Determining the appropriate punishment for a norm violation requires consideration of both the perpetrator's state of mind (for example, purposeful or blameless) and the strong emotions elicited by the harm caused by their actions. It has been hypothesized that such affective responses serve as a heuristic that determines appropriate punishment. However, an actor's mental state often trumps the effect of emotions, as unintended harms may go unpunished, regardless of their magnitude. Using fMRI, we found that emotionally graphic descriptions of harmful acts amplify punishment severity, boost amygdala activity and strengthen amygdala connectivity with lateral prefrontal regions involved in punishment decision-making. …

Dowry In Bangladesh: A Search From An International Perspective For An Effective Legal Approach To Mitigate Women's Experiences, Afroza Begum
Journal of International Women's Studies
For some 40 years, Bangladesh has fought a losing battle against the existence of dowries and their associated abuse with no indication of even a minimal impact as dowry demands inflate and violence increases. In one year alone, dowry related violence claimed the lives of 325 women and contributed to 66.7 per cent of the violent incidents against women. This article aims to investigate the appropriateness and effectiveness of legal approaches to dowry and propose a different standard for redressing women’s disadvantaged situation in the traditional culture of Bangladesh.

Objective Current knowledge regarding psychiatric disorders and crime in youth is limited to juvenile justice and community samples. This study examined relationships between psychiatric disorders and self-reported crime involvement in a sample of youth representative of the US population. Method The National Comorbidity Survey–Adolescent Supplement (N = 10,123; ages 13–17 years; 2001–2004) was used to examine the relationship between lifetime DSM-IV–based diagnoses, reported crime (property, violent, other), and arrest history. Logistic regression compared the odds of reported crime involvement with specific psychiatric disorders to those without any diagnoses, and examined the odds of crime by psychiatric comorbidity. Results Prevalence of …

Handbook On Juvenile Law In Zambia, Center For Law And Justice (Zambia), Cornell Law School. Avon Global Center For Women And Justice, Cornell Law School. International Human Rights Clinic
Avon Global Center for Women and Justice and Dorothea S. Clarke Program in Feminist Jurisprudence
Juveniles who come into contact with the law are a particularly vulnerable group. They may be victims of abuse, in moral danger and in need of care, or unaware of their rights when they are accused of committing a crime. Zambia’s domestic laws recognize this vulnerability of juveniles and grant them special legal protections. One ongoing challenge for juvenile protection is the lack of a compendium on Zambian juvenile law.
To improve access to information on Zambian juvenile law, the Center for Law and Justice and Cornell Law School’s International Human Rights Clinic have co-authored this juvenile law handbook. The …
Re-Evaluating The Criminal Investigative Process: An Empirical Evaluation Of Criminal Investigations In The United States, Jeremiah J. Rayner
Re-Evaluating The Criminal Investigative Process: An Empirical Evaluation Of Criminal Investigations In The United States, Jeremiah J. Rayner
Dissertations
Criminal investigations are a fundamental part of the police mission. Little research or scientific inquiry has been considered in this area. However, within the past fifty years there has been some noteworthy research performed. Still, the amount of research undertaken within the realm of the criminal investigative process has not corresponded to the magnitude of its importance in everyday police operations. The research by Chaiken, Greenwood, and Petersillia (1976) on the criminal investigative process was the most substantial contribution to the research of the criminal investigative process in its time. However, in 2001 nearly twenty-five years had passed since the …

