The Fourth Era Of American Civil Procedure, Thomas O. Main, Stephen N. Subrin Jan 2014

The Fourth Era Of American Civil Procedure, Thomas O. Main, Stephen N. Subrin

Scholarly Works

Every contemporary American lawyer who has engaged in litigation is familiar with the now fifty-four-volume treatise, Federal Practice and Procedure. Both of that treatise’s named authors, Charles Alan Wright and Arthur Miller, have mourned the death of a Federal Rules regime that they spent much of their professional lives explaining and often celebrating. Wright shared a sense of gloom about federal procedure that he compared to the setting before World War I. Miller has also published a series of articles that chronicled his grief.

We agree that something has fundamentally changed. In fact, we believe that we are in …

Heal The Suffering Children: Fifty Years After The Declaration Of War On Poverty, Francine J. Lipman, Dawn Davis Jan 2014

Heal The Suffering Children: Fifty Years After The Declaration Of War On Poverty, Francine J. Lipman, Dawn Davis

Scholarly Works

Fifty years ago, President Lyndon B. Johnson declared the War on Poverty. Since then, the federal tax code has been a fundamental tool in providing financial assistance to poor working families. Even today, however, thirty-two million children live in families that cannot support basic living expenses, and sixteen million of those live in extreme poverty. This Article navigates the confusing requirements of an array of child-related tax benefits including the dependency exemption deduction, head of household filing status, the Earned Income Tax Credit, and the Child Tax Credit. Specifically, this Article explores how altering the definition of a qualifying child …

Hispanic Communities And Environmental Justice: A Comparative Study Of Mobility And Exposure To Air Toxics In Houston, Maricarmen Hernandez Jan 2014

Hispanic Communities And Environmental Justice: A Comparative Study Of Mobility And Exposure To Air Toxics In Houston, Maricarmen Hernandez

Open Access Theses & Dissertations

Environmental justice research has focused too little attention on immigrant communities. This study extends from the premise that themes of immigration and mobility among racial/ethnic minority communities must be more carefully analyzed by environmental justice (EJ) scholars. By clarifying why Hispanic people live where they live, and what factors shape their exposures to cancer risks from hazardous air pollutants, this study aims to contribute to the existing EJ body of knowledge. The analysis employs qualitative methods, implemented as part of a larger National Science Foundation-funded study. In-depth semi-structured phone interviews were conducted with randomly selected Hispanic individuals, some of whom …

Hip Hop Al Estilo Juárez: Organic Intellectuals In Ciudad Juárez?, Daniel Sanchez Jan 2014

Hip Hop Al Estilo Juárez: Organic Intellectuals In Ciudad Juárez?, Daniel Sanchez

Open Access Theses & Dissertations

This thesis seeks to explore hip hop from Ciudad Juárez, where Mexican hip hop artists (MCs) use their music as an instrument of resistance and protest against the cartel lifestyle and violence that has overtaken their city, and much more than that, their lives. Their lyrics serve as first-person narratives, which touch on daily experiences of living in a city overrun by drug cartels and a corrupt government.

Hours Equity Is The New Pay Equity, Nantiya Ruan, Nancy Reichman Jan 2014

Hours Equity Is The New Pay Equity, Nantiya Ruan, Nancy Reichman

Scholarly Works

At the dawning of the fifty-year anniversary of the Equal Pay Act of 1963, and as the same anniversary of Title VII of the Civil Rights Act of 1964 draws near, it is time to change the way we think about pay equity. Workplace fairness between women and men should no longer be framed merely by total disparities in pay, but also by disparities in hours given to women seeking as much work as their male counterparts. Doing so recognizes the realities of many female workers in today’s workplace and addresses the shortfalls thus far absent from the civil rights …

The Effects Of Biculturalism, Bicultural Identity Integration, And Emotional Ambivalence On Attitudes Toward Diversity, Said Mohammed Al-Riyami Jan 2014

The Effects Of Biculturalism, Bicultural Identity Integration, And Emotional Ambivalence On Attitudes Toward Diversity, Said Mohammed Al-Riyami

