No uniform or customary method of disclosure for software patents is currently employed by inventors. This Note examines the issues that develop from software patent claims disclosed at various levels of abstraction, and the difficulties encountered by courts and the public when investigating the contours of the software patent space. While the courts have placed some restrictions on the manner in which software inventions are claimed, they are easily bypassed by clever patent applicants who desire to claim the maximum scope of their inventions. 35 U.S.C. § 101 allows a patent for “any new and useful process, machine, manufacture, or composition of matter, or any new and useful improvement thereof.” Recently, the Supreme Court issued several key decisions affecting the doctrine of patentable subject matter under § 101. Starting with Bilski v. Kappos (2011), and continuing with Mayo Collaborative Services, Inc. v. Prometheus Laboratories (2012), Association for Molecular Pathology v. Adaptive governance is an emergent form of environmental governance that is increasingly called upon by scholars and practitioners to coordinate resource management regimes in the face of the complexity and uncertainty associated with rapid environmental change. Although the term “adaptive governance” is not exclusively applied to the governance of social-ecological systems, related research represents a significant outgrowth of literature on resilience, social-ecological systems, and environmental governance. Tissue engineering aims to create functional biological tissues to treat diseases and damaged organs. A primary goal is to fabricate a 3D construct that can promote cell-cell interaction, extra cellular matrix (ECM) deposition and tissue level organization. Cancer cell metastasis is the single most threatening occurrence of tumor progression and predicts patient prognosis as well as survival. Invasion can be regulated by the Met receptor tyrosine kinase (c-Met), integrin beta4, and the lipid enzyme, 12-Lipoxygenase (12-LOX). Therefore we sought to determine if beta4, c-MET and 12-LOX comprise a signaling axis. c-Met is implicated in cancer cell dissemination through regulation of invasion in EMT where cell-cell junctions are disturbed to allow motility. Furthermore, beta4 promotes cellular adhesion to the extracellular matrix through hemidesmosomes. However, the homeostatic signaling functions of beta4's cytoplasmic tail can be hijacked by growth factor …

This study was designed to assess Abbey's (1991; 2002; 2011) model, which posits that acute alcohol intoxication increases the likelihood of sexual aggression at two stages of a cross-sex interaction. Early on, the cognitive impairments induced by alcohol encourage a potential perpetrator to overperceive a woman's level of sexual intent. Later, if the man's sexual advances are rejected, intoxication encourages an aggressive response. This research expands on the previous literature by examining: 1) both stages of Abbey's model in a single study, 2) rejection from a woman as a potential trigger for aggression, and 3) behavioral (past sexual assault perpetration), …

A significant degree of public opinion research has been conducted on Muslim Americans, but very little has focused on their perceptions. This study explores how opinion leaders address the question of patriotism, Americanness, hyphenated identities, and the implications of such a discourse. The study is confined to Wayne County, MI, because of the significant role Muslim Americans have played in labor struggles, local culture, civil rights, and their visibility. Vibrio cholerae is the etiologic agent of the severe diarrheal disease cholera. The aquatic bacterium is ingested by humans through contaminated water or food. Disease initiation depends on the production of the major virulence factors: cholera toxin (CT) and the toxin co-regulated pilus (TCP). The bacterium responds to signals in the human host that activate a virulence regulatory cascade termed the "ToxR Regulon". The ToxR regulon consists of various transcription regulators whose activity culminates in the production of the major virulence regulator, ToxT. Since Superstorm Sandy in October 2012, Kendra McMillin and Gerry Hertel monitored tree fall in the Gordon Natural Area. After Sandy there was a wind event in August, 2013 and then the ice storm in February 2014 which caused further tree fall.

Background: Diabetes is currently a global public health problem affecting people at all ages. Dietary antioxidants have been associated with a reduced risk of type 2 diabetes. Grape pomace contains considerable amounts of polyphenols and it has been reported to exhibit an inhibitory activity against alpha- glucosidases. Alpha-glucosidases, in turn, play a major role in controlling starch digestion and therefore postprandial blood glucose, a target for diabetes management.

Treatment non-adherence for Type 1 patients; especially during adolescence, is viewed as the precursor for healthy, or unhealthy patterns of self-care in adulthood. The risk for long-term health problems such as blindness, renal failure, heart attack, lower limb amputations, and stroke are exacerbated if healthy monitoring of the condition is not adhered to consistently, and early after diagnosis. This dissertation concerns the properties of nonlinear dynamic systems hybrid with Markov switching. It contains two parts. The first part focus on the mean-field models with state-dependent regime switching, and the second part focus on the system regularization and stabilization using feedback control. Throughout this dissertation, Markov switching processes are used to describe the randomness caused by discrete events, like sudden environment change or other uncertainty.

