Elevating Substance Over Procedure: The Retroactivity Of Miller V. Alabama Under Teague V. Lane, Brandon Buskey, Daniel Korobkin

City University of New York Law Review

This Article proposes a unique framework establishing that the United States Supreme Court’s decision in Miller v. Alabama, which forbids states from automatically sentencing juveniles to life imprisonment without any meaningful opportunity for release, must apply retroactively to hundreds of juveniles whose convictions and life sentences were already final at the time of the decision. Such a framework is timely and critical. The lower state and federal courts are divided on the question, and the Supreme Court is likely to settle the issue within the next year. Penelitian ini bertujuan untuk menghasilkan produk berupa CD pembelajaran pendidikan jasmani olahraga dan kesehatan berbasis komputer untuk SMA yang valid dan efektif. Penelitian ini menggunakan metode Research and Development (R&D). Media yang dikembangkan memuat materi tentang HIV/AIDS. Pengembangan media pembelajaran ini menggunakan software Adobe Flash Cs3 Professional. Media yang telah dikembangkan melalui dua tahap penelitiannya itu validasi ahli dan uji coba lapangan. Berdasarkan validasi ahli dan uji coba lapangan hasil penelitian menunjukkan produk termasuk kriteria "Sangat baik" dengan rerata skor 4,25. In this article we discuss evidence-based elements of effective in-home child welfare services as a foundation for advancing the evidence base for family-centered child welfare practice. In 2009 the U.S. Children’s Bureau established the National Resource Center for In-Home Services to build the capacity of state and tribal child welfare agencies to ensure the safety and well-being of children and youth in their homes, prevent their initial placement or re-entry into out-of-home care, and to support families in their role as primary caregivers. Over the past 20 years, neglect has been the most pervasive form of child maltreatment in the United States, affecting more than half a million children annually. Further, neglect is more likely than other forms of maltreatment to occur repeatedly within child welfare-involved families. Children experiencing neglect, especially early in childhood and with regularity, face long-term deleterious effects on their physical, cognitive, social, and emotional development. Despite the ubiquity of neglect throughout child welfare and the potentially devastating consequences, interventions designed to target families chronically reported to Child Protective Services (CPS) for neglect are scant. Children with special needs often require additional supports in child care settings. The provision of technical assistance (TA) and consultation to child care teachers is an established method for addressing this need. This study expands on existing research by bringing the perspective of different adults (parents, technical assistance consultants, teachers, and child care center directors) together to better understand the experiences of all parties involved in TA cases for children between the ages of three and five. The concerns most frequently leading to the consultation were social-emotional-behavioral (50.5%), developmental (32.3%), medical (28.3%), and environmental risk (14%), and one quarter of …

Families involved in the child welfare system have disproportionately high rates of child mental health difficulties coupled with co-occurring stressors which impede access to child mental health treatment and therapeutic benefits. Peer support providers, an emerging workforce within child-serving settings, show particular promise at facilitating access to services, particularly for individuals with stigmatizing conditions. However, the perceived benefits of utilizing peer support providers from the perspective of child welfare-involved families is unknown. Religious Faith And Depression Among Child Welfare Involved Mothers With Young Children, Elissa E. Madden, Donna M. Aguiniga, Karen T. Zellmann

Journal of Family Strengths

Using secondary data from the Fragile Families and Child Wellbeing Survey of New Parents, this study explores the association between religion and depression in a nationwide sample of mothers with young children who were referred to Child Protective Services (N=344). The findings suggest that, when controlling for other contextual factors, mothers who viewed their religious faith as a guide for their daily lives were more than three times as likely to have experienced depression within the last year. Additionally, mothers who attended religious services a few times a month were significantly less likely to experience depression than mothers who reported …

This cross-sectional study explored child welfare agency workers' attitudes and practice regarding working with fathers whose children are at-risk for abuse and neglect. Agency workers completed a questionnaire about their attitudes towards working with fathers, their knowledge of barriers to fathers' engagement, and their experiences with their own fathers. They also completed open-ended items about services and supports they felt would be most helpful to fathers. A content analysis of the data revealed critical themes for four areas that workers felt could be enhanced to effectively engage fathers: (a) use diligent efforts that ensure fathers are present to contribute, (b) …

Accurately assessing caregiver satisfaction in their child’s education creates an opportunity for two-sided conversations between caregivers and schools that fosters active family involvement in education. In response to the need for accurate assessment of caregiver satisfaction, Fantuzzo, Perry and Childs (2006) created the Parent Satisfaction in Educational Experiences Scale (PSEE) specifically for low-income caregivers of preschool aged children attending Head Start preschool programs as well as caregivers of kindergarten students. There is a limited, but growing body of research on the effectiveness of peer recovery coaches in promoting treatment engagement, retention, and completion among child welfare-involved parents with substance use disorders. A quasi-experimental design was employed using propensity score matching to examine treatment engagement and treatment completion among child welfare-involved substance abusing parents who were exposed to either peer recovery coach engagement services or professional, non-peer engagement services. This study focuses on the field test of a design team intervention in two rural and one urban site experiencing high workforce turnover. Hypothesis 1: Job satisfaction is significantly improved among public child welfare workers participating in the Design Team intervention. Hypothesis 2: Job satisfaction is significantly related to lower turnover in public child welfare workers participating in the Design Team intervention. This study analyzes the demographic characteristics of foster care children under the conservatorship of the Department of Family and Protective Services (DFPS) in Texas from 2002 to 2013. Using one state as an example, the progress charting data in 12 years demonstrates the need to set up a national agenda on closing the gap in racial disproportionality. While the data reveal an increase of Hispanic children in foster care from 33.6% in 2002 to 41.3% in 2013, in terms of disproportionality, the ratio index for Hispanic children has been much lower (0.83) than that for African American children (2.33) over …

As of 2014, it is estimated that 1 in 68 children born in the United States will be diagnosed with an autism spectrum disorder (ASD). Previous research finds that children with ASDs are victimized at disproportionately high rates compared to their typically-developing peers. Utilizing survey data from a national sample of parents of children with ASDs (n=262) and in-depth semi-structured follow up interviews with a fraction of these participants (n=40), this study indicates that there are potential risk and protective factors in a range of dimensions that may impact the likelihood of victimization among children with autism. Deaccessioning And Agency Costs Of Free Cash Flow In Manager's Hands: A Formal Model, Andrej Srakar

The problem of agency costs of free cash flow in manager's hands has been firstly noted by Easterbrook and Jensen. We present one of the first attempts to formally model the problem in light of similar situation faced by managers of museums being allowed (or disallowed) to deaccession the artworks from their collections. We show that deaccessioning funds always lead to various forms of agency costs for the museum. This finding applies for any non-profit firm and its endowment. The task lying ahead is to formally prove the general conjecture also for the case of private for-profit firms.

This paper outlines some of the environmental and economic implications of an additional CO2 tax of EUR 15/tCO2 in Slovenia in the period 2012-2030 in order to determine whether it yield a double dividend. Authors analyze (using E3ME model) different forms of revenue recycling by reducing the social security contributions of either the employers or the employees or by reducing the public deficit, in order to identify the optimal fiscal instrument for improving the environmental and economic welfare (double dividend). Paper analyses barriers to science-industry cooperation in Slovenia through three detailed case studies. Each case tackles both sides, industry (firms) and science (university/research institute). Case studies confirm our assumption that it is the lack of companies with in-house R&D activities which is the main structural deficit for more science-industry cooperation. Strengthening of firms’ in-house R&D departments and staff, and clustering of firms around the most propulsive ones is the precondition for more science-industry cooperation.
