Towards International Criminalization Of Transboundry Environmental Crimes, Hamdan Qudah
Towards International Criminalization Of Transboundry Environmental Crimes, Hamdan Qudah
Dissertations & Theses
This dissertation puts forward the argument that violations of the International Covenant on Economic, Social and Cultural Rights should be penalized under a criminal body of international law. The theories brought forth under this proposal stems from the field of green criminology, which explores the criminal application of law in the context of environmental protection. The concept of crimes against future generations can be the crux of new law that can be used to criminalize conduct against the interest of future populations. In an effort to maintain sustainable development which centers on environmental protection, economic protection and social development, the …
Bridging The Gap Between Commercial Sexual Exploitation Of Children And Responses From Law Enforcement, Ruth Y. Kasalwe
Bridging The Gap Between Commercial Sexual Exploitation Of Children And Responses From Law Enforcement, Ruth Y. Kasalwe
Dissertations, Theses and Capstone Projects (Full IR Collection)
Commercial sexual exploitation of children (CSEC) has become a growing crime in most cities in the United States, particularly Atlanta. There seems to be a gap between these types of crime and how law enforcement responds to them. This paper discussed why Atlanta has attracted such a crime and how local law enforcement is dealing with the issue, as well as current laws that are in place to combat this crime. In particular, this study will answer two main questions: (1) Why is Metro Atlanta a hotspot for CSEC? (2) How can local law enforcement better respond to CSEC? The …

An Assault On Liberty: The 2012 National Defense Authorization Act And The Indefinite Military Detention Of Us Citizens Without Charge Or Trial, Matthew M. D'Angelo
Political Science
In the wake of 9/11 the U.S. Government has passed a host of counter-terrorism laws that provide the Executive Branch and the President of the United States frightening levels of authority. The Authorization for Use of Military Force Against Terrorists of 2001 (AUMF) and the National Defense Authorization Act for Fiscal Year 2012 (NDAA) include provisions or have been interpreted to allow the President to indefinitely detain terrorism suspects in military custody without charge or trial. This includes the potential application of these laws to American citizens. This thesis will analyze these statutes and relevant jurisprudence on the subject of …
A Spatial Analysis Test Of Decennial Crime Patterns In The United States, Kristina R. Donathan
A Spatial Analysis Test Of Decennial Crime Patterns In The United States, Kristina R. Donathan
UNLV Theses, Dissertations, Professional Papers, and Capstones
Crime in the United States has steadily been decreasing since the 1990s. Social disorganization theory states that breakdowns of social institutions were the root causes of juvenile delinquency. Using exogenous variables of poverty, residential mobility, and ethnic heterogeneity, this study aims to investigate the impacts and magnitude of these variables on violent and property crime committed in the United States for adults and for juveniles. By comparing adult crime rates to juvenile delinquency rates, these findings will guide policy makers to develop effective policy tools that will provide a safer environment for the community. Using annual crime datasets, this thesis …
The Special Tribunal For Lebanon: A Defense Perspective, Charles Chernor Jalloh
The Special Tribunal For Lebanon: A Defense Perspective, Charles Chernor Jalloh
Articles
This Article analyzes the absence of organs tasked with guaranteeing the rights of the defense in international criminal law. It explains the historical origins of the problem, tracing it back to the genesis of modern prosecutions at the Nuremberg International Military Tribunal. It then explains how the organizational charts of the UN courts for the former Yugoslavia, Rwanda, and Sierra Leone omitted the defense and essentially treated it as a second class citizen before the eyes of the law. This sets the stage for the author to show why the creation of the first full-fledged defense organ in international criminal …

All About Life: Analyzing The Most Effective Interventions In A Colorado Juvenile Diversion Program, Kamille Mckinney
Master's Theses
Far too often in our society offenders in the criminal justice system started their criminal careers as juveniles and never found a way to dig themselves out of the black hole that is delinquency. In recent years, across the nation, there has been great effort expended in finding early interventions for juveniles to deter them away from the criminal justice system before they delve into a negative life trajectory. In Colorado multiple jurisdictions utilize diversion programs as a way to keep juvenile offenders out of the formal court system. This research examines one such Juvenile Diversion Program in the Fifth …

