Laboratory Evaluation Of A Prospective Remediation Method For Pcb-Contaminated Paint, Erin K H Saitta, Michael J. Gittings, Christian Clausen, Jacqueline Quinn, Cherie L. Yestrebsky

Background: Paint laden with polychlorinated biphenyls (PCBs) often acts as a point source for environmental contamination. It is advantageous to address contaminated paint before the PCBs transport to surrounding media; however, current disposal methods of painted material introduce a variety of complications. Previous work demonstrates that PCBs can be broken down at ambient temperatures and pressures through a degradation process involving magnesium metal and acidified ethanol. This report is an extension of that work by describing the development of a delivery system for said reaction in preparation for a field test. Two treatment options including the Activated Metal Treatment System …

Giving Meaning To “Meaningful Enough”: Why Trevino Requires New Counsel On Appeal, Devon Lash
Fordham Law Review
Generally, defendants cannot raise new claims in a writ of habeas corpus unless they can accomplish the difficult task of showing that they could not have raised the claims earlier. In 2012, the U.S. Supreme Court laid out an equitable exception that allows defendants to claim—for the first time in a writ of habeas corpus—that they had an ineffective trial attorney if their failure to make a timely claim was due to a second ineffective attorney or no attorney whatsoever. The exception, however, only applied to defendants in states that required ineffective assistance claims to be brought in collateral proceedings, …

This article discusses an action research study of a week-long Summer Teachers Institute which immersed teachers in the study of Jewish historical and cultural texts. We investigate how this kind of cultural immersion created opportunities for transformative learning – the kind of learning that would not merely be the application of “new lessons,” but that would also help teachers reconceptualize their teaching practices regarding Jewish religion and culture. Our findings suggest that text study practices of challenging – in tandem with practices of supporting and voicing – were central in constructing a “relational learning community.” Such a community was a …

Conceptualizing And Reconceptualizing The Reporter’S Privilege In The Age Of Wikileaks, Rachel Harris
Conceptualizing And Reconceptualizing The Reporter’S Privilege In The Age Of Wikileaks, Rachel Harris
Fordham Law Review
The examination of the reporter’s privilege in light of WikiLeaks gives rise to several imperative questions. Could WikiLeaks claim a federal reporter’s privilege if the U.S. government were to ask it to disclose the sources of its documents? Does the current federal law on reporter’s privilege adequately address new media, such as WikiLeaks? And if not, how should the law evolve to sufficiently accommodate organizations like WikiLeaks?
This Note seeks to answer these questions. First, this Note advocates that WikiLeaks would be able to claim the privilege under current federal law. Second, this Note concludes that the current law on …

Anonymity, The Production Of Goods, And Institutional Design, Jeffrey M. Skopek
Anonymity, The Production Of Goods, And Institutional Design, Jeffrey M. Skopek
Fordham Law Review
In this Article, I demonstrate that anonymity has been misconceived as an aspect of privacy, and that understanding this mistake reveals a powerful and underutilized set of legal tools for facilitating and controlling the production of information and other social “goods” (ranging from uncorrupted votes and campaign donations to tissue samples and funding for biomedical research). There are three core components to this analysis. First, I offer a taxonomic analysis of existing law, revealing that in areas ranging from contract and copyright to criminal law and constitutional law, the production of information and other goods is being targeted by three …

Innocence Presumed: A New Analysis Of Innocence As A Constitutional Claim, Paige Kaneb
Innocence Presumed: A New Analysis Of Innocence As A Constitutional Claim, Paige Kaneb
Faculty Publications
The Supreme Court has never resolved whether innocence is a freestanding constitutional claim. Many critics have mistakenly contended that the Court held in 1993 that innocence is not a federal constitutional claim. As a result, much of the literature has failed to recognize that the door for such claims remains open, or that relevant circumstances have changed and thus the constitutional analysis has changed as well.
In the past two decades, a consensus has emerged among states recognizing the right to judicial review of compelling claims of innocence. In the wake of DNA exonerations, the states reacted uniformly in providing …

Privatization Of Prisons: Costs And Consequences, Alex Friedmann, Kathryn Hamoudah, Alec Karakatsanis
Privatization Of Prisons: Costs And Consequences, Alex Friedmann, Kathryn Hamoudah, Alec Karakatsanis
Working in the Public Interest Conferences
The privatization of prisons is generally undertaken by states to lower the cost to the public of housing prisoners. Whether cost savings actually result is debatable. Importantly, the ways in which private prisons do cut costs are problematic from the perspective of public safety, human rights, and public policy. In some well-documented cases, prisoners have escaped due to lax security and poorly trained staff. More generally, staff turnover rates are often high and the compensation packages of private prison guards may be inadequate to attract the best candidates. The U.S. Department of Justice produced a report in June of 2013 …
Delivering Public Assistance: What Does It Mean To Follow The Law?, Patrick Cates, Keith Horton, Frances Fox Piven
Delivering Public Assistance: What Does It Mean To Follow The Law?, Patrick Cates, Keith Horton, Frances Fox Piven
Working in the Public Interest Conferences
Temporary Assistance for Needy Families (TANF) is the rare public program that provides direct assistance to families in need. Georgia, like other states, receives block grants to administer TANF. What is the current state of the TANF program in Georgia and is assistance getting to those who need it? Should the state be more proactive in reaching out to those who qualify for assistance? Are there times when qualifying families are unable to access benefits due to administrative hurdles and poor customer service? What recourse do families have if they are not treated fairly by TANF administrators? This panel will …
