The Panopticon Of International Law: B’Tselem's Camera Project And The Enforcement Of International Law In A Transnational Society, Pini Pavel Miretski, Sascha-Dominik Oliver Vladimir Bachmann

Osgoode Legal Studies Research Paper Series

This paper analyzes the influence of transnational non-state actors on compliance with international legal rules, as part of Foucault’s power/knowledge structure. Particularly it examines the effect of the “Shooting Back” project, by the Israeli NGO B’Tselem, on the level of investigations of alleged violations of the law of occupation. According to Bentham’s principles of Panoptism, power should be visible and unverifiable. The implementation of these principles by transnational actors is highlighted by the “Shooting Back” project in Israel. In 2007 the NGO B’Tselem supplied Palestinians living in high-conflict areas with video-cameras in order to capture, expose, and “seek redress for” …

Faithful Translations? Cross-Cultural Communications In Canadian Religious Freedom Litigation, Howard Kislowicz Jan 2014

Faithful Translations? Cross-Cultural Communications In Canadian Religious Freedom Litigation, Howard Kislowicz

Osgoode Legal Studies Research Paper Series

In three religious freedom cases pursued to the Supreme Court of Canada – Amselem, Multani, and Huterrian Brethren of Wilson Colony – religious freedom claimants engaged in litigation over a religious practice particular to their group. Some have argued that cases like these can be seen as cross-cultural encounters. How did the religious freedom claimants seek to make their practices – the succah, the kirpan, and the prohibition on being photographed – understood to the courts? And how did the courts respond to these claims? In this paper, I draw out two central values from the literature on cross-cultural communication: …

Diminished Returns: The Exorbitance Of Collecting Dna From All Arrestees, Carlos Jordi Jan 2014

Diminished Returns: The Exorbitance Of Collecting Dna From All Arrestees, Carlos Jordi

St. Thomas Law Review

This comment will examine the effects of a criminal justice system where DNA is collected from everyone who is arrested, regardless of the seriousness of the charge. Part L.A will begin with an analysis of King to provide an understanding of how the Supreme Court decision may permit states to collect DNA from all arrestees. DNA is used in the criminal justice system because of its ability to effectively identify people. Part I.B discusses DNA science and provides a cursory understanding of how information is gathered from an individual's genetic code. Part I.C displays how law enforcement uses DNA for …

Reconciliation And The Rule Of Law: The Changing Role Of International War Crimes Tribunals, Oriana Lavilla Jan 2014

Reconciliation And The Rule Of Law: The Changing Role Of International War Crimes Tribunals, Oriana Lavilla

Claremont-UC Undergraduate Research Conference on the European Union

This paper explores the relationship between international war crimes tribunals and reconciliation in post-conflict societies. The aim of the present study was to examine how the role of international war crimes tribunals has changed in the peacebuilding process since the early years after World War II. Due to the evolving nature of international law and the international criminal legal system, international tribunals have become increasingly recognized as an integral component of peacebuilding in post-conflict societies. The International Criminal Tribunal for the former Yugoslavia (ICTY) was the first international tribunal with a mandate to contribute to international peace and security. The …

Crime, Income Inequality, And Density At The Neighborhood Level, Andrew Hovel Jan 2014

Crime, Income Inequality, And Density At The Neighborhood Level, Andrew Hovel

Honors Theses, 1963-2015

An economic model of crime gives policymakers a basis to understand how income inequality and population density relate to crime at the neighborhood level. This study reveals a negative and significant relationship between population density in Census tracts and both property and violent crime rates. It finds ambiguous results that vary by city for income inequality. This cross-sectional analysis of Census tracts in Chicago, Los Angeles, Houston, and Dallas uses crime and demographic data from the National Neighborhood Crime Study. This study also yields interesting results about the importance of residential stability for crime prevention and comments on possible urban …

The Jury Process: Racial Bias, Extraversion, Leadership, & Sex, Amanda Nusbaum Jan 2014

The Jury Process: Racial Bias, Extraversion, Leadership, & Sex, Amanda Nusbaum

Honors Theses, 1963-2015

This study explored the interactions between individuals’ attitudes and group dynamics during the jury deliberation process. More specifically, whether implicit racial bias are correlated with pre-deliberation decision of innocence and which factors contribute to an individual’s tendency to take on a leadership role in a mock jury setting. 10 mock juries, consisting of groups of 4 White undergraduate students, participated in this experiment. Each participant completed an Implicit Association Test (IAT) and a self-report survey to examine racial bias, a self-report personality survey to examine extraversion, and then participated in a mock jury deliberation. Results showed that implicit racial bias …