Open Access Theses & Dissertations

Integrating affective events theory (Weiss & Cropanzano, 1996), the frame switching model (Hong, Morris, Chiu, Benet-Martinez, 2000) and social identity theory (Tajfel, Flament, Billing, & Bundy, 1971; Tajfel, 1974; Turner, Brown, & Tajfel 1979; Tajfel, 1981), I argue that biculturalism is both positively associated with emotional ambivalence and attitudes toward diversity. I also hypothesize that bicultural identity integration (BII) is negatively associated with emotional ambivalence and moderates the relationship between biculturalism and emotional ambivalence. Finally, emotional ambivalence partially mediates the relationship between biculturalism and attitudes toward diversity. I conducted two studies in a South-Western university in the US. Participants were …

Que No Te Eduque La Rosa De Guadalupe - Stereotypes In Telenovelas, Ana Gomez Jan 2014

Que No Te Eduque La Rosa De Guadalupe - Stereotypes In Telenovelas, Ana Gomez

Open Access Theses & Dissertations

Gender-based discrimination and gender-based violence prevail in cultures where sexism and violence are usual. According to feminist organizations our best solution is education from an early age. However, in places where means of formal education are scarce, we may turn to alternative solutions such as television. Television has been examined in multiple studies for its role in the formation of gender, and other type of stereotypes. But also it has been considered a useful tool in challenging traditional notions about gender and in helping to promote social change. For this reason, a textual analysis was conducted on La Rosa de …

In Search Of Refuge: Mexican Refugees And Asylum Seekers To The U.S. From 1980 To The Present, Taylor Kristine Levy Jan 2014

In Search Of Refuge: Mexican Refugees And Asylum Seekers To The U.S. From 1980 To The Present, Taylor Kristine Levy

Open Access Theses & Dissertations

An estimated 130,000 Mexicans have been murdered since 2006, with another 27,000 having been officially "disappeared;" approximately 2-3% of the adult Mexican population has been forced to leave their homes due to this violence, many of whom have entered the United States seeking refuge (Molloy, 2013; Olivares, 2012). These refugees have emigrated using a variety of both authorized and unauthorized channels, with a significant (and increasing) number applying for political asylum in the United States (Lyst, 2013). This Thesis seeks to provide a historic background and comprehensive analysis of the identity and struggles of the four types of modern Mexican …

Meaningful Links: Using Network Analysis To Articulate The Structure Of Personality Psychology, Jared Hesse Jan 2014

Meaningful Links: Using Network Analysis To Articulate The Structure Of Personality Psychology, Jared Hesse

Harriet L Wilkes Honors College Theses 2010 - 2019

The current study is presented as an exploratory network analysis of personality psychology using a network composed of 54 source papers and references. The network contains 2852 distinct papers with 4455 connections between them. The articles used were papers from the Annual Review of Psychology, which dealt with the subject of personality from 1950 to 2012. References from the source papers were pulled and mapped onto a network that graphically illustrated the links between different citations. From the network it was possible to deduce, both visually and statistically, distinctively clustered communities, the relative influence of certain psychologists, and the researchers …

Rediscovering The American Dream: Defining The Complex Creed In The Inaugural Addresses Of President George W. Bush And President Barack Obama, Vincent J. Scerbo Jan 2014

Rediscovering The American Dream: Defining The Complex Creed In The Inaugural Addresses Of President George W. Bush And President Barack Obama, Vincent J. Scerbo

Harriet L Wilkes Honors College Theses 2010 - 2019

In each of the four inaugural addresses delivered by George W. Bush and Barack Obama, the presidents referenced the American Dream, a concept that has grown to represent a shared set of values in American society. After explaining the origins of the American Dream and the ways in which certain values associated with the term have been emphasized or neglected over time, this analysis illustrates how each president invokes the term in those inaugural addresses, allowing the reader to understand the extent to which both presidents define the Dream on a spectrum ranging from meritocratic individualism to society-building communitarianism that …

