A Hermeneutic Exploration Of And Proposed Solution To The Schism Between Researchers And Clinicians In Psychology, Mark S. Green Aug 2014

A Hermeneutic Exploration Of And Proposed Solution To The Schism Between Researchers And Clinicians In Psychology, Mark S. Green

All-Inclusive List of Electronic Theses and Dissertations

Fragmentation in the field of psychology has persisted throughout its history (Slife, 2000). One example of this fragmentation is the gap between researchers and clinicians (Teachman, Drabick, Hershenberg, Vivian, & Wolfe 2012). Although many attempts have been made to bridge this gap, there is still no consensus regarding its resolution. This dissertation provides an explanation for the gap at the philosophical level and provides a method for communicating across potentially incommensurable philosophies, based on Gadamer’s (1960/1989) hermeneutic opus: Truth and Method.

Community At The Courts: Social And Community Interactions At Public Basketball Courts, Elizabeth Arnaud Fogle Aug 2014

Community At The Courts: Social And Community Interactions At Public Basketball Courts, Elizabeth Arnaud Fogle

Graduate Theses and Dissertations

Based on over 60 informal interviews conducted at two public basketball courts, this study utilizes grounded theory to trace class- and race-based differences in the social interactions occurring at both parks. By comparing social interactions between a white, middle class basketball court, and a black, lower class basketball court, I argue that social engagement is not be declining for all segments of society as some theorists suggest. Moreover, I argue that the relationships forged at the basketball court in a predominantly black, working-class neighborhood prove to be more meaningful and have deeper benefits than those forged at a basketball court …

Single Tube, Multiple Enzyme Reaction For Detection Of Uv And Oxidative Damage In Forensic Physiological Stains, Nicholas J. Eurek Aug 2014

Single Tube, Multiple Enzyme Reaction For Detection Of Uv And Oxidative Damage In Forensic Physiological Stains, Nicholas J. Eurek

Department of Biochemistry: Dissertations, Theses, and Student Research

For decades, the use of DNA as a biological tool has revolutionized forensic investigations. The primary use of this genetic evidence is for identification of a victim or suspect through short tandem repeat (STR) profiling. However, the usefulness of this evidence can be compromised through inhibition of PCR, damage to the DNA, or low copy number. Here, we investigate damage induced to DNA by environmental factors. UV light is known to damage DNA by the formation of cyclobutane pyrimidine dimers, 6-4 photoproducts, and strand breaks. These lesions can stall polymerase action or misincorporate bases during extension. Oxidative damage is also …

Beyond The Civil Rights Act Of 1964: Confronting Structural Racism In The Workplace, William M. Wiececk, Judy L. Hamilton Aug 2014

Beyond The Civil Rights Act Of 1964: Confronting Structural Racism In The Workplace, William M. Wiececk, Judy L. Hamilton

Louisiana Law Review

Since 1967, sociologists have produced a compelling body of literature on structural racism that explains why severe racial disparities persist throughout American society in all social domains: employment, education, residential patterns, wealth accumulation, and so on. Structural racism perpetuates the effects of past, overt discrimination because it does its work through organizational procedures and social policies that appear to be race neutral. Dealing with structural racism requires us to focus on social structure instead of the intentions of bigoted individuals. In this Article, we link the disciplines of sociology and constitutional history to demonstrate that the U.S. Supreme Court has …

Prison, Perceptions, And Policy: Authoritarianism And Attitudes Toward Sexual Assault Victims In U.S. Correctional Facilities, Amy Michelle Magnus Aug 2014

Prison, Perceptions, And Policy: Authoritarianism And Attitudes Toward Sexual Assault Victims In U.S. Correctional Facilities, Amy Michelle Magnus

UNLV Theses, Dissertations, Professional Papers, and Capstones

Existing research on sexual victimization in correctional facilities has expanded since the enactment of the Prison Rape Elimination Act (PREA) of 2003. Previous literature suggests that the prevalence of sexual victimization in prisons is unknown, yet the known ramifications of reported sexual assaults are serious for both the individuals involved and the institution. Government policies such as the Prison Rape Elimination Act (PREA) of 2003 attempt to address the issue of sexual violence in U.S. correctional facilities. Limitations of PREA, however, derive from a lack of clear distinction between coerced and consensual behavior and how these ideas manifest and co-exist …

Physical Child Abuse And Cultural Differences In Reporting, Emily Frances Reed

UNLV Theses, Dissertations, Professional Papers, and Capstones

Previous research using both National Child Abuse and Neglect Data System (NCANDS) data and other sources has found that biases do exist with regard to racial differences. The current study will build on past research of biases in the Child Protective Services (CPS) involvement and reporting. This study uses a secondary data set, the 2009 NCANDS dataset; which consists of child specific data of all investigated reports of maltreatment to state CPS agencies. This research seeks to determine if there are disparities in cases reported to and substantiated by CPS as reflected by race (Black, White, & Hispanic children) and …

The Role Of Self-Concept In Consumer Behavior, Marisa Toth Aug 2014

The Role Of Self-Concept In Consumer Behavior, Marisa Toth

UNLV Theses, Dissertations, Professional Papers, and Capstones

Understanding the influences underlying consumption has become an increasingly important goal for marketers. This study examined the role of self-concept in consumer behavior, specifically product evaluation. The influences of various dimensions of the self-concept are examined in regard to four product dimensions: public luxury, public necessity, private luxury, and private necessity. Differences due to variations in individual levels of self-monitoring are also measured. Overall, results showed that the more conspicuous a product is (higher on luxury/public dimensions) the greater the relationship between evaluation and ideal self-images (ideal self and ideal social self) for both high and low self-monitors.

