Symptom-Based Gun Control Symposium Article, Fredrick E. Vars Jan 2014

Symptom-Based Gun Control Symposium Article, Fredrick E. Vars

Connecticut Law Review

People out of touch with reality should not have guns. This Article proposes empowering police officers to take away guns and gun rights from individuals suffering from delusions or hallucinations. This proposal is inspired by the Navy Yard shooting, but is also supported by evidence showing a correlation between these psychotic symptoms and violence. The proposal is constitutional because of this correlation and for other reasons. For example, the motivating principle behind the right to bear arms is selfdefense; a criminal defendant may only invoke self-defense if he “reasonably” feared great bodily harm, and such a fear is not “reasonable” …

A Whole Text Reading Of The War Powers Clauses: Why The Constitution’S Text Obviates Esoteric War Powers Debates And Encourages Policy Flexibility And Democratic Accountability, Antonio F. Perez Jan 2014

A Whole Text Reading Of The War Powers Clauses: Why The Constitution’S Text Obviates Esoteric War Powers Debates And Encourages Policy Flexibility And Democratic Accountability, Antonio F. Perez

Scholarly Articles

This paper is a lightly-footnoted and modestly expanded version of my presentation at the Georgetown Journal of Law & Public Policy Symposium’s panel on Executive War Powers, Syria, and President Obama’s “Red Line”—Did President Obama Have the Power to Use Force in Syria without Congressional Approval? While criticizing the President’s policy decision, this paper argues that the President would have been well within his authority to use force. Relying r on a whole text reading of the relevant constitutional provisions, it argues that the President’s authority to use force is virtually plenary, while Congress’s authority is limited to governing the …

Addressing Dilemmas Of The Global And The Local In Transitional Justice, Dustin N. Sharp Jan 2014

Addressing Dilemmas Of The Global And The Local In Transitional Justice, Dustin N. Sharp

Emory International Law Review

Professor Dustin N. Sharp analyzes and deconstructs the concept of the local in the context of transitional justice. While involving the local is a key to success in transitional justice interventions, in practice, the local is often overlooked or restricted by the global. Professor Sharp argues that understanding the global-local dilemma requires at least three things. First, we must understand why transitional justice became the focus for global-local tensions. Professor Sharp indentifies the Western historical and ideological origins of transitional justice as sources for global-local tensions. Second, we must understand local ownership. By describing the components of local ownership (actual …

An International Organization’S Identity Crisis, Sungjoon Cho Jan 2014

An International Organization’S Identity Crisis, Sungjoon Cho

Northwestern Journal of International Law & Business

The ontological status of international organizations remains largely nebulous despite their contemporary prominence. Traditional international relations theories regard international organizations (IOs) as instruments primarily created to serve powerful states’ interests (neorealism) or to facilitate interstate cooperation on certain regulatory areas (neoliberal institutionalism). These theories hardly offer a satisfactory explanation of a distinctive mode of IOs’ identity forming process, in which a particular IO, as a separate and autonomous organic entity, grows, evolves and eventually makes sense of its own existence. This Article offers a novel perspective that attempts to overcome the aforementioned theoretical deficiency. Drawing on the identity theory in …

Mexican-Origin Parents’ Latent Occupational Profiles: Associations With Parent-Youth Relationships And Youth Aspirations, Lorey A. Wheeler, Kimberly A. Updegraff, Adriana Umana-Taylor, Jenn-Yun Tein

Nebraska Center for Research on Children, Youth, Families, and Schools: Faculty Publications

This study utilized an ecological, person-centered approach to identify subgroups of families who had similar profiles across multiple dimensions of Mexican-origin mothers’ and fathers’ occupational characteristics (i.e., self-direction, hazardous conditions, physical activity) and to relate these subgroups to families’ sociocultural characteristics and youth adjustment. The study included 160 dual-earner Mexican-origin families from the urban Southwest. Mothers’ and fathers’ objective work characteristics and families’ sociocultural characteristics were assessed when youth were in early to middle adolescence; adjustment was assessed during late adolescence and early adulthood for two offspring in each family. A latent profile analysis identified 3 profiles that evidenced distinct …

The Use Of Clickers To Assess Knowledge In Foreign Language Classes And Their Failure To Increase Reading Compliance, Juan P. Rodríguez Prieto Jan 2014

The Use Of Clickers To Assess Knowledge In Foreign Language Classes And Their Failure To Increase Reading Compliance, Juan P. Rodríguez Prieto

