Terror On Campus: Analyzing Macro Level Factors Of Colleges That Contribute To Forcible Rape, Lakesha Martin
All ETDs from UAB
Rapes on college campuses have been a major problem in the United States and alarming numbers of this crime occurring in our colleges and universities call for attention in this matter to provide solutions to reduce or prevent the incident of rape on campus. Institutions possess certain characteristics that may contribute to rape on campuses. This explanatory study analyzes different factors of institutions on a macro level basis to understand which factors significantly contribute to the likelihood of forcible rapes. Two hundred U.S. colleges and universities are used in this data sample to analyze their institutional demographic factors and situational …
Sex Trafficking : An Exploration Of Clinician Perspectives Of The Type And Efficacy Of Treatment Interventions, Jennifer Kung
Sex Trafficking : An Exploration Of Clinician Perspectives Of The Type And Efficacy Of Treatment Interventions, Jennifer Kung
Theses, Dissertations, and Projects
This qualitative study investigates clinician perspectives on the type of clinical interventions used in therapy with sex trafficking survivors. Due to the absence of systematic evaluation of mental health treatment for this population, the limited current research recommends interventions that are used for victims of domestic violence and sexual assault. This study's main research question is: what are the perspectives of clinicians who provide therapy for trafficking survivors on the type and usefulness of their treatment interventions? This study interviewed 11 clinicians who provided therapy for sex trafficking survivors. The major findings of this study show that the most commonly …
Identity And Cultural Competency : Critical Race And Postmodern Perspective, Nathan N. Orians
Identity And Cultural Competency : Critical Race And Postmodern Perspective, Nathan N. Orians
Theses, Dissertations, and Projects
This theoretical thesis explores how racism is unavoidable in social work because of the weight of systemic influences. It looks at how the use of cultural competency could be unethical, by using both critical race and postmodern theory. The use of critical race theory in thinking about cultural competency seems to allow for a passive acceptance of a system which has continued to be un-critical of its racist origins and assumptions. Furthermore the enacting of cultural competency through a postmodern view could at times be considered a micro aggression and as such unethical. This paper hopes that by acknowledging that …
Civil Rights 3.0, Nan D. Hunter
Civil Rights 3.0, Nan D. Hunter
Georgetown Law Faculty Publications and Other Works
It is now commonplace to hear the LGBT rights movement being described as the last, or the next, or today’s, pre-eminent civil rights issue. This chapter will explore what that means from several perspectives: What does the label tell us about the civil rights paradigm itself? If the achievement of marriage equality is the great civil rights achievement of this generation, what does that suggest about a future for equality more generally? How have new forms of, and technologies for, movement building affected the idea and practice of civil rights? Does the civil rights paradigm have a future? I focus …
The Trickle-Down War, Rosa Brooks
The Trickle-Down War, Rosa Brooks
Georgetown Law Faculty Publications and Other Works
The history of the European nation-state, wrote political sociologist Charles Tilly, is inextricably bound up with the history of warfare. To oversimplify Tilly’s nuanced and complex arguments, the story goes something like this: As power-holders (originally bandits and local strongmen) sought to expand their power, they needed capital to pay for weapons, soldiers and supplies. The need for capital and new recruits drove the creation of taxation systems and census mechanisms, and the need for more effective systems of taxation and recruitment necessitated better roads, better communications and better record keeping. This in turn enabled the creation of larger and …
The Exclusion Of Improperly Obtained Evidence At The International Criminal Court: A Principled Approach To Interpreting Article 69(7) Of The Rome Statute, Michael Madden
LLM Theses
This thesis examines article 69(7) of the Rome Statute, which creates an exclusionary rule for improperly obtained evidence at the International Criminal Court (ICC). Ultimately, the thesis proposes how the ICC should interpret its exclusionary rule. The thesis discusses the theory underlying exclusionary rules, the evidence law and remedial law contexts within which exclusionary rules operate, and numerous comparative examples of exclusionary doctrine from within national criminal justice systems. Finally, some unique aspects of international criminal procedure are described in order to demonstrate how an international exclusionary rule might need to differ from a domestic rule, and previous jurisprudence relating …
Application Of The State Immunity Rule In The International Criminal Justice System: Problems Arising And A Critique Of Legal Response Mechanisms, Celestine Nchekwube Ezennia
Application Of The State Immunity Rule In The International Criminal Justice System: Problems Arising And A Critique Of Legal Response Mechanisms, Celestine Nchekwube Ezennia
LLM Theses
The state immunity rule was founded upon such sound rationales as respect for the sovereign equality of all states and non-interference with state functions. However, its application in the international criminal justice system produces numerous problems. These include impunity for violation of peremptory international legal norms (like the prohibitions on serious international crimes) and violation of human rights. It also undermines the individual accountability and justice administration missions of the system because it shields state officials from criminal responsibility and subjects their victims to injustice. The international community has adopted various legal mechanisms which attempt to respond to these problems …