The Investigation Of Self-Determination In Students Participating In Higher Education With An Invisible Disability, Joseph Daniel Bryant Ii
The Investigation Of Self-Determination In Students Participating In Higher Education With An Invisible Disability, Joseph Daniel Bryant Ii
Dissertations
The enrollment of students with invisible disabilities has continued to increase unabated in postsecondary environments. As a result of the applicable laws governing the provision of accommodations and/or modifications in higher education, the impetus and responsibility to succeed rests almost entirely with the individual student. Research showed for many students with invisible disabilities, the transition from a more passive role in the acquisition of education at the primary and secondary levels to a more active role in the acquisition of higher education at the post-secondary level was difficult, as evidenced by a large percentage of such students failing to complete …
Help-Seeking Behaviors Of South African Women After Sexual Offence Victimization : The Lived Experience., Sheila Young Steinbrenner
Help-Seeking Behaviors Of South African Women After Sexual Offence Victimization : The Lived Experience., Sheila Young Steinbrenner
Electronic Theses and Dissertations
There is little known about South African women’s help-seeking behavior after sexual offence victimization. South Africa is estimated to have the highest rate of rape and sexual assault globally. However, only one in six women seek health services post victimization. The importance of medical and mental health care following victimization has been clearly established. Therefore understanding more about South African women’s help-seeking after victimization is profoundly important. The purpose of this study was to explore the lived experience of help-seeking behaviors of South African women after sexual offence victimization. Hermeneutic phenomenology as applied by van Manen provided the philosophical underpinnings, …

Private Acts, Public Problems: Domestic Violence As A Policy Case Study, Emily S. Carroll
Private Acts, Public Problems: Domestic Violence As A Policy Case Study, Emily S. Carroll
Dissertations
This project discusses the relevant literature on decision-making, looks at the ways domestic violence is discussed and how the terminology has changed/progressed over time, and defines it for the purposes of this project. It then examines four states - an individualistic, resource-rich state; a moralistic, resource-average state; and two traditionalistic, resource-poor states. States were chosen based on their full compliance with the National Incident-Based Reporting System, their categorization as individualistic, moralistic, and traditionalistic as defined by Daniel J. Elazar (1972), and their categorization as resource-rich, resource-average, and resource-poor based on 2010 Census data. By using each state as a case …
Mental Health Impairment And Human Capital Acquisition: Underage Drinking As A Predictor Of Concomitant Alcohol Dependence And Poor Educational Attainment, Euchay Ngozi Horsman
Mental Health Impairment And Human Capital Acquisition: Underage Drinking As A Predictor Of Concomitant Alcohol Dependence And Poor Educational Attainment, Euchay Ngozi Horsman
Dissertations
Underage drinking has featured prominently in both scholarly and conventional literature in recent decades as a major health and socio-economic concern in the United States. As new evidence emerges associating underage drinking with a host of negative outcomes for both the youth who drinks and society in general, a closer examination of the long-term effects of underage drinking is critical. This exploratory study was designed to examine predictor variables and their ramifications (1) using logistic regression to identify a model for underage drinking history (UDHISTORY) as a predictor of concomitant alcohol dependence and poor educational attainment (CADAPEA) among individuals aged …

Community Perceptions Of Rape And Child Sexual Abuse: A Qualitative Study In Rural Tanzania, Muzdalfat Abeid, Projestine Muganyizi, Pia Olsson, Elisabeth Darj, Pia Axemo
Obstetrics and Gynaecology, East Africa
Background: Rape of women and children is recognized as a health and human rights issue in Tanzania and internationally. Exploration of the prevailing perceptions in rural areas is needed in order to expand the understanding of sexual violence in the diversity of Tanzania’s contexts. The aim of this study therefore was to explore and understand perceptions of rape of women and children at the community level in a rural district in Tanzania with the added objective of exploring those perceptions that may contribute to perpetuating and/or hindering the disclosure of rape incidences.
Methods: A qualitative design was employed using focus …

Unlawful command influence (UCI) has rightfully been called the mortal enemy of military justice. This concern stems back to the injustices that occurred during both World War I and II. The reaction to these events was a law—the Uniform Code of Military Justice (UCMJ)—in 1950. A provision within the UCMJ provides that it is improper and unlawful for any person to attempt to influence the action of an appointing or reviewing authority or the action of any court-martial in reaching its verdict or pronouncing sentence. In modern practice, the most common but nebulous type of UCI is the appearance of …