The Māori Stairway To Heaven, Louis Midgley Jan 2014

The Māori Stairway To Heaven, Louis Midgley

Interpreter: A Journal of Latter-day Saint Faith and Scholarship

Jason Hartley’s book manifests a passion for alleviating the problem of Māori surging into the prisons of Aotearoa/New Zealand2 by restoring their old, traditional religious ethos and the social control that hinges on the recovery of the old belief that they are potentially noble children of God. In setting out his own disappointing discovery of the roots of both a growing problem and what he believes is the solution, he describes how he came to learn the arcane moral teachings, or old stories, that once buttressed Māori social order. For Latter-day Saints, he also demonstrates that for some Māori, despite …

BACKGROUND: Although funding has supported the scale up of routine, opt-out HIV testing in the US, variance in implementation mechanisms and barriers in high-burden jurisdictions remains unknown.

METHODS: We conducted a survey of health care organizations in Washington, DC and Houston/Harris County to determine number of HIV tests completed in 2011, policy and practices associated with HIV testing, funding mechanisms, and reported barriers to testing in each jurisdiction and to compare results between jurisdictions.

RESULTS: In 2012, 43 Houston and 35 DC HIV-testing organizations participated in the survey. Participants represented 85% of Department of Health-supported testers in DC and 90% …

International Human Rights In Canada: At The Juncture Of Law And Politics, Faisal Bhabha Jan 2014

International Human Rights In Canada: At The Juncture Of Law And Politics, Faisal Bhabha

Osgoode Legal Studies Research Paper Series

This paper addresses the topic of international human rights law from the Canadian perspective. As the title suggests, this paper’s analysis of the topic sits at the intersection of law and politics, where all questions of international law necessarily do. It proceeds in three parts. First, it provides a sketch of the political context, drawing from recent events and trends, to describe a conflicted official government approach to international human rights. Next, it examines the formal legal status of international human rights law in Canada, drawing selectively from Supreme Court of Canada jurisprudence. Finally, it addresses the adoption of the …

Poetry, Mercy, And The Phenomenology Of Justice, Benjamin L. Berger Jan 2014

Poetry, Mercy, And The Phenomenology Of Justice, Benjamin L. Berger

Osgoode Legal Studies Research Paper Series

What would a phenomenology of justice look like and what role would mercy play in that account? The unruly experiences and lives of the individuals and communities wrapped up in the dramas of justice are paradoxically distant from legal and philosophical reasoning, laundered by rules of evidence for the instrumental exigencies of the former, and frequently effaced by the disciplinary conventions of the latter. One casualty of these habits of reflection is our understanding of the role of mercy in the experience of justice. Wanting to recapture space to imagine the role of mercy in justice, this paper makes an …

Investigating Integrated Domestic Violence Courts: Lessons From New York, Jennifer Koshan Jan 2014

Investigating Integrated Domestic Violence Courts: Lessons From New York, Jennifer Koshan

Osgoode Legal Studies Research Paper Series

Extensive law and policy reforms in the area of domestic violence have occurred in the last several decades in the United States and Canada, the latest being the development of specialized domestic violence (DV) courts. DV courts typically operate in the criminal realm, particularly in Canada. A recent innovation that is relatively unique in the U.S. is Integrated Domestic Violence (IDV) courts, where criminal, civil and family matters are heard together in a one judge/one family model. This paper examines the literature on DV and IDV courts in Canada and the U.S., and situates these reforms in the context of …

Observations On History, Law, And The Rise Of The New Jim Crow In State-Level Immigration Law And Policy For Latinos, Tom I. Romero Jan 2014

Observations On History, Law, And The Rise Of The New Jim Crow In State-Level Immigration Law And Policy For Latinos, Tom I. Romero

Sturm College of Law: Faculty Scholarship

This essay works to connect the history of local enforcement of immigration law and policy against Mexican migrants and Mexican American citizens and its relationship to the creation and perpetuation of what Michelle Alexander has described as a redesigned caste system in the United States. As state and local government authorities then and now sought to define and respond to a “Mexican menace” as the failed enforcement of federal immigration law, such law and policy challenged not only Congress’s seemingly settled plenary power to determine who had license and permission to be in the United States but also who had …

Influence Of Popular Television Programming On Students’ Perception About Course Selection, Major, And Career, Kristy Tucciarone

Faculty Scholarship

This study explores the ways in which television programming influences undergraduate students’ perceptions of careers in advertising and related fields. Drawing on cultivation theory, the research examines how repeated exposure to television portrayals of professional life can shape expectations and decision-making about college majors and career paths. The analysis focuses on two series—Mad Men and Trust Me—which depict advertising professionals in contrasting but influential ways.

Using a focus group methodology, the study engaged undergraduate students enrolled in advertising and communication-related courses. Participants were asked to discuss their viewing experiences, perceptions of advertising careers as presented on television, and …
