging Query-By-Humming (QBH) problem, according to which, given a hummed part of a song, we would like to identify the closest matches in a large music repository. The problem of selecting the most appropriate, based on each specific query, distance measure out of a pool of measures for classification in time series data is also investigated. Species are discrete groups of organisms that are reproductively isolated from other related groups of organisms. Variation in the strength of reproductive isolation between closely related taxa falls along a `speciation continuum', from weakly isolated structured populations to fully isolated sister species. Efforts to understand the genetics of speciation have focused primarily on developmental defects in hybrids (intrinsic postzygotic isolation) leading to sterility or inviability. Once speciation is complete, species continue to diverge as a result of mutation, genetic drift, and selection, and new forms of reproductive isolation may continue to accumulate.