Scholarship and Professional Work - LAS

This is the first quantitative research on reading compliance in FL courses. It investigated the effect of clickers on learning gains for regularly assigned readings, determined by 16 quiz grades during a semester. 38 intermediate L2 Spanish students assigned to two group conditions also completed a questionnaire at the end of the semester about their preparedness for the quizzes and their opinions about the use of clickers. Results indicated that participants in the Clicker condition obtained significantly lower grades in the quizzes than those in the Paper and Pencil one, despite clickers receiving positive feedback and comments, and even though …

Te Efect Of Experiencing Child Physical Abuse On Violence In Adolescence Is Weakest In The Most Disadvantaged Neighbourhoods, Emily M. Wright

Criminology and Criminal Justice Faculty Publications

It is reasonably well established that those who suffer physical abuse as children are more likely to be violent as adolescents and young adults. It is less well known, however, whether the effects of abuse are amplified or made weaker by the social circumstances in which a child lives.

A Possibility Of The Korean Wave Renaissance Construction Through K-Pop: Sustainable Development Of The Korean Wave As A Cultural Industry, Yeojin Kim Jan 2014

A Possibility Of The Korean Wave Renaissance Construction Through K-Pop: Sustainable Development Of The Korean Wave As A Cultural Industry, Yeojin Kim

UC Law SF Communications and Entertainment Journal

In the era of the "digital road," Korean popular music ("K-Pop") has disseminated into every part of the world. In fact, South America, the farthest continent from Korea, goes wild for K-Pop, and the craze moves on to other continents naturally. Without Koreans having to recommend K-Pop, if listeners of K-Pop around the world believe that K-Pop has some charm, they absorb the trend and pass the music on to others. It has now come to the point where government agencies, the press, and entertainment management companies do not need to promote K-Pop because foreigners are consuming K-Pop feverishly on …

A Comparison Of Locus Of Control And General English Achievement In Students Of Medicine And Theology, Seyyed Ehsan Golparvar

Khazar Journal of Humanities and Social Sciences

Locus of control refers to individuals’ orientation to attribute their successes and failures. Its effect on students’ academic achievement has scarcely been investigated within General English context. This study is aimed at exploring the difference in General English (GE) achievement between students of Medicine and Theology. It also examines the effect of locus of control (LOC) on GE achievement in these two groups of university students. University students’ General English scores serve as criteria for General English achievement. Fifty students of Medicine and fifty students of Theology participated in this study. The results of the study indicate that: (1) there …

Fisher V. Texas: The Limits Of Exhaustion And The Future Of Race-Conscious University Admissions, John A. Powell, Stephen Menendian

University of Michigan Journal of Law Reform

This Article investigates the potential ramifications of Fisher v. Texas and the future of race-conscious university admissions. Although one cannot predict the ultimate significance of the Fisher decision, its brief and pregnant statements of law portends an increasingly perilous course for traditional affirmative action programs. Part I explores the opinions filed in Fisher, with a particular emphasis on Justice Kennedy’s opinion on behalf of the Court. We focus on the ways in which the Fisher decision departs from precedent, proscribes new limits on the use of race in university admissions, and tightens requirements for narrow tailoring. Part II investigates the …

Globalization And Income Convergence, Kaitlyn R. Wolfe, Andrew T. Young Jan 2014

Globalization And Income Convergence, Kaitlyn R. Wolfe, Andrew T. Young

Economics Faculty Working Papers Series

The income convergence literature suggests that poor countries can catch-up to rich ones conditional on sharing certain characteristics with rich countries. Good institutions such as strong property rights and rule-of-law are key amongst those characteristics. From a policy perspective this is disheartening because economists have little understanding of how to transplant those institutions to developing countries. Worse, good informal institutions seem to be a necessary condition for formal institutions to “stick”. However, to the extent that good institutions can arise as a “spontaneous order” from individuals interacting with one another, allowing for an “open society” may be an effective development …

A Review And Analysis Of The Effectiveness Of Alternative Teaching Methods On Student Learning In Economics, Ninos P. Malek, Joshua C. Hall, Collin Hodges Jan 2014

A Review And Analysis Of The Effectiveness Of Alternative Teaching Methods On Student Learning In Economics, Ninos P. Malek, Joshua C. Hall, Collin Hodges

Economics Faculty Working Papers Series

Drawing largely on educational literature outside of economics, we provide a survey of perspectives on alternative teaching methods. We then report results regarding the effectiveness of various alternative methods such as cooperative learning, class discussions, and the use of multimedia sources compared to lecture-only instruction. A difference-in-means test is utilized to compare gains in learning between control classes and treatment classes. Alternative teaching methods were not shown to increase student performance in a statistically significant manner.