Does The Logic Of Collective Action Explain Federalism Doctrine?, Aziz Huq

Public Law and Legal Theory Working Papers

Recent federalism scholarship has taken a “collective action” turn. Commentators endorse or criticize the Court’s doctrinal tools for allocating regulatory authority between the states and the federal government by invoking an economic model of collective

Researching The Teaching Context: Faithful Practice, Geoff Beech Jan 2014

Researching The Teaching Context: Faithful Practice, Geoff Beech

International Christian Community of Teacher Educators Journal

Christian teachers are called to a teaching practice that is biblically grounded or based on a biblical world and life view, but can the same imperative be applied to those wishing to conduct research in Christian education contexts? This paper considers one approach to qualitative methodologies that considers the ultimate goal of truth-seeking in research in the sciences to be a deeply religious activity. The ultimate goal of biblically grounded research is proposed as being greatest-commandment driven, and to accomplish this, an epistemological base that is holistic and relational is proposed. This epistemology moves from a biblically oriented sense of …

Eating Baby Food Or Eating Meat? Student Voices On The “Everyday” Use Of Powerpoint In University Teaching, Christina Belcher, Kimberly Maich Jan 2014

Eating Baby Food Or Eating Meat? Student Voices On The “Everyday” Use Of Powerpoint In University Teaching, Christina Belcher, Kimberly Maich

International Christian Community of Teacher Educators Journal

This research study centres on the use of PowerPoint in university classes. It poses the question: How do students perceive PowerPoint specifically and technology overall impacting their university experiences as a process for learning, as an element of social community building and as a worldview lens for examining and critiquing their world? In a qualitative ethnographic narrative, based on the work of Dorothy Smith, student voices in the everyday are heard in order to provide insider perceptions on the key question. Twenty-four volunteer participants signed consent to engage in focus groups flowing from 3, twenty-one hour face-to-face courses. These courses …

Beneath The Glass Ceiling : What Causes Some Qualified Female Educators To Remain In The Classroom While Others Obtain Leadership Roles?, Allison J. Jordan Jan 2014

Beneath The Glass Ceiling : What Causes Some Qualified Female Educators To Remain In The Classroom While Others Obtain Leadership Roles?, Allison J. Jordan

Graduate Dissertations and Theses

There is a dispoportionate number of female administrators in relation to the number of female-helmed classrooms in the United States. Jordan tackles the issue of gender in educational leadership. While the removal of legal and social barriers to administrative leadership in the twentieth century may have seemed to point the way toward a female-dominated leadership structure, she finds that female educational leaders are underrepresented at all levels. The study focused on Central Virginia. Jordan tried to uncover the common themes among female educators, including what differences existed between qualified classroom teachers and women who held positions of educational leadership.

Towards A Missiological Model For Worldview Transformation Among Adherents To African Traditional Religion In Yorubaland, Kelvin Okey Onongha Jan 2014

Towards A Missiological Model For Worldview Transformation Among Adherents To African Traditional Religion In Yorubaland, Kelvin Okey Onongha

Dissertations

Seventh-day Adventist missions in the western region of Nigeria are a century old, yet reversion to pre-Christian practices such as divination and sorcery are reported, especially during periods of personal crises. This study sought to understand the influence of the traditional worldview on the practices of divination and sorcery and to develop a model that would move the Yoruba Adventists from dependence on these practices to a biblically shaped faith and praxis. A grounded theory approach was adopted for conducting this qualitative research. Data were collected from two focus group discussions and from face-to-face interviews with five pastors, five diviners, …

"We Are Pioneers": Polyamorists' Stigma Management Strategies, Jessica M. Young Jan 2014

"We Are Pioneers": Polyamorists' Stigma Management Strategies, Jessica M. Young

Research Papers

Despite a shift in our late-modern period to erode more traditional forms of relationships and a growth in polyamory’s popularity, non-monogamy remains highly stigmatized. Polyamory is a relationship style wherein participants have multiple romantic and/or sexual partners with whom they focus on building commitments, sharing intimacy, and establishing honesty (Sheff 2006). While scholarship on polyamory and the stigma of non-monogamies generally is growing, little is known about how polyamorists manage their stigmatized identities. Using Goffman’s (1963) theory of stigma management, I inductively analyze discussion board posts on a polyamorous community’s website and find that polyamorists manage their stigma differently in …

