Out Of Place: Racial Stereotypes And The Ecology Of Frisks And Searches Following Traffic Stops, Leo Carroll, M. Liliana Gonzalez Mar 2014

Out Of Place: Racial Stereotypes And The Ecology Of Frisks And Searches Following Traffic Stops, Leo Carroll, M. Liliana Gonzalez

Sociology and Anthropology Faculty Publications

Objectives: Test hypotheses drawn from Smith and Alpert's social conditioning theory that explains biased policing as the result of implicit racial stereotypes. Distinguishing between frisks, external pat-downs, and probable cause searches, we hypothesize that (1) black drivers are more likely than white drivers to be frisked and searched; (2) racial disparity is greater in frisks than searches; (3) racial disparity in frisks, but not searches, is conditional upon the racial composition of the community; and (4) that drivers' race is not related to the productivity of searches. Methods: Data are all traffic stops made by the Rhode Island …

Icc Fugitives: The Need For Bespoke Solutions, Beth Van Schaack Mar 2014

Icc Fugitives: The Need For Bespoke Solutions, Beth Van Schaack

Faculty Publications

It is axiomatic that the ICC depends on the cooperation of the international community, including state parties and non-party states alike, to carry out its mandate to prosecute the “most serious crimes of international concern.” Nowhere is this dependency more apparent than with respect to the imperative of gaining custody of the accused. Given the high degree of situational variation, strategies aimed at gaining custody of one fugitive will not necessarily be effective with others. As such, the international community — in coordination with the Court — needs to devise bespoke solutions. This paper discusses the particular circumstances of each …

The New Policing Of Business Crime, Rachel E. Barkow Mar 2014

The New Policing Of Business Crime, Rachel E. Barkow

Seattle University Law Review

The central goal of this Article is to describe the burgeoning turn to new policing techniques in the business crime context and to offer some initial thoughts on the promises and limits of the approach. Part II begins by explaining the traditional or “old policing” of business crime. After implementing an initial strategy that focused on pursuing individuals, the government turned its attention to the organizations where those individuals operated. It increased the sanctions for violators and sought to target companies in an effort to prompt them to adopt internal compliance pro-grams. The focus on company compliance programs was designed …

Key Ingredients In The Rule Of Law Recipe: The Role Of Judicial Independence In The Effective Establishment Of The Rule Of Law, Lauren A. Shumate

USF Tampa Graduate Theses and Dissertations

In recent decades, countries around the globe have engaged in rule of law and judicial reform initiatives, with such efforts being most prominent in transitional democracies, post-conflict and post-communist countries. Despite the fact that the concepts of judicial independence and the rule of law continue to be contested among political and legal scholars, popular wisdom and belief in the international community suggests that an independent judiciary is the cornerstone of a democratic, market-based society based on the rule of law. However, the disagreement over the extent to which an independent judiciary effects the establishment of the rule of law has …