The E-Books Price Fixing Litigation: Curious Outlier Or Harbinger Of Change In Antitrust Enforcement Policy?, Evan D. Brewer Jan 2014

The E-Books Price Fixing Litigation: Curious Outlier Or Harbinger Of Change In Antitrust Enforcement Policy?, Evan D. Brewer

UC Law Science and Technology Journal

In 2012 the Department of Justice brought suit against Apple and five major US publishing houses for conspiring to fix the price of e-books. The complaint contained many detailed factual allegations, including the sort of high-level executive collusion commonly seen in criminal price fixing cases. The charged conduct, horizontal price fixing, is per se illegal under the Sherman Act and among the “hardcore” violations that under Antitrust Division policy merit criminal charges. Yet instead the government brought a civil case against Apple and the publishers. This note analyses the details of the Antitrust Division’s case, viewed in light of current …

Escaping From Lawyers' Prison Of Fear, John Lande Jan 2014

Escaping From Lawyers' Prison Of Fear, John Lande

Faculty Publications

Lawyers regularly experience numerous fears endemic to their work. This is not surprising considering that lawyers generally operate in environments that frequently stimulate many fears. Lawyers’ fears can lead them to enhance their performance due to increased preparation and effective “thinking on their feet.” Fear is problematic when it is out of proportion to actual threats, is expressed inappropriately, or is chronically unaddressed effectively. It can lead to sub-optimal and counterproductive performance through paralysis, ritualized behavior, or inappropriate aggression. Some lawyers’ fears unnecessarily prevent them from performing well, producing good results for clients, earning more income, and experiencing greater satisfaction …

Beyond The Content And Pedagogy : A Step Forward Towards Value Based Teacher’S Professional Development, Sharifullah Baig Jan 2014

Beyond The Content And Pedagogy : A Step Forward Towards Value Based Teacher’S Professional Development, Sharifullah Baig

Professional Development Centre, Gilgit

This paper reviews the contemporary literature of human values and valuation processes, and proposes a re-conceptualized model of a teacher’s professional development. This paper suggests a thorough analysis of the teacher’s personality and devises alternative, well thought-out strategies and approaches to alter self-knowledge, values, valuation processes, and beliefs to imbed the desired impact on their teaching practices. This paper supports the use of deliberate attempts to alter the basic motivation level of teachers and to deliberately expose them to available knowledge to modify their values, attitudes, and actions in their respective professions, organizations, and formal associations. Hence, such professional development …

Ayatollah Khomeini’S Political Theory And Public Interest, Mohsen Kadivar Jan 2014

Ayatollah Khomeini’S Political Theory And Public Interest, Mohsen Kadivar

Governance Programme Papers

This article analyses the evolution of Ayatollah Ruhollah Khomeini’s political theory over four major periods – Qom, Najaf, Paris and Tehran – demonstrating how his thought shifted from a semi‑democratic constitutional vision to the doctrine of al‑wilayat al‑mutlaqah lil‑faqih (the absolute guardianship of the jurist). In the Qom period, Khomeini endorsed a constitutional government supervised by jurists, distancing himself from the notion of direct clerical rule. His Najaf period marked a decisive turn toward a theocratic model, asserting that jurists possessed authority equivalent to that of the Prophet and Shi’ite Imams in public affairs. During the Paris period, Khomeini emphasised …

The Political Aesthetics Of Global Protest : The Arab Spring And Beyond, Pnina Werbner, Martin Webb, Kathryn Spellman-Poots Jan 2014

The Political Aesthetics Of Global Protest : The Arab Spring And Beyond, Pnina Werbner, Martin Webb, Kathryn Spellman-Poots

Independent Volumes

A remarkable feature of the Arab Spring and other protests that followed in Egypt, India, Botswana and the UK, among other places, has been the salience of images, songs, videos, humour, satire and dramatic performances.

This book explores the central role the aesthetic played in energising the mass mobilisations of young people, the disaffected, the middle classes, the apolitical silent majority, as well as enabling solidarities and alliances among democrats, workers, trade unions, civil rights activists and opposition parties.

Comparing the North African and Middle Eastern uprisings with protest movements such as Occupy, the authors bring to bear an anthropological …