In the wake of E.T.'s 1982 debut, film critics Marina Heung and Vivian Sobchack established that the enduring appeal of E.T. inheres in the dissolution of the nuclear heterosexual family over the latter half of the twentieth century and the film's “fairy tale” stand-in for the “mythology of family relations” that Dana Cloud terms “conservative familialism.” As Carl Plantinga puts it, E.T. offers a “virtual solution … to [a] traumatic problem.” Despite this, however, E.T. remains for many an inconsolable tragedy. Aim- Cities represent an ideal study system for assessing how intensive land-use change and biotic interchange have altered beta diversity at broad geographic extents. Here we test the hypothesis that floras in cities located in disparate regions of the globe are being homogenized by species classified as invasive (naturalized species that have spread over a large area) or as a European archaeophyte (species introduced into Europe before ad 1500 from the Mediterranean Basin). We also test the prediction that the global influences of European activities (colonization, agriculture, commerce) have supported this outcome.

Identifying and assessing core knowledge has been and continues to be a challenge that vexes the discipline of sociology. With the adoption of a thematic approach to courses in the core curriculum at Butler University, faculty teaching Introductory Sociology were presented with the opportunity and challenge of defining the core knowledge and skills to be taught across course sections with a variety of themes. Seed tape has recently received attention as an alternative planting system for smallholder farmers in underdeveloped regions of South America, Africa, China, and India (Mateus, 2014). Seed companies are also developing seed-tape planting systems for germplasm evaluations (Deppermann et al., 2013). The Complete Plastid Genome Sequence Of Iris Gatesii (Section Oncocyclus), A Bearded Species From Southeastern Turkey, Carol A. Wilson

Aliso: A Journal of Systematic and Floristic Botany

Iris gatesii is a rare bearded species in subgenus Iris section Oncocyclus that occurs in steppe communities of southeastern Turkey. This species is not commonly cultivated, but related species in section Iris are economically important horticultural plants. The complete plastid genome is reported for I. gatesii based on data generated using the Illumina HiSeq platform and is compared to genomes of 16 species selected from across the monocotyledons. This Iris genome is the only known plastid genome available for order Asparagales that is not from Orchidaceae. The I. gatesii plastid genome, unlike orchid genomes, has little gene loss and rearrangement …

This Article examines whether contract design can influence the post- formation behavior of the non-drafting party. If it can, contract preparers may be able to obtain significant transactional advantages. This Article suggests that several contractual features can be explained in terms of their ability to exploit the cognitive biases of, and to induce particular “advantageous” emotions from, the non-drafting party after the contract has been executed. These features may include arbitration provisions, disclosures in capital letter or bold face type, “reliance” language, and language framing possible losses in particular ways. General public debate about the Second Amendment has focused almost exclusively on the regulation of firearms. After Heller and McDonald, the scope of the Second Amendment’s protection has been hotly contested. One area of the Second Amendment that has been less discussed is the decisional rules that would govern non-firearms and levels of protection based on location. This Comment proposes two Second Amendment Constitutional decisional rules. Seeds are chattel. As such, seeds are protectable by the same tapestry of public and private ordering as other forms of chattel. However, the distinguishing characteristic of seeds, their method of propagation, and the history of seeds-traditionally viewed as a public good rather than chatteldistort that tapestry. The model of seed distribution thus needs to be refrained in light of the often disparate interests of innovators, producers, and consumers. As with all chattel, there is no single, correct model for distributing seeds, but law and contract may be woven together to strike a balance.

Family law courts in America are overwhelmed with self-represented parties who try their best to navigate an unfamiliar territory laden with procedural and evidentiary rules. Efforts to level the playing field in these courts have resulted in state entities and judges taking on roles that previously belonged to attorneys. State supreme court judges and state agencies draft and promulgate family law forms, such as divorce pleadings and paternity acknowledgments, to provide poor citizens access to justice. In this work we study mixtures of cationic surfactant (CTAB) and sugar based surfactant(s) (octyl beta-D-glucopyranoside (C8G1), dodecyl maltoside (C12G2) and octyl beta-D-xylopyranoside (C8X1)) to understand the non-ideal thermodynamic behavior of the mixtures of cationic and non-ionic surfactants in water and synthesis of imprinted materials. The thermodynamics of micellization, mixing and dilution of these systems are studied using Isothermal Titration Calorimetry (ITC) and the experimental data obtained are modeled with a pseudo-phase separation model with non-ideal mixing described by regular solution theory. In this Article, I contend that a belief in animal liberation qual­ifies as religion under the Free Exercise Clause jurisprudence of the United States Constitution. Thus, every time a prison warden, public school teacher or administrator, or government employer refuses to accommodate the ethical belief of an animal liberationist, they are infringing on that person's relig­ious freedom, and they should have to satisfy the same consti­tutional or statutory requirements that would adhere were the asserted interest based on more traditional religious exercise.