Access To Emergency Contraception And Safe Abortion Services For Survivors Of Rape: A Review Of Policies, Programmes And Country Experiences In Sub-Saharan Africa, Jill Thompson, Chi-Chi Undie, Ian Askew
Reproductive Health
This study examined how pregnancy prevention and management services (specifically, the provision of emergency contraception, pregnancy testing and counseling, and termination or referral for termination of pregnancy services) feature within post-rape care services in sub-Saharan Africa. The study drew on a range of sources via a desk review, as well as on information provided through key informant interviews. The existence of numerous national guidelines in the region demonstrates countries’ desire to respond to this public health and legal challenge. However, if left in their current state, the gaps and inconsistencies observed across most national guidelines contribute to a violation of …

Jailing Black Babies, James G. Dwyer
Jailing Black Babies, James G. Dwyer
Utah Law Review
Children-in-prison programs reflect a commendable sympathy for the lifelong disadvantage and deprivation that most prison inmates have suffered and a wish to transform their lives. But acting primarily on the basis of that sympathy and wish, rather than focusing realistically on what is truly best for children, is a moral and policy mistake. Available evidence suggests that the extreme form of connecting incarcerated birth parents with their offspring, prison nurseries, harms the great majority of those children, especially when the impact is compared to the life the children might have had if adopted immediately after birth. Advocacy for this practice …

Using Internet Artifacts To Profile A Child Pornography Suspect, Marcus K. Rogers, Kathryn C. Seigfried-Spellar
Using Internet Artifacts To Profile A Child Pornography Suspect, Marcus K. Rogers, Kathryn C. Seigfried-Spellar
Journal of Digital Forensics, Security and Law
Digital evidence plays a crucial role in child pornography investigations. However, in the following case study, the authors argue that the behavioral analysis or “profiling” of digital evidence can also play a vital role in child pornography investigations. The following case study assessed the Internet Browsing History (Internet Explorer Bookmarks, Mozilla Bookmarks, and Mozilla History) from a suspected child pornography user’s computer. The suspect in this case claimed to be conducting an ad hoc law enforcement investigation. After the URLs were classified (Neutral; Adult Porn; Child Porn; Adult Dating sites; Pictures from Social Networking Profiles; Chat Sessions; Bestiality; Data Cleaning; …
Multi-Stakeholder Case Prioritization In Digital Investigations, Joshua I. James
Multi-Stakeholder Case Prioritization In Digital Investigations, Joshua I. James
Journal of Digital Forensics, Security and Law
This work examines the problem of case prioritization in digital investigations for better utilization of limited criminal investigation resources. Current methods of case prioritization, as well as observed prioritization methods used in digital forensic investigation laboratories are examined. After, a multi-stakeholder approach to case prioritization is given that may help reduce reputational risk to digital forensic laboratories while improving resource allocation. A survey is given that shows differing opinions of investigation priority between Law Enforcement and the public that is used in the development of a prioritization model. Finally, an example case is given to demonstrate the practicality of the …

