A Portraiture Of Leadership As Enacted By School Administrators Working In Alternative Educational Settings, Eric Shawn Hall
A Portraiture Of Leadership As Enacted By School Administrators Working In Alternative Educational Settings, Eric Shawn Hall
USF Tampa Graduate Theses and Dissertations
School leadership has been an evolving topic over the past several decades, with research examining the impact of leadership on school performance, school culture, and other elements in this field. However, only a few studies have examined the construct of leadership in alternative schools, where these specialized sites often serve as mid-points between traditional schools and juvenile detention centers. Considering the evidence related to the displacement rates of minority students, particularly Black males, from traditional schools to alternative settings, these specialized sites are ideal for exploring practices that perhaps can redirect students in the school-to-prison pipeline, back towards their traditional …
Criminal Corporate Character, Robert E. Wagner
Criminal Corporate Character, Robert E. Wagner
Florida Law Review
In the last few years, corporations have been accused of crimes ranging from environmental pollution on an unprecedented scale, to manslaughter, to election tampering, to large-scale antitrust violations. Many of these accused companies had previously committed similar acts or even the exact same offense. Unfortunately, the rules of evidence in the federal system and in virtually every state system prohibit the use of this information in a prosecution for such crimes. The reasons for this prohibition are based in historical anomalies, a mistaken understanding of corporate function, and a misplaced anthropomorphism of the corporation. This combination of errors has resulted …

At its best, a university is a collection of individuals ‐‐ students and faculty ‐‐ focused on learning and discovering new knowledge. For this goal to be realized, a critical element is having faculty members deeply engaged in such discovery within their disciplines. Scholarship, in the form of journal articles, book chapters, monographs and similar endeavors, creative activity which can take an even wider range of forms, and funded research which explores the boundaries of disciplines all contribute to such engagement. Through such participation, faculty members stay at the growing edges of their fields, and in so doing, they enrich …

Reports and Publications from John Jay College
"John Jay College of Criminal Justice is pleased to publish this report documenting patterns in misdemeanor arrests in New York City (and, to a lesser extent, in New York State) over the past three decades. This report presents trends in the types of misdemeanors for which New Yorkers have been arrested; analyzes these data by the age, gender, and race/ethnicity of those receiving this enforcement attention; examines shifts in misdemeanor arrest activity by police precincts; displays changes in the issuance of Desk Appearance Tickets over time; and traces these misdemeanor arrests to the initial court disposition at arraignment." Failing To Keep "Easy Cases Easy": Florida V. Jardines Refuses To Reconcile Inconsistencies In Fourth Amendment Privacy Law By Instead Focusing On Physical Trespass, George M. Dery Iii
Loyola of Los Angeles Law Review
This Article analyzes Florida v. Jardines, in which the Supreme Court ruled that a canine sniff of a home from the front porch was a Fourth Amendment search. In reaching this ruling, the Court employed the property-rights definition of a search newly recovered the prior term in United States v. Jones instead of applying the reasonable expectation of privacy test created in Katz v. United States. This work examines the concerns created by Jardines’s ruling. This Article asserts that Jardines refused to resolve a potentially troubling incongruity between Kyllo v. United States, precedent that exalted the privacy of the home, …

An Overview Of The Rochester Drug Free Streets Initiative: A Developing Strategy That Addresses The Open-Air Marijuana Market Located In The Conkey & Clifford Neighborhood, Pedro O. Vazquez Gonzalez
Theses
Because low-level marijuana possession is not illegal in New York State, the police have difficulty intervening and eliminating the open-air marijuana markets in the City of Rochester. Project HOPE, a non-profit organization, is trying to find another way to intervene in the Conkey and Clifford neighborhood, and bring to an end the open-air marijuana market in that neighborhood. The object of this research is to identify the problems that are caused by the open- air marijuana market in the Conkey and Clifford neighborhood. I will also examine the process of project HOPE's new initiative that addresses the issues of the …

The Challenge Of Seeing Justice Done In Removal Proceedings, Jason A. Cade
The Challenge Of Seeing Justice Done In Removal Proceedings, Jason A. Cade

Prosecutorial discretion is a critical part of the administration of immigration law. This Article considers the work and responsibilities of the Immigration and Customs Enforcement (ICE) trial attorneys, who thus far have not attracted significant scholarly attention, despite playing a large role in the ground-level implementation of immigration law and policy. The Article makes three main contributions. First, I consider whether ICE attorneys have a duty to help ensure that the removal system achieves justice, rather than indiscriminately seek removal in every case and by any means necessary. As I demonstrate, trial attorneys have concrete obligations derived from statutory provisions, …
