A Judicial Cure For The Disease Of Overcriminalization, Stephen F. Smith Aug 2014

A Judicial Cure For The Disease Of Overcriminalization, Stephen F. Smith

Journal Articles

The dangers of “overcriminalization” are widely appreciated across the political spectrum, but confusion remains as to its cause. Standard critiques fault legislatures alone. The problem, however, is not simply that too many criminal laws are on the books, but that they are poorly defined in ways that give unwarranted sweep to the criminal law, raising the danger of punishment absent or in excess of moral blameworthiness. Instead of narrowing ambiguous criminal laws to more appropriate bounds, courts frequently expand them, even when this ratchets up the punishment that offenders face, and fail to insist on proof of sufficiently culpable states …

The Debt Penalty: Exposing The Financial Barriers To Offender Reintegration, Douglas N. Evans Aug 2014

The Debt Penalty: Exposing The Financial Barriers To Offender Reintegration, Douglas N. Evans

Publications and Research

Financial debt associated with legal system involvement is a pressing issue that affects the criminal justice system, offenders, and taxpayers. Mere contact with the criminal justice system often results in fees and fines that increase with progression through the system. Criminal justice fines and fees punish offenders and are designed to generate revenue for legal systems operating on limited budgets. However, fines and fees often fail to accomplish this second goal because many offenders are too poor to pay them. If they do not pay their financial obligations, they may be subject to late fees and interest requirements, all of …

Dog Bite Health Burden In Alaska Communities, 2002-2012, Marina Vinnikova Aug 2014

Dog Bite Health Burden In Alaska Communities, 2002-2012, Marina Vinnikova

Student Projects for Graduate Degrees

Dog bite injuries and fatalities are major public health problems nationwide. Alaska dog bite hospitalization rates are consistently higher than national rates, indicating that a health disparity exists. In Alaska dog bite injuries are inconsistently recorded and are not centrally reported. The objective of this study was to characterize dog bite injuries and victims in Alaskan communities for 2002-2012. A cross sectional study design was used in this first attempt to consolidate and analyze scattered statewide data regarding dog bites. Results showed that the vast majority of dog bites in Alaska went unreported, and confirmed previous research that the Alaska …

Detecting Heat Waves: Comparison Of Various Heat Wave Definitions With Excess Mortality, Lance Elliott Watkins Aug 2014

Detecting Heat Waves: Comparison Of Various Heat Wave Definitions With Excess Mortality, Lance Elliott Watkins

Theses and Dissertations

Four different heat wave definitions (as outlined by Hajat et al, 2006; D’lppoliti et al, 2010; Anderson and Bell, 2011; Nairn and Fawcett, 2013) were used to characterize heat wave mortality across the United States. The goal was to identify if certain definitions perform better or worse than others. Overall every definition performed poorly, resulting in high False-Alarm Ratios and low Heidke Skill Scores. However, the Nairn and Fawcett (2013) and Anderson and Bell (2011) definitions performed consistently better than the other definitions. Despite several limitations, the results of this study indicate that the heat wave definitions need refinement. Additionally, …