Reducing Court-Related Stress Through Court Education: Examining Child Witnesses, Attorneys And Parents, Brittnie Turquoise Watkins Aug 2014

Reducing Court-Related Stress Through Court Education: Examining Child Witnesses, Attorneys And Parents, Brittnie Turquoise Watkins

UNLV Theses, Dissertations, Professional Papers, and Capstones

Court education presents a useful approach to addressing children's stress, anxiety or fear related to testifying. The current study uses a pretest-posttest design to evaluate whether Kids' Court School (KCS), a court education program in Clark County, Nevada, reduces court-related stress in child witnesses. In addition, attorneys' and parents' concerns related to various elements of the child's impending testimony, are evaluated. The measure used to assess stress was the Court-Related Stress Scale (CRSS), a 10-item Likert scale adapted from the Stressfulness of Life Scale. In addition, open-ended questions were posed at the time of posttest. The CRSS was administered to …

Attitudes And Perceptions Toward Sex Tourism In Las Vegas, Carolyn Willis Aug 2014

Attitudes And Perceptions Toward Sex Tourism In Las Vegas, Carolyn Willis

UNLV Theses, Dissertations, Professional Papers, and Capstones

The purpose of this study is to explore attitudes and perceptions as they relate to the consensual and non-consensual aspect of sex and tourism. This practice of engaging in sexual activities, aligned with the tourism industry, is referred to as `sex tourism', `romance tourism', or `prostitution tourism'. This has evolved into a global phenomenon where sex has become a commodity in many tourist destinations. Previous research available from Asia, Europe, the Caribbean, and Central America will be used to demonstrate similar patterns in transnational motivations and practices by looking at concepts, perceptions, legality, and potential exploitation as it relates to …

Finding The Lost Involuntary Public Figure, Jeffrey Omar Usman Aug 2014

Finding The Lost Involuntary Public Figure, Jeffrey Omar Usman

Utah Law Review

This Article follows Aristotle’s guidance that “[i]f you would understand anything, observe its beginning and its development.” That is precisely how the discussion in this Article begins in Part I, through observation of the beginning and development of the Supreme Court’s jurisprudence on the constitutional limitations imposed upon defamation actions under the First Amendment to the United States Constitution. Part II of the Article then briefly sets forth the constitutional framework that the Supreme Court imposed in 1974 on defamation actions in Gertz v. Robert Welch, Inc. The Article then addresses in Part III how the pressures of the First …

Outsiders Looking In: Advancing The Immigrant Worker Movement Through Strategic Mainstreaming, Jennifer J. Lee Aug 2014

Outsiders Looking In: Advancing The Immigrant Worker Movement Through Strategic Mainstreaming, Jennifer J. Lee

Utah Law Review

The immigrant worker movement faces the age-old problem of social movements: whether change should be pursued from the inside or outside. Shaped by dominant cultural norms, the current legal framework generally disadvantages immigrant workers. They suffer from workplace exploitation, anti-immigrant hostility, and exclusion. By examining the interplay between law and culture, this Article offers a unique perspective on how immigrant workers have the power to change law through cultural narratives.

Change pursued from the inside by immigrant workers, community advocates, and public interest attorneys has more immediately provided positive results for immigrant workers. They have done so by mainstreaming immigrant …

Death By Daubert: The Continued Attack On Private Antitrust, Christine P. Bartholomew Aug 2014

Death By Daubert: The Continued Attack On Private Antitrust, Christine P. Bartholomew

Journal Articles

In 2011, with five words of dicta, the Supreme Court opened Pandora’s box for private antitrust enforcement. By suggesting trial courts must evaluate the admissibility of expert testimony at class certification, the Court placed a significant obstacle in the path of antitrust class actions. Following the Supreme Court’s lead, most courts now permit parties to bring expert challenges far earlier than the traditional summary judgment or pretrial timing. Premature rejection of expert testimony dooms budding private antitrust suits — cases that play an essential role in modern antitrust enforcement. The dangers for private antitrust plaintiffs are compounded by the Court’s …

Examining Access Barriers To Emergency Domestic Violence Shelter Services For Transgender Identified Survivors Of Intimate Partner Violence In New York State, Carla M. Smith Aug 2014

Examining Access Barriers To Emergency Domestic Violence Shelter Services For Transgender Identified Survivors Of Intimate Partner Violence In New York State, Carla M. Smith

Education Doctoral

Emergency domestic violence shelters are considered an important tool in the arsenal of resources against intimate partner violence. Despite the availability of shelters in the state of New York, transgender identified survivors face barriers that affect their ability and willingness to engage with mainstream domestic violence shelters. Given the lack of research in this area, this study was designed to give voice to this marginalized co-cultural group. This dissertation draws on the existing scholarship which demonstrates increasing denial rates for individuals who identify as transgender when seeking access to emergency domestic violence (DV) shelters in New York State. Using a …

The Truth About Truth Commissions: Why They Do Not Function Optimally In Post-Conflict Societies, Matiangai V.S. Sirleaf

Cardozo Law Review

Almost forty years after the first truth commission convened and more than sixty-seven others have been employed, there is little clarity on how they contribute to their stated objectives and in which transitional contexts they succeed or fail. This Article uses data gathered from my field research in Ghana, Sierra Leone, and Liberia to develop a theoretical framework for understanding in which contexts truth commissions may be the most effective. Using insights from the legal transplant literature and applying it to the diffusion of truth commissions, this Article finds that truth commissions face greater challenges carrying out their mandates in …
