The Right To Digital Privacy: Advancing The Jeffersonian Vision Of Adaptive Change, Kerry Moller Jan 2014

The Right To Digital Privacy: Advancing The Jeffersonian Vision Of Adaptive Change, Kerry Moller

CMC Senior Theses

The relationship between privacy, technology, and law is complex. Thomas Jefferson’s prescient nineteenth century observation that laws and institutions must keep pace with the times offers a vision for change. Statutory law and court precedents help to define our right to privacy, however, the development of new technologies has complicated the application of old precedents and statutes. Third party organizations, such as Google, facilitate new methods of communication, and the government can often collect the information that third parties receive with a subpoena or court order, rather than a Fourth Amendment-mandated warrant. Privacy promotes fundamental democratic freedoms, however, under current …

Assessing The Effectiveness Of Reality-Based Focusing Events Across The Curriculum, Eloy Nunez, Ernest G. Vendrell, Nancy Ryan Jan 2014

Assessing The Effectiveness Of Reality-Based Focusing Events Across The Curriculum, Eloy Nunez, Ernest G. Vendrell, Nancy Ryan

International Journal for the Scholarship of Teaching & Learning

A mythical Democratic-Republican National Convention (DRNC) was created as a focusing event which serves as the overarching theme for all newly redesigned courses in the graduate Criminal Justice Department at Saint Leo University. The study examines the effectiveness of focusing events in a graduate level curriculum. Students in the newly redesigned DRNC courses were surveyed. The results indicate that the overarching theme was perceived as being a valuable learning tool. The respondents indicated that the DRNC scenarios were highly realistic and would strengthen decision-making skills in their individual criminal justice careers. Somewhat surprising was the finding that the newly designed …

At The Intersections Of Dialogue, Social Media, And Crisis Communication: A Case Study Of Consolidated Edison's Communicative Response To Superstorm Sandy, Nathan Furstenau Jan 2014

At The Intersections Of Dialogue, Social Media, And Crisis Communication: A Case Study Of Consolidated Edison's Communicative Response To Superstorm Sandy, Nathan Furstenau

Masters Theses

Crisis is constantly lurking in the shadows for organizations, and leaders must be prepared to respond when it strikes. Traditional organization-stakeholder communication models have largely relied on one-way frameworks, but the advent and widespread adoption of social media is changing the way organizations and stakeholders interact. This project explores how one organization, Consolidated Edison, utilized Twitter to communicate dialogically with stakeholders during the 2012 Superstorm Sandy crisis. Analysis focuses on how the organization's use of dialogue and Sturges' (1994) instructing and adjusting information tactics helped mitigate negative backlash from stakeholders throughout the crisis. Theoretical and practical implications for public relations …

Collaboration For The Common Good: Examining Americorps Programs Sponsored By Institutions Of Higher Education, Erin B. Brown

Theses and Dissertations

The report, A Crucible Moment, published in 2012 by the National Task Force on Civic Learning and Democratic Engagement described a crisis in higher education surrounding the lack of civic learning and engagement opportunities for students. This crisis has led to decreased political participation and a general lack of knowledge in civics education (National Task Force on Civic Learning and Democratic Engagement, 2012). Educating students for citizenship in America’s colleges and universities will assist with sustaining the country’s democracy by engendering a sense of civic responsibility in young adults that will last throughout their lifetime. This qualitative case study …

The Future Of Medicaid Supplemental Payments: Can They Promote Patient-Centered Care?, Laura Hermer, Merle Lenihan Jan 2014

The Future Of Medicaid Supplemental Payments: Can They Promote Patient-Centered Care?, Laura Hermer, Merle Lenihan

Faculty Scholarship

Supplemental Medicaid payments such as DSH and UPL are the exception to the financing of specific services to specific patients. Medicaid DSH funds currently finance over 30 percent of hospital care to the uninsured. As a result of the Affordable Care Act (ACA), DSH funds will be substantially reduced. At the same time, their importance will be heightened, especially in states that refuse to take up the ACA’s Medicaid expansion. DSH payments to hospitals have been plagued by a lack of accountability and transparency and an inability to assess whether patients benefit from such payments. Flexibility in the DSH program …

On The Uneasy Relationship Between Medicaid And Charity Care, Laura D. Hermer, Merle Lenihan Jan 2014

On The Uneasy Relationship Between Medicaid And Charity Care, Laura D. Hermer, Merle Lenihan

Faculty Scholarship

Medicaid and charity care have a lengthy relationship fraught with complications. These complications will remain and in some respects become even more acute following the implementation of the Patient Protection and Affordable Care Act.

