Cloud computing and digital forensics are emerging fields of technology. Unlike traditional digital forensics where the target environment can be almost completely isolated, acquired and can be under the investigators control; in cloud environments, the distribution of computation and storage poses unique and complex challenges to the investigators. Recently, the term “cloud forensics” has an increasing presence in the field of digital forensics. This project examined the problem of juvenile crime and incarceration. I explored how two Criminal Justice theories—Attribution theory and Deterrence theory—support and explain the problem, and how two Social Work theories—Social Justice theory and Responsive Regulation theory—offer an alternative view and solution to the problem. I explained the principles and program models of Restorative Justice and strived to understand why there are so few Social Workers involved in Restorative Justice programs. On May 17, 1954 the Supreme Court handed down two decisions that for the first time categorically held that racial segregation in public schools was per se unlawful – Brown v. Board of Education and Bolling v. Sharpe. Ostensibly, both cases dealt with a same question; however, in Brown the entity accused of discrimination was a creature of the State of Kansas, while in Bolling the discrimination was practiced by the federal government. The problem that the Supreme Court faced was the language of the Fourteenth Amendment, which, by its own terms, guaranteed “equal protection of the laws” only vis-à-vis …

The importance of the military as a police model in the U.S. had been eliminated, for the most part, from criminal justice and police studies until the 1980s-1990s, even as the professional model was studied extensively. The military, however, had been a strong presence since at least the turn of the last century. As reformers from that time began to fight against machine rule in city after city, they often adopted the military paradigm as their police model, and sought those with military backgrounds to head police departments. Seeing The State: Women, Incarceration, And Social Marginality, Cesraea Rumpf

Based on in-depth, semi-structured qualitative and photo-elicitation interviews with 36 formerly incarcerated women, this dissertation answers three central research questions: (1) How does the state structure women's post-incarceration experiences? (2) How do these post-incarceration experiences relate to women's experiences of criminalization and incarceration? (3) How do women respond to criminalization, incarceration, and post-incarceration? By centering women's standpoint, I draw upon poststructuralist theories of the state to show how women experienced governance across multiple sites. I first examine the violence and dehumanization women experienced in their encounters with the criminal legal system and how the state labeled women as "criminals" and …

Presidential debates are purposely held on college campuses because it is well-known that college students are a large voting population who often serve as leaders when it comes to political activism and community involvement. Moreover, when students leave home to attend college, some of them want to vote in their college towns. In fact, the U.S. Supreme Court in its 1979 landmark decision in Symm v. United States held that students have the constitutional right to register and vote where they attend college. However, despite the Symm’s decision and other constitutional protections, college students also have to be knowledgeable about …

The note argues that blanket bans on internet and internet-capable devices as a condition of supervised release for child pornography offenders are unconstitutional under the doctrine of unconstitutional conditions. These bans infringe on fundamental liberties such as speech, association, and access to information, disproportionately affecting offenders’ ability to reintegrate into society. The analysis advocates for a balanced approach that prioritizes public safety while respecting constitutional rights, suggesting alternatives like supervised release rather than outright internet prohibition.

This Note addresses the recent Eight Circuit opinion in Keller v. City of Fremont, which upheld an Anti-Immigrant Housing Ordinance (AIHO) passed in Fremont, Nebraska. It reviews the doctrine of federal preemption, the long-recognized primacy of federal authority over immigration, and relevant case law. In light of the law and supporting policy, it concludes state and local AIHOs should be preempted by federal law.

