Criminal Justice Faculty Publications

Everyone is a potential stalker, given the right set of circumstances. There are a vast number of tools readily available—from social media networking to easily accessible websites that provide background checks for a minimal fee—that allow individuals to observe the life (or lives) of whomever they so desire. But what are the innate, essential traits and characteristics of an individual that extends beyond the more normative expression of romantic interest and the general curiosity that is a natural and accepted occurrence for anyone who has ever been infatuated with another? This paper will consider the intentionality and motivation behind stalking, …

Punishment And Inclusion: Race, Membership, And The Limits Of American Liberalism, Andrew Dilts

Law

At the start of the twenty-first century, 1 percent of the U.S. population is behind bars. An additional 3 percent is on parole or probation. In all but two states, incarcerated felons cannot vote, and in three states felon disenfranchisement is for life. More than 5 million adult Americans cannot vote because of a felony-class criminal conviction, meaning that more than 2 percent of otherwise eligible voters are stripped of their political rights. Nationally, fully a third of the disenfranchised are African American, effectively disenfranchising 8 percent of all African Americans in the United States. In Alabama, Kentucky, and Florida, …

Effects Of Intimate Partner Violence On Maternal Reflective Functioning And Attachment Relationship In Hispanic/Latina Women And Their Preschool-Age Children: A Qualitative Study, Patricia Martinez Burr Sep 2014

Effects Of Intimate Partner Violence On Maternal Reflective Functioning And Attachment Relationship In Hispanic/Latina Women And Their Preschool-Age Children: A Qualitative Study, Patricia Martinez Burr

Individual, Family, and Community Education ETDs

Research indicates that thousands of women across the world suffer intimate partner violence (IPV) under the hands of their partner on a daily basis. Understanding the effects of intimate partner violence on their psychological functioning and maternal response to very young children is crucial to our understanding and provision of appropriate treatment. This qualitative study used a transcendental phenomenological approach designed to analyze the in-depth interview responses of ten Hispanic/Latina mothers of preschool-age children, who had been victims of IPV within the last year to examine these effects. Given the researchers desire to better understand the effects of IPV on …

United States V. Booker And Federal Sentencing Outcomes: General, Extra-Legal, And Contextual Policy Effects, Jeffrey Nowacki Sep 2014

United States V. Booker And Federal Sentencing Outcomes: General, Extra-Legal, And Contextual Policy Effects, Jeffrey Nowacki

Sociology ETDs

Judicial discretion plays an important role in the sentencing process. Unrestrained discretion has the potential to lead to unwarranted disparity in sentencing outcomes. In an effort to constrain some of that discretion, the Federal Sentence Guidelines were implemented in 1987 so that judges were to consider just an offenders criminal history and the severity of the offense when determining sentences. In the 2005 Supreme Court case United States v. Booker, these guidelines were ruled unconstitutional and in violation of the 6th Amendment. This dissertation examines sentencing outcomes in the wake of this landmark decision. Using data from the U.S. Sentencing …

An Action Research Case Study: A Sociocultural Perspective On Native American Students Learning Mathematics In A Public Elementary School Classroom, Lisa M. Tsuchiya Sep 2014

An Action Research Case Study: A Sociocultural Perspective On Native American Students Learning Mathematics In A Public Elementary School Classroom, Lisa M. Tsuchiya

Teacher Education, Educational Leadership & Policy ETDs

This dissertation is a qualitative study utilizing action research methods to develop a case study on the experience of urban public elementary school Native American students in collaborative mathematics activities. Data was collected with observations, mathematics assessments, and interviews to study how public school Native first graders experience collaborative mathematics activities when culturally modified with Indigenous ways of knowing and being? A major challenge in analyzing this work was finding a theoretical framework that could explain the experience of Native students in a multicultural public school. Sociocultural theory was selected because it operationalizes the key features of the study: Indigenous …