Adult Offender Recidivism Rates: How Effective Is Pre-Release And Vocational Education Programing And What Demographic Factors Contribute To An Offenders Return To Prison, James K. Bueche, Jr.
LSU Doctoral Dissertations
The primary purpose of this study was to determine if the Louisiana Department of Public Safety and Corrections’ 100 hour pre-release program and vocational education had a significant impact on offender recidivism. Additionally, a model of predicating offender recidivism using demographic data was another aspect of the study. Offenders in the study were 404 offenders who completed the pre-release program, 404 offenders who completed vocational education and 808 offenders who composed the control group. All offenders were released from prison in the year of 2010, and if they returned to prison between their release and December 31, 2013, they were …
Peers, Parent-Child Conflict, And Familial History In The Prediction Of Substance Use In College, Angela M. Holth
Peers, Parent-Child Conflict, And Familial History In The Prediction Of Substance Use In College, Angela M. Holth
Departmental Honors Projects
Using a cross-sectional study design, we examined whether peer relationships, parent-child conflict and family history of substance problems predicted substance use (frequency and quantify of alcohol, nicotine and marijuana use, age at first and alcohol and marijuana use, and maximum number of drinks consumed in a 24 hour period) in a sample of college students (N=194). Our findings suggested the following: 1) deviant peers and deviant substance using peers were significantly related to increases in all substance use measures, and a decrease in age at first alcohol, use but not age at first marijuana use. 2) there were no gender …
Guilty Of Homelessness: Evaluating The Criminalization Of Homelessness Through A Human Rights Framework, Cristina M. Semi
Guilty Of Homelessness: Evaluating The Criminalization Of Homelessness Through A Human Rights Framework, Cristina M. Semi
Departmental Honors Projects
Several international treaties and declarations affirm adequate housing as a fundamental human right. However, the United States, while a signatory to several of these agreements, does not recognize this right. Homelessness violates the right to housing. Moreover, homelessness often subjects individuals to additional rights violations. These additional violations often occur because governments criminalize homelessness.
Public order laws that criminalize basic life-sustaining behaviors, such as sitting, lying, and sleeping in public spaces, violate several constitutional rights when applied to unsheltered individuals experiencing homelessness. Devoid of any accommodation aside from the public streets, such individuals must necessarily perform the prohibited conduct in …

Women Struggle To Reach The Top: Gender Disparities In The Workplace, Shannon E. Doherty
Departmental Honors Projects
Abstract
The study examined the degree to which gender role expectations, anticipated role conflict and same-gendered role models are related to women’s career centrality. It was predicted that women who adhere more to male norms than female norms will indicate more career centrality than women who adhere more to female norms; women who anticipate less work-family conflict will indicate more career centrality; women will identify female role models more often than male role models; and women who identify female role models will report those individuals to have a higher degree of impact on their career centrality. There were 97 students …
When Speech Isn't Free: Legal Barriers And Consequences Of Reporting Sexual Violence, Kevin M. Fleming
When Speech Isn't Free: Legal Barriers And Consequences Of Reporting Sexual Violence, Kevin M. Fleming
Departmental Honors Projects
Incidents of sexual violence continue to be a serious problem for society. Likewise, acts of sexual violence impose severe consequences for survivors. The consequences initially begin at the onset of the survivor’s journey to psychological recovery following the traumatic sexual assault. The consequences take on a unique set of characteristics when the survivor attempts to use the justice system to confront the perpetrator who committed the offense. These characteristics can transform an adversarial process into an isolated battle for the survivor. In the worst cases, the justice system empowers individuals who wish to silence survivors with free speech restrictions instead …

Comparative Institutional Competency And Sovereignty In Indian Affairs, Michalyn Steele

While vigorous debate surrounds the proper scope and ambit of inherent tribal authority, there remains a critical antecedent question: whether Congress or the courts are ultimately best situated to define the contours of inherent tribal authority. In February 2013, Congress enacted controversial tribal jurisdiction provisions as part of the Violence Against Women Act reauthorization recognizing and affirming inherent tribal authority to prosecute all persons, including non-Indian offenders, for crimes of domestic violence in Indian country. This assertion by Congress of its authority to set the bounds of tribal inherent authority -- beyond where the United States Supreme Court has held …

Does Personality Play A Role In Computer Information Systems Performance?, S.E. Kruck, Patricia Sendall, Wendy Ceccucci, Alan Peslak, Scott Hunsinger
Management Faculty Publications
This study represents an analysis of student performance in computer information systems (CIS) courses and the potential influence of Jungian personality traits on academic success in CIS courses. For this study, academic success is measured by grades achieved. The MBTI measurement scale was self-analyzed by students in CIS courses from fall 2008 through spring 2013. The data showed a statistically significant correlation between various personality dichotomies of the type (Extraversion-Introversion, Sensing-Intuition, Thinking-Feeling, and JudgingPerceiving) and higher grades scores. The results of this study indicate that course performance of groups of students are different relative to their personality type. In this …