This article focuses on the uneasy relationship between Medicaid and charity care, one that becomes particularly acute in the context of Medicaid reimbursement. It traces the lineage of Medicaid in charity, and uses Medicaid reimbursement and supplemental payments as lenses through which to examine the relationship between Medicaid and charity care. The tension that we uncover will need to be resolved if Medicaid is to come …

Touching Torture With A Ten Foot Pole, Craig Forcese Jan 2014

Touching Torture With A Ten Foot Pole, Craig Forcese

Osgoode Legal Studies Research Paper Series

In 2011, then-Public Safety Minister Vic Toews issued “ministerial directions” to Canada’s key security and intelligence agencies on “information sharing with foreign entities”. These directions permit information sharing in exigent circumstances, even “when doing so may give rise to a substantial risk of mistreatment of an individual”. The directions prompted a brief chorus of condemnation. They have since sunk into relative obscurity, remaining part of the Canada’s national security policy framework. And yet, in trying to walk the fine line between principle and realism in the administration of Canada’s approach to torture, they continue to raise pressing moral and legal …

Justice As A Rounding Error? Evidence Of Subconscious Bias In Second-Degree Murder Sentences In Canada, Craig Jones, Micah B. Rankin

Osgoode Legal Studies Research Paper Series

There are few areas of law that grant judges as much discretion as the sentencing of criminal offenders. This discretion necessarily leads to concerns about the influence of biases, including those that result from subconscious processes associated with human cognition; that is to say, “heuristics”. In this article, the authors explore one heuristic – “number preference” – through an examination of all reported second degree murder parole ineligibility decisions between 1990 and 2012. Number preference leads individuals to predictably “round off” measurements to certain favoured numbers. The authors identify a tendency for parole ineligibility decisions to “cluster” around even numbers …

The Protection Of The Rights Of Homosexuals Under The International Law Of Human Rights: European Perspectives, Philip Girard Jan 2014

The Protection Of The Rights Of Homosexuals Under The International Law Of Human Rights: European Perspectives, Philip Girard

Osgoode Legal Studies Research Paper Series

The Parliamentary Committee on Equality Rights heard a number of submissions from various groups urging the amendment of the Canadian Human Rights Act to include "sexual orientation" as a prohibited ground of discrimination, and amendment of the Charter itself to rectify the lack of specificity on the topic in the enumeration of equality rights contained in section 15. This article provides a comparative perspective by examining the rights of homosexuals under the international law of human rights. Particular attention is paid to the experience under the European Convention on Human Rights.

Balancing Privacy And The Open Court Principle Of Family Law: Does De-Identifying Case Law Protect Anonymity?, Sujoy Chatterjee Jan 2014

Balancing Privacy And The Open Court Principle Of Family Law: Does De-Identifying Case Law Protect Anonymity?, Sujoy Chatterjee

Dalhousie Journal of Legal Studies

This paper discusses the right to privacy in the context of family law cases. In balancing the open court principle against the right of the individual to remain anonymous, it is argued that there is a greater public good in maintaining transparency of the judicial process. Disclosing the personal details of individuals who use the public court system allows the public to hold the judiciary accountable for their decisions. While advocates for greater privacy would argue that the personal details of litigants have no bearing on the legal rules that emerge from cases, landmark decisions such as Murdoch v Murdoch …

Alcohol Use Disorders And Antiretroviral Therapy Among Prisoners With Hiv/Aids In Argentina, Michael Drake Alpert Jan 2014

Alcohol Use Disorders And Antiretroviral Therapy Among Prisoners With Hiv/Aids In Argentina, Michael Drake Alpert

Yale Medicine Thesis Digital Library

While Argentina has significantly improved access to HIV care and antiretroviral therapy (ART) for both the general population and prisoners, the prevalence of alcohol use disorders (AUDs) among HIV-infected prisoners and their relationship to accessing ART in Argentina is currently unknown. This study aims to characterize the substance abuse patterns of HIV-infected prisoners in Argentina and to assess the independent correlates of receipt of pre-incarceration ART.

An anonymous, cross-sectional survey of 100 HIV-infected federal prisoners was conducted in the Buenos Aires municipality from July-December 2010. AUDs were assessed using the AUDIT scale.