"To Corral And Control The Ghetto": Stop, Frisk, And The Geography Of Freedom, Anders Walker
University of Richmond Law Review
While criminal law scholar Michelle Alexander has shown that stop and frisks often serve as the gateway into the criminal justice system for young men of color, she occludes the complex forces that led to their rise." This article seeks to identify those forces, relating the rise of stop and frisk rules to liberal politics, Cold War concerns, and spatial dynamics. To illustrate, this article will proceed in three parts. Part I will demonstrate how Mapp v. Ohio coincided with judicial frustration at police intrusions into private, intimate space-including private thought-precisely at a time when the United States sought to …
A Case Study Of The Early Institutionalization Process Of A Restorative Justice Social Movement Organization., Brittany Buttry-Watson
A Case Study Of The Early Institutionalization Process Of A Restorative Justice Social Movement Organization., Brittany Buttry-Watson
Electronic Theses and Dissertations
This study investigates the early development process of a restorative justice social movement organization in Louisville, KY. Utilizing social movement and organizational frameworks, this case study seeks to expand knowledge on the early developmental period for small, locally founded social movement organizations. Results from this study confirm claims in the literature about the critical nature of an organization’s structure, networks, and strategy. The analysis also discovers an unexplored strategy for organizational development, i.e. preemptive co-optation. Restorative Justice Louisville deliberatively sought co-optation by the institution they were attempting to change, the juvenile justice system, from early in their development. Due to …

Prevalence Of Knowledge In Forensic Anthropological Field Methods Within Traditional Forensic Investigation., Cassandra Christina Rausch 1988-
Electronic Theses and Dissertations
As forensic evidence has come to be of increasing importance in the courtroom, standards and practices regarding documentation, collection, and preservation of evidence have also become increasingly necessary. This study examines forensic anthropological field methods and their incorporation into crime scene investigation. Prior research suggests that incorporation could increase evidence recovery, result in better preservation of evidence, and enhance chain of custody. Examination of baseline survey data and a specific cross-regional analysis seeks to discover how/if these methods are being utilized within crime scene investigation. Baseline results are compared with follow-up interviews from a small sample of agencies to examine …

This report takes into account the primary objectives of the Office of Substance Abuse and Mental Health Services (SAMHS): to identify substance abuse patterns in defined geographical areas, establish substance abuse trends, detect emerging substances, and provide information for policy development and program planning. It also highlights all the prevention priorities identified in the SAMHS strategic prevention plan: underage drinking, high-risk drinking among 18-25 year olds, misuse of prescription drugs among 18-25 year olds, and marijuana use in 12-25 year olds; as well as monitors the progress being made to address these priorities. This report includes data available through December …
Hot Crime: Economic Analysis And Insight Into The Relationship Between A City's Latitude And Its Rate Of Violence, Erin K. Piepenbrok
Hot Crime: Economic Analysis And Insight Into The Relationship Between A City's Latitude And Its Rate Of Violence, Erin K. Piepenbrok
Economics Undergraduate Honors Theses
Every day in America, a case of violent crime makes headlines across the television, newspapers, websites, and social media. These tragedies deeply affect those directly involved and the communities in which the crimes take place. Not only are individuals physically and mentally affected by violent crime, but communities and cities suffer an economic loss from rising violent crime rates. Reducing the current rates of violent crime (robbery, assaults, rapes, and murders) can reduce costs for cities and taxpayers, while ultimately improving the quality of life for Americans. Research into what affects violent crime rates lead to discoveries that unemployment, gun …

