Troubled Grounds: Florida’S Stand Your Ground Law And The Threat Of Covert Racism Against Blacks In The United States, Alexander Nicoleau Jan 2014

Troubled Grounds: Florida’S Stand Your Ground Law And The Threat Of Covert Racism Against Blacks In The United States, Alexander Nicoleau

Theses & ETDs

The United States has always had to grapple with its deep-seeded history of racial discrimination against Blacks since the start of the Antebellum era. While the U.S has progressively become more inclusive of Blacks thanks to periods of great reform like Reconstruction, and the Civil Rights Movement, laws that discriminate on the basis of race have transitioned from overt to covert. The Florida Stand Your Ground law has come under fire for being covertly racist against Blacks. The objective of this thesis is it to analyze the history of covert and overt racism in the U.S. and reveal whether or …

Training Law Enforcement In Mental Health: A Broad-Based Model, Rachael Elaine Hatfield

Theses, Dissertations and Capstones

Police officers respond to many calls involving people suffering from a mental illness; yet many law enforcement training programs and workshops do not include mental health training. A literature review was conducted to explore the problems resulting from the lack of mental health training available for law enforcement officers and identify specialized training programs currently being implemented to address those problems. The review identified several program models being implemented throughout the United States including: Joint Police/Mental Health Team Model, Mobile Crisis Unit Model, Crisis Intervention Team Model, and the Broad-Based Training Model. These models include empirically supported components used to …

Teaching Against Hierarchies: An Anarchist Approach, Stephanie Spoto Jan 2014

Teaching Against Hierarchies: An Anarchist Approach, Stephanie Spoto

Journal of Feminist Scholarship

The state of California spends more on prisons than on colleges and universities, and the fact that these two budgetary figures are often compared shows the relationship between the two state institutions. Our classrooms, starting from a very early stage, not only prepare children to be productive members of the consumer economy but educate them for complacency in the face of state violence and mass incarceration. In attempting to move away from hierarchical models of education, this article looks at the feminist pedagogical theory of bell hooks and antiauthoritarian and anarchist theorists such as Jacques Rancière and Derrick Jensen in …

The purpose of this research is to gain additional knowledge and insight about the racial disparities that persist in academic achievement and punitive methods of social control, hopefully contributing to the ongoing discussion of the ways in which to improve teacher practices and develop strategies for effectively engaging African American males in the classroom. An Implementation Plan For Integrated Dual Diagnosis Treatment, Mary Jean Dunn Jan 2014

An Implementation Plan For Integrated Dual Diagnosis Treatment, Mary Jean Dunn

Theses and Graduate Projects

Recovery from substance abuse or mental illness can be a long and difficult process. lndividuals attempting to recover from both issues face an even more complex road to healing. Research shows that treatment models, which address both illnesses simultaneously, in the same setting, have the best success. Treatment models that address both issues at once are called Integrated Dual Diagnosis Treatment (IDDT). There are a number of IDDT models around the country and Minnesota has recently finalized its framework for IDDT certification. This paper examines the most corlmonly used components of IDDT models and will study the process of implementation …

Violence Prevention In Schools: Safety & Security Measures, Timber L. Day Jan 2014

Violence Prevention In Schools: Safety & Security Measures, Timber L. Day

Theses and Graduate Projects

Media broadcasts of rampage school shootings can raise anxiety for parents, school officials and students. Violence prevention in schools is a national priority. It's time to take a closer look at what can be done to make schools safer. The results indicate that heightening school security and implementing zero tolerance policies are not the solution to the problem. Parent psycho-education, cognitive therapy, relaxation, self- monitoring and social skills training are more effective.

