Ordered Gun Liberty: Rights With Responsibilities And Regulation, Linda C. Mcclain, James E. Fleming May 2014

Ordered Gun Liberty: Rights With Responsibilities And Regulation, Linda C. Mcclain, James E. Fleming

Faculty Scholarship

This Article focuses on the case of the Second Amendment right to bear arms and gun control to examine whether the Constitution has fostered a pathological rights culture of rights without responsibilities and regulation. We offer some preliminary thoughts about “ordered gun liberty” – the individual right to bear arms in relation to responsibilities, virtues, and regulation. This article addresses a conundrum concerning this right: there is no individual right that cries out more for governmental encouragement of responsibility concerning its exercise and for governmental regulation to promote safety and to protect from harm, and yet there is no individual …

Perspectives On Criminal Litigation Ethics: James Cole & Jeffrey Adachi, James Cole, Jeffrey Adachi

UC Law Journal

In August 2013, U.C. Hastings College of the Law was honored to host its first ever MCLE conference addressing “Criminal Litigation Ethics.” MCLE, of course, means “mandatory continuing legal education,” and I was pleased to organize a conference that addressed, in an academic setting, this vital topic of practical lawyering that appears in the headlines almost every day. Our unique objective was to provide two full days of hands-on training by nationally prominent criminal defense and prosecution lawyers, for litigating lawyers as well as law students, separated by setting and geography from the competition of daily practice. The conference was …

Selected Topics In Foundation Design, Quality Assurance, And Remediation, Danny Winters

USF Tampa Graduate Theses and Dissertations

There are over 602,000 bridges in the United States, of which 12.5% are classified as functionally obsolete and 11.2% are structurally deficient. The functionally obsolete bridges will require expansion or replacement to increase the service capacity of the bridge. The structurally deficient bridges will either need remediation of the load carrying elements which are damaged or deteriorated or will need to be replaced completely. Replacement of the bridges means new construction; new construction means better design and quality assurance to meet the 100+ year service life requirement in place now. Rehabilitation of bridges will require better design and quality assurance …

The Western New York Nonprofit Organizations Programs/Services Help Support Immigrants/Refugees To Build Businesses And Neighborhoods, Seraphine Udahemuka-Sargent Mrs

Public Administration Master’s Projects

The number of immigrants and refugees settling in Buffalo has been increasing for the last decades, and the studies have shown that by settling in the abandoned inner cities, immigrants are revitalizing these areas (Cornelius, 2011) and along with reductions in crime and decreases in concentrated poverty (Spector, 2013). While research has focused on gateway cities in California, there are not many studies or documents that address immigration and the revitalization of the City of Buffalo. This research project is intended to explore the programs/services helping to support immigrants/refugees to build small businesses and become home owners, through the Westminster …

Abstract

Drone technology is evolving rapidly. Microdrones—what the FAA calls “sUAS”—already on the market at the $1,000 level, have the capability to supplement manned helicopters in support of public safety operations, news reporting, and powerline and pipeline patrol, when manned helicopter support is infeasible, untimely, or unsafe.

Larger drones–"machodrones”–are not yet available outside battlefield and counterterrorism spaces. Approximating the size of manned helicopters, but without pilots, or with human pilots being optional, their design is still in its infancy as designers await greater clarity in the regulatory requirements that will drive airworthiness certification.

This article evaluates drone technology and design …

Applying Michigan V. Summers To Off-Premises Seizures: The "As Early As Practicable" Standard, David Torreblanca

St. John's Law Review

(Excerpt)

Part I provides an overview of the Fourth Amendment’s protection against unreasonable searches and seizures, first discussing general Fourth Amendment principles, then analyzing the Supreme Court’s Summers decision. Part II addresses the circuit split over extending Summers where the occupant of the premises has left the property. Part II discusses the approaches taken by the four circuits that have applied, and the two circuits that have declined to apply, Summers to off-premises detainments. Part III argues that the circuits that have extended Summers where officers have detained occupants off premises are correct. It asserts that such detainments are reasonable …

Restoring The Balance Between Immigration Self-Reporting Requirements And The Fifth Amendment, Sheena Kelley Apr 2014

Restoring The Balance Between Immigration Self-Reporting Requirements And The Fifth Amendment, Sheena Kelley

St. John's Law Review

(Excerpt)

This Note argues that the test currently relied on to maintain this balance is no longer effective and must be replaced. Part I analyzes the history of immigration law and limitations on Fifth Amendment protections. Part I also examines the legislative history of 8 U.S.C. § 1324(a)(2)(B)(iii) and its intended use as an anti-smuggling statute. Part II discusses the factors used by courts to evaluate Fifth Amendment claims and courts’ treatment of various reporting provisions. This Part also discusses how these factors, as they are currently applied by the courts, no longer adequately protect individuals’ Fifth Amendment rights. Part …
