The Separate But Unequal Constitution, Adam Lamparello, Charles Maclean
The Separate But Unequal Constitution, Adam Lamparello, Charles Maclean
DePaul Law Review
The Constitution should not be a political chess match, and outcomes should not depend on the composition of the Supreme Court. The text’s written and unwritten mandates speak to a single value that should unite jurists of all interpretive persuasions: the people — not legislatures or courts — own the Constitution’s enumerated rights, and have a corresponding right to define those that are not enumerated. But those rights have not been fully realized because the Constitution has been applied in a separate — and unequal — manner.
The wealthy have increased access to the political process, the poor are disproportionately …

Criminal Justice Faculty Publications
Police sexual misconduct encompasses a range of acts from less serious noncriminal behaviors to more egregious criminal behaviors including police sexual violence. Victims of sex crimes are often reluctant to report sexual abuse when the offender is a police officer. The study provides empirical data on 771 sex-related arrest cases in years 2005-2008 of 555 sworn officers at 449 nonfederal law enforcement agencies across the United States. The study identifies and describes incidents where officers were arrested for sex crimes through a quantitative content analysis of published newspaper articles and court records. Findings focus on arrested officers and their victims.

Brown V. Plata: Renewing The Call To End Mandatory Minimum Sentencing, Steven Nauman
Brown V. Plata: Renewing The Call To End Mandatory Minimum Sentencing, Steven Nauman
Florida Law Review
After more than twenty years of litigation, the United States Supreme Court finally determined whether California’s overcrowded prison system created a constitutional violation in Brown v. Plata. With prisons and jails across the country operating at well over 100% capacity, the Court concluded what advocates had been screaming for over a decade: prison overcrowding cannot be tolerated, and the only remedy is to reduce prison populations. What the Court failed to resolve, however, was what the primary cause of prison overcrowding is and how states and the federal government are supposed to comply with capacity expectations amid concerns for …
Bringing Our Children Back From The Land Of Nod: Why The Eighth Amendment Forbids Condemning Juveniles To Die In Prison For Accessorial Felony Murder, Mariko K. Shitama
Bringing Our Children Back From The Land Of Nod: Why The Eighth Amendment Forbids Condemning Juveniles To Die In Prison For Accessorial Felony Murder, Mariko K. Shitama
Florida Law Review
Over 2,589 individuals sit in prison, where they have been condemned to die for crimes they committed before their eighteenth birthday. At least a quarter of these individuals received this sentence for accessorial felony murder, or a crime in which they did not kill or intend to kill the victim. Beginning with Roper v. Simmons in 2005 and continuing with Graham v. Florida in 2010, recent Eighth Amendment jurisprudence has recognized that juveniles are fundamentally different from adults in ways that limit the constitutionality of imposing adult punishment on them. In June 2012, the Supreme Court held that sentencing juveniles …

Today's Dream Keepers: Exploring The Personal And Professional Beliefs Of Teachers Who Successfully Provide Literacy Instruction To African American Males In Grades 3-5, Lateshia Warren
Georgia Educational Research Association Conference
The purpose of this study was to describe the personal and professional beliefs of teachers who were successful with providing literacy instruction to elementary school African American males in a Title I elementary school. This study examined the literacy practices of teachers and their beliefs about African American males. It also investigated their use of culturally relevant teaching practices. It was hypothesized that by exploring the beliefs and practices of successful teachers with African American males, this research could provide evidence of effective strategies, which could be used to impact the literacy achievement of African American males. A qualitative case …
When Words Inflict Harm: Documenting Sexuality And Gender Identity Microaggressions In Schools For Lgbtqq Youth, Darla Linville
When Words Inflict Harm: Documenting Sexuality And Gender Identity Microaggressions In Schools For Lgbtqq Youth, Darla Linville
Georgia Educational Research Association Conference
With the adoption of anti-bullying laws and policies, it may seem that things are looking up for lesbian, gay, bisexual, trans, queer or questioning (LGBTQQ) youth. We might assume that these laws and policies would better protect them from insults, harassment and violence at the hands of their peers and teachers. In fact, this is sometimes the case. But it is also the case that the insults become more covert, more implicit. Looking at microaggressions gives educational researchers and school personnel the opportunity to examine how gender nonconforming or non-heterosexual youth, or those perceived to be non-heterosexual, are assaulted, invalidated …

Safe Havens Or Dangerous Waters? A Phenomenological Study Of Abused Women's Experiences In The Family Courts Of Ontario, Lois Shereen Winstock
PhD Dissertations
This qualitative, interdisciplinary research study explores the experiences of women abused by their intimate partners who appear as litigants in family court proceedings in Ontario, and the responses of judges presiding over those proceedings.
Domestic violence and abuse affects families from all social, economic and cultural groups. Women have been overwhelmingly identified as the victims of domestic violence and abuse. Children exposed to domestic violence and abuse, either directly or indirectly, are also negatively impacted. The term woman abuse has been employed to denote the gendered nature of the phenomena.
Studies of abused womens interactions with the legal system across …