Trauma Informed Nursing Care For Women Who Are Marginalized: An Educational Workshop, Jenna Fadlalla Jan 2014

Trauma Informed Nursing Care For Women Who Are Marginalized: An Educational Workshop, Jenna Fadlalla

Theses and Graduate Projects

Traumatic events profoundly affect both the physical and emotional health of a woman who endures the event. Gender, socioeconomic, racial, and ethnic disparities in rates of trauma exist showing that women who are marginalized are at a higher risk for trauma. Nurses are privileged to provide care for these women in their greatest times of need, yet despite the intimate relationship between nurses and their patients, trauma is a topic that remains largely unaddressed by the field of nursing. Because trauma can have such a profound effect on health, it is essential for nurses of all specialties and at all …

Treaty Termination And Historical Gloss, Curtis A. Bradley Jan 2014

Treaty Termination And Historical Gloss, Curtis A. Bradley

Articles

The termination of U.S. treaties provides an especially rich example of how governmental practices can provide a “gloss” on the Constitution’s separation of powers. The authority to terminate treaties is not addressed specifically in the constitutional text and instead has been worked out over time through political-branch practice. This practice, moreover, has developed largely without judicial review. Despite these features, Congress and the President—and the lawyers who advise them—have generally treated this issue as a matter of constitutional law rather than merely political happenstance. Importantly, the example of treaty termination illustrates not only how historical practice can inform constitutional understandings …

Juror Internet Misconduct: A Survey Of New Hampshire Superior Court Judges, Brooke Lovett Shilo Jan 2014

Juror Internet Misconduct: A Survey Of New Hampshire Superior Court Judges, Brooke Lovett Shilo

The University of New Hampshire Law Review

[Excerpt] “The Constitution guarantees criminal defendants the right to a fair trial before an impartial jury and the right to confront the evidence against them. When a juror improperly accesses the Internet during a criminal trial, the defendant is denied these constitutional rights. The problem of outside information entering the courtroom is as old as our judicial system. As early as 1907, Justice Holmes observed that, “The theory of our [criminal justice] system is that the conclusions to be reached in a case will be induced only by evidence and argument in open court, and not by any outside influence, …

Charm City Televised & Dehumanized: How Cctv Bail Reviews Violate Due Process, Edie Fortuna Cimino, Zina Makar, Natalie Novak

University of Baltimore Law Forum

On May 28, 2013, Torrey Johnson5 struggles to raise both his hands, handcuffed and seated shoulder-to-shoulder between two other defendants in the first row of the closed circuit television (“CCTV” or “videoconference”) bail review hearing room within the Baltimore Central Booking and Intake Center (“Centeral Booking”). There are two more rows of defendants behind Mr. Johnson, all in yellow jumpsuits, being watched by correctional officers. Separated by a three-foot wall, Mr. Johnson’s public defender sits out of sight from the video camera’s field of view, about ten feet away from her client. The judge quickly reads through Mr. Johnson’s rights. …

Recent Development: Nash V. State: Jury Note Expressing Concern About Motives Behind A Juroror Ury Note Expressing Concern About Motives Behind A Jurororsumption Of Prejudice Requiring Voir Dire Sua Sponte, Nadya Cheatham

University of Baltimore Law Forum

The Court of Appeals of Maryland held that a note from a jury, containing allegations that a juror would change her original voting position if it meant she could go home earlier, did not raise a presumption of prejudice and therefore did not require the trial judge to conduct voir dire sua sponte. Nash v. State, 439 Md. 53, 94 A.3d 23 (2014). Additionally, the court held that the trial judge did not abuse her discretion when she chose to release the jurors and remind them of their duties under oath, rather than directly assuring the impartiality of the jurors. …

Electronic Control Devices & Injury Impact: An Analysis Of Secondary Data From The Arlington Police Department, Brook Rollins

Criminology & Criminal Justice Theses - Archive

For law enforcement officers, the necessity to utilize force against a citizen is a powerful aspect of the job. Recent technological advances in force options contribute to the delicate balance of a police officer and using force against a citizen. The Electronic Control Device (ECD) is one such tool of technological advancement. With the introduction of the ECD a fierce argument has emerged challenging the efficacy and safety of the devices. The Arlington Police Department deploys ECD's to its officers as a part of the daily issued equipment. The purpose of this research project is to analyze the usage of …

Disparity In Judicial Misconduct Cases: Color-Blind Diversity?, Athena D. Mutua

Journal Articles

This article presents and analyzes preliminary data on racial and gender disparities in state judicial disciplinary actions. Studies of demographic disparities in the context of judicial discipline do not exist. This paper presents a first past and preliminary look at the data collected on the issue and assembled into a database. The article is also motivated by the resistance encountered to inquiries into the demographic profile of the state bench and its judges. As such, it also tells the story of the journey undertaken to secure this information and critiques what the author terms a practice of colorblind diversity. Initially …