Today, cyber threats have the potential to harm critical infrastructures which may result in the interruption of life-sustaining services, catastrophic economic damages or severe degradation of national security. The diversity and complexity of cyber threats that exploit the vulnerabilities of critical infrastructures increase every day. . Sharing economies, with their vast diversity of goods and services offered and rapidly evolving business models, have proven inconducive to traditional-regulatory approaches. Yet a complete laissez-faire approach or complete ban is not advisable. On the one hand, it is in the public interest to allow these new economies to continue to innovate, as they create value from unused assets, facilitate useful market transactions, and sometimes even lead to the creation of new goods and services to improve quality of life. Cyber “warfare” and hackback by private companies is a hot discussion topic for its potential to fight cybercrime and promote cybersecurity. In the shadow of this provocative discussion, Microsoft has led a concerted, sustained fight against cybercriminals by using traditional legal theories and court actions to dismantle criminal networks known as botnets. This article brings focus to the role of the private sector in cybersecurity in light of the aggressive civil actions by Microsoft to address a thorny and seemingly intractable global problem. American Indian/Alaskan Native (AI/AN) people are known to have a history of man-made trauma that corresponds to the colonization of the Americans. Trauma experienced by AI/AN sex offenders has not been evaluated in the research as it relates to their treatment planning. The lack of data reflecting intervention needs for AI/AN sex offenders is problematic. The current study hypothesized that American Indian sex offenders would report a greater number of trauma experiences, endorse increased symptoms of Posttraumatic Stress Disorder (PTSD), display more traumatic cognitions, and endorse higher dissociative experiences than Caucasian sex offenders. In Idi Amin’S Shadow: Women, Gender, And Militarism In Uganda, Alicia C. Decker

In Idi Amin’s Shadow is a rich social history examining Ugandan women’s complex and sometimes paradoxical relationship to Amin’s military state. Based on more than one hundred interviews with women who survived the regime, as well as a wide range of primary sources, this book reveals how the violence of Amin’s militarism resulted in both opportunities and challenges for women. Some assumed positions of political power or became successful entrepreneurs, while others endured sexual assault or experienced the trauma of watching their brothers, husbands, or sons “disappeared” by the state’s security forces. This essay examines three cases from the Supreme Court’s October Term 2013 addressing the standards for summary judgment. In one case, the Court affirmed summary judgment against a civil-rights plaintiff, in a continued erroneous over-reliance on the certainty of video evidence. In two other cases, the Court rejected the grant of summary judgment against civil-rights plaintiffs, arguably for the first time in quite a while. This essay unpacks the substance and procedure underlying all three decisions and considers the effect of the three cases and what signals they send to lower courts and litigants about the proper approach to summary …

In Making Space for Dying: Portraits of Living with Dying, I describe the everyday lived experience of dying and the care culture within freestanding, community-based, end-of-life residences (CBEOLR) utilizing portraiture and arts-based research. I craft four case studies into “portraits,” based on interviews, on-site visits, up-close observation, and field notes. In the person-centered portraits, I reveal the inner landscape of two terminally ill women, with data represented in poetry. In the place-centered portraits, I “map” the social topography of two CBEOLRs to illustrate how lives and care of the dying are emplaced, from the perspectives of community leaders, …

Failure To Report: The Manifestly Unconstitutional Nature Of The Human Smugglers Act, Jennifer Bond

This paper uses the Human Smugglers Act as a case study of what can happen when a Canadian government tables legislation that is highly controversial not only for reasons of ideology or policy, but also because it almost certainly violates the Charter. The conclusion is twofold: first, that a requirement originally meant to increase government accountability in the face of Canada’s human rights instruments is failing; and second, that this same requirement is now providing the government political cover to deflect legitimate constitutional critique while simultaneously avoiding substantive engagement. Compared to post-crisis communication, pre-crisis communication has received little attention in strategic communication research. As the population and use of social media platforms increase, so does the role they play in strategic pre-crisis communication. Based on a message framing approach, this study focused on examining how Hyundai Motor company (hereafter Hyundai) communicated with its publics through social media channels as a platform for their strategic pre-crisis communication response to the current technical issue, regarding its models’ overestimated Miles Per Gallon (MPG) flaw. Purpose– The aim of this paper is to examine how crises can be triggered online, how different social media tools escalate crises, and how issues gain credibility when they transit to mainstream media.Design/methodology/approach– This exploratory study uses the multiple case study method to analyze five crises, generated online, throughout their life-cycles, in order to build analytic generalizations (Yin).Findings– Crises are often triggered online when stakeholders are empowered by social media platforms to air their grievances. Environmental organizations have experienced a string of recent courtroom successes enforcing the federal Species At Risk Act. This case comment examines one of these cases, Minister of Fisheries and Oceans v. David Suzuki Foundation (“Killer Whales”), to expose the rule-of-law underpinnings of the Federal Court of Appeal’s decision. It argues that, while the decision is on its face an ostensible victory for endangered species protection, the conception of the rule of law on which the court relies is incapable of providing meaningful legal constraints for much environmental decision-making.