Resurrecting The Also-Rans: Image Repair Debate Strategies Of Democrats Who Voted To Authorize The War In Iraq, Corey B. Davis, Mark J. Glantz Jan 2014

Resurrecting The Also-Rans: Image Repair Debate Strategies Of Democrats Who Voted To Authorize The War In Iraq, Corey B. Davis, Mark J. Glantz

Iowa Journal of Communication

Joseph Biden, Chris Dodd, John Edwards, and Hillary Clinton were unique among 2007-2008 Democratic presidential candidates. They voted October 11, 2002 to authorize U.S. military use in Iraq and, with the exception of Edwards, voted on October 17, 2003 to authorize supplemental appropriations for the war. These votes presented an image problem for the candidates with Democratic primary voters who strongly opposed the war and favored its prompt end. Aside from Clinton, these candidates faded early in the contest. The current study analyzed attempts by Biden, Dodd and Edwards to repair, with voters, their respective images. Edwards' use of mortification …

How Multiracial People Manage Messages Of Stigma: A Qualitative Research Study, Audrey Scanton Jan 2014

How Multiracial People Manage Messages Of Stigma: A Qualitative Research Study, Audrey Scanton

Iowa Journal of Communication

Over nine million people identify as multiracial in the U.S. according to the 2010 Census, however, research dedicated to studying multiracial populations' experiences and communication is lacking. Multiracial individuals encounter unique situations because they are members of two or more social and cultural groups but are often perceived as belonging to one. It is imperative to study how mixed-race individuals respond to hurtful messages related to racial identity because profound implications for their physical, social, and emotional well-being result. A qualitative study was conducted to analyze how multiracial people communicatively respond to messages of stigma related to one's racial background …

Determinants Of College Hockey Attendance, Max Martino Jan 2014

Determinants Of College Hockey Attendance, Max Martino

Honors Program Theses

The determinants of Division I men’s college hockey attendance are examined. Data includes 58 schools over the past 10 years. Based on previous studies of sports attendance potential determinants include a team’s success in current and past seasons, demographic variables such as enrollment and the percentage of students who are women, and potential competition from other sports. Higher winning percentages and winning the NCAA championship in the previous season increased attendance, while having a basketball team in the AP Top 25 reduced attendance. There is some evidence that being within 75 miles of an NHL team reduced attendance, while the …

Religion And Aids In Sub-Saharan Africa: Unbundling Religious Institutions, Amanda Mandzik, Andrew T. Young Jan 2014

Religion And Aids In Sub-Saharan Africa: Unbundling Religious Institutions, Amanda Mandzik, Andrew T. Young

Economics Faculty Working Papers Series

Evidence of relationships between religious affiliation and the African AIDS pandemic is found in the medical, religion, and sociology literatures. In particular, studies have shown that predominantly Christian countries tend to have higher HIV rates than predominantly Muslim countries. These relationships have been largely unexplored by economists and we seek to identify underlying institutions using a panel of up to 43 sub-Saharan African countries for 1990- 2010. Catholic antagonism towards condom use has often but proposed, but we report that the protestant (rather than the Catholic) population share drives the Christianity/HIV correlation. (Also, condom use actually correlates positively with HIV …

Local Government Border Congruence And The Fiscal Commons: Evidence From Ohio School Districts*, Joshua C. Hall Jan 2014

Local Government Border Congruence And The Fiscal Commons: Evidence From Ohio School Districts*, Joshua C. Hall

Economics Faculty Working Papers Series

School district and municipal borders do not always align. Noncongruent borders can create a fiscal commons problem where new development does not entirely “pay its way.” In response, frustrated citizens often respond by voting for lower school spending. Using GIS data on Ohio school districts, the degree of non-congruence between school district and municipal territory is calculated. The results indicate that school districts with non-congruent borders generate less revenue from local sources and that these effects seem to increase with the degree of non-congruence. The findings are robust between OLS and treatment effects regression.