Is Finra A State Actor? A Question That Exposes The Flaws Of The State Action Doctrine And Suggests A Way To Redeem It, Michael Deshmukh
Vanderbilt Law Review
For over seventy years, the National Association of Securities Dealers ("NASD") was the principal self-regulatory organization ("SRO") responsible for the regulation and oversight of the U.S. securities market.' In 2000, working with the Securities and Exchange Commission ("SEC") and the New York Stock Exchange ("NYSE"), the NASD initiated a joint investigation into twelve investment firms that were allegedly "spinning" initial public, offerings. This sort of regulatory interplay between the NASD and the NYSE governed the industry until 2008, when self-regulatory power was further consolidated by a merger between the NASD and the regulatory arm of the NYSE. The resulting organization, …
Incompetent But Deportable: The Case For A Right To Mental Competence In Removal Proceedings, Fatma E. Marouf
Incompetent But Deportable: The Case For A Right To Mental Competence In Removal Proceedings, Fatma E. Marouf
UC Law Journal
Important strides are currently being made toward increasing procedural due process protections for noncitizens with serious mental disabilities in removal proceedings, such as providing them with competency hearings and appointed counsel. This Article goes even further, arguing that courts should recognize a substantive due process right to competence in removal proceedings, which would prevent those found mentally incompetent from being deported. Recognizing a right to competence in a quasi-criminal proceeding such as removal would not be unprecedented, as most states already recognize this right in juvenile adjudication proceedings. The Article demonstrates that the same reasons underlying the prohibition against trial …

Perspectives On Criminal Litigation Ethics: James Cole & Jeffrey Adachi, James Cole, Jeffrey Adachi
UC Law Journal
In August 2013, U.C. Hastings College of the Law was honored to host its first ever MCLE conference addressing “Criminal Litigation Ethics.” MCLE, of course, means “mandatory continuing legal education,” and I was pleased to organize a conference that addressed, in an academic setting, this vital topic of practical lawyering that appears in the headlines almost every day. Our unique objective was to provide two full days of hands-on training by nationally prominent criminal defense and prosecution lawyers, for litigating lawyers as well as law students, separated by setting and geography from the competition of daily practice. The conference was …
Physical And Mental Health Status Of Adults With Serious Mental Illness Participating In A Jail Diversion Intervention, Robin Telford
Physical And Mental Health Status Of Adults With Serious Mental Illness Participating In A Jail Diversion Intervention, Robin Telford
USF Tampa Graduate Theses and Dissertations
Adults with mental illnesses are at an increased risk to be diagnosed with one or more comorbid physical illnesses compared to the general population. Much of the disparities faced by adults with serious mental illnesses (SMI) can be attributed to medication side effects, increased risk for metabolic diseases, inability to communicate about severity and monitor physical health symptoms, poor health behaviors, high rates of smoking, and poor quality health care. The rate of physical illnesses for adults with mental illnesses are even higher among those who have been involved with the criminal justice system. In order to understand the relationship …
In Defense Of American Criminal Justice, J. H. Wilkinson, Iii
In Defense Of American Criminal Justice, J. H. Wilkinson, Iii
Vanderbilt Law Review
The American criminal justice system is on trial. A chorus of commentators-often but not exclusively in the legal academy-has leveled a sharp indictment of criminal process in our country. The indictment charges that large flaws infect nearly every stage of the adjudicatory process. And the prescriptions are equally far-reaching, with calls for abolition of many current practices and an overhaul of the entire system. What is more, the critics issue their condemnations essentially as givens, often claiming that all reasonable people could not help but agree that fair treatment of the accused has been fatally compromised. For these critics, "We …

The Therapeutic Role Of Forgiveness In Restorative Justice, Obinna Paschal Ezeihuoma
The Therapeutic Role Of Forgiveness In Restorative Justice, Obinna Paschal Ezeihuoma
Theses (Pre-2016)
The criminal justice system does not currently emphasize the role of forgiveness m the application of justice. Criminal justice procedures and practices have been dominated by the punitive preference of the state, whose interest is traditionally hinged on deterrence, incapacitation, and retributive justice. This thesis will scrutinize the literature of restorative justice and apply the principles of restorative justice to Quinney's (1993) compassionate criminology, which encourages personal and social transformation. Additionally, using secondary cum content analyses of existing criminal justice cases (i.e., case law); this study will utilize qualitative methods by exploring the linkages between the idea of restorative justice …