A majority (63 per cent) of participants met …

Increasing Compliance With A Tobacco-Free Policy Via A Campus Campaign, Rachael A. Record Jan 2014

Increasing Compliance With A Tobacco-Free Policy Via A Campus Campaign, Rachael A. Record

Theses and Dissertations--Communication

The implementation of a tobacco-free policy is the leading recommendation among health institutes for reducing the harms associated with tobacco exposure–for both smokers and nonsmokers–on college campuses. Despite the health benefits associated with tobacco-free policies, compliance with these policies remains a serious challenge on college campuses. Interventions aimed at increasing smokers’ willingness to comply with tobacco-free policies are essential for improving public health.

Guided by the theory of planned behavior (TPB), the purpose of this study was to (a) investigate the factors associated with tobacco-free policy compliance among undergraduate students and (b) design and evaluate a theory-based campaign aimed at …

The Punishment Agenda In The Courts, Debra Parkes Jan 2014

The Punishment Agenda In The Courts, Debra Parkes

The Supreme Court Law Review: Osgoode’s Annual Constitutional Cases Conference

This paper critically examines the potential of prisoner litigation in Canada to shed light on what U.S. Supreme Court Justice Anthony Kennedy has called “the hidden world of punishment”. It considers whether prisoners’ rights litigation can act as a meaningful legal check on the growing punishment agenda in Canada. The paper begins with a brief description of some aspects of the punishment agenda before moving on to consider case law under the section of the Canadian Charter of Rights and Freedoms which speaks directly to punishment and its limits, the section 12 right to be free from “cruel and unusual …

Sacred Rain Arrow: Honoring The Native American Heritage Of The States While Balancing The Citizens' Constitutional Rights, Amelia Coates Jan 2014

Sacred Rain Arrow: Honoring The Native American Heritage Of The States While Balancing The Citizens' Constitutional Rights, Amelia Coates

American Indian Law Review

Many states’ histories and traditions are steeped heavily in Native American culture, which explains why tribal imagery and symbolism are prevalent in official state paraphernalia such as license plates, flags, and state seals. Problems arise for states using Native American artwork when a citizen takes offense to the religious implications of Native American depictions, and objects to having it displayed on any number of items. This Comment will examine the likely outcome of cases involving Establishment Clause and compelled speech claims arising from Native American images and propose a solution for balancing the constitutional rights of the citizens while still …

Big Data Distortions: Exploring The Limits Of The Aba Leatpr Standards, Andrew G. Ferguson Jan 2014

Big Data Distortions: Exploring The Limits Of The Aba Leatpr Standards, Andrew G. Ferguson

Oklahoma Law Review

Before moving on to my contribution about how the growing reliance on big data analytics may necessitate a slight modification to the ABA Standards on Law Enforcement Access to Third Party Records (LEATPR Standards), I would like first to pay a few compliments to the drafters of the LEATPR Standards for producing such a systematic, thoughtful, and elegant framework for considering Fourth Amendment freedoms. As anyone who writes about or teaches the Fourth Amendment knows, the doctrine remains a theoretical muddle. Yet, despite a minefield of conflicting precedent, the drafters of the LEATPR Standards have managed to construct a defensible …

Exploring Community Engagement In The Indianapolis Opera Scene, Nicole Vasconi Jan 2014

Exploring Community Engagement In The Indianapolis Opera Scene, Nicole Vasconi

Undergraduate Honors Thesis Collection

Despite its long history, the majority of today's society no longer holds this art form in such high regard. This is especially true for American culture, where opera companies are operating amidst a tumultuous time of foreclosures. The reasons for opera's continued decline in popularity among American audiences is a hotly debated topic for music historians and administrators, but the fact remains that the general public who once regarded opera as popular entertainment now rejects it as paltry and pointless. It is too Like many contemporary American opera companies, Indianapolis Opera and easy to cite the operas themselves as the …

Corporate Law Constraints On Political Spending, James Kwak Jan 2014

Corporate Law Constraints On Political Spending, James Kwak

Faculty Articles and Papers

Corporations currently can participate in electoral politics in the United States through various means: affiliated PACs, super PACs, 501(c)(6) organizations like the Chamber of Commerce, 501(c)(4) social welfare organizations, and traditional 501(c)(3) charitable organizations. Corporate law, as generally interpreted by the courts, places few constraints on the ability of corporate insiders to engage in politics as they choose. I argue that existing statutes and case law could be interpreted to impose greater constraints on corporate political activity. Political contributions should be reviewed as potential violations of the duty of loyalty whenever they could provide personal benefits to board members and …
