Flawed Coalitions And The Politics Of Crime, David Jaros May 2014

Flawed Coalitions And The Politics Of Crime, David Jaros

All Faculty Scholarship

Bipartisanship can be dangerous. In the late 1970s, liberal and conservative forces united to discard two centuries of federal sentencing practice and usher in an era of fixed guidelines that would reshape the criminal justice landscape. In the decades that followed, liberals would come to bitterly regret their alliance with conservative sentencing reformers. The guideline regime established by the Sentencing Reform Act ultimately advanced hardline conservative criminal justice goals that were antithetical to the objectives of many of the Act’s former liberal supporters.

Researchers have shown that a particular cognitive bias — cultural cognition — can explain why intense partisan …

Chamber Of Commerce V. Whiting: A Law Student's Freewheeling Inquiry, Laura E. Ploeg May 2014

Chamber Of Commerce V. Whiting: A Law Student's Freewheeling Inquiry, Laura E. Ploeg

Villanova Law Review (1956 - )

The Supreme Court, in Chamber of Commerce v. Whiting, should have found that federal law pre-empts the Arizona law, and that the Court’s holding will have serious consequences. Whiting departs from the Court’s traditional application of implied pre-emption and general pre-emption principles, which are well established and have been repeatedly applied over many years. The Court used implied pre-emption principles only a few years ago to strike down a state law with a similar relationship to federal law as the laws in Whiting. The Whiting Court should have found the Arizona law pre-empted by federal law because it undermines several …

Validity And Reliability Testing Of The National Health And Nutrition Examination Survey (Nhanes) Taste And Smell Protocol, Mallory Honda May 2014

Validity And Reliability Testing Of The National Health And Nutrition Examination Survey (Nhanes) Taste And Smell Protocol, Mallory Honda

Honors Scholar Theses

The NHANES 2011–2014 protocol includes a taste and smell questionnaire (CSQ) in the home interview followed by brief olfactory and taste assessment in mobile exam centers. The CSQ asks self-reported taste and smell ability, and selected symptoms, comorbidities, and treatment for chemosensory disorders. In the taste assessment, participants rate intensities of 1 M NaCl and 1mM quinine hydrochloride applied to the tongue tip and these plus 0.32M NaCl sampled with the whole mouth. Smell function is assessed with two 4-item, scratch-and-sniff tests (Pocket TestsTM (PT), Sensonics, Inc.) to classify normosmia and olfactory dysfunction from microsmia to anosmia. We examined …

The Financial Crisis Was Good For Something: Improved Nonprofit Efficiency, Caitlin Paige Britt May 2014

The Financial Crisis Was Good For Something: Improved Nonprofit Efficiency, Caitlin Paige Britt

Finance Undergraduate Honors Theses

This study explores the need for financial performance measures in the nonprofit sector and the impact the 2008-2009 Financial Crisis had upon nonprofits’ efficiency. This analysis tests the hypothesis that the financial crisis actually improved nonprofit efficiency by forcing nonprofits to eliminate unnecessary costs, continue to produce their services, thus improving operational efficiency, despite decreased donor contributions and increased user need. Entries reported on nonprofits’ IRS 990 forms from 2003-2010 determined whether nonprofit efficiency was significantly different after the crisis. The efficiencies used to measure the impact of the Financial Crisis include: Program Expense Efficiency, Administrative Expense Efficiency, Fundraising Expense …

Multimedia Portfolio, Dan Clark May 2014

Multimedia Portfolio, Dan Clark

Journalism Program

For a journalist, there are only a few things that can land you a job. One of those things is having a professional portfolio. That’s why the Journalism Department has its students complete a professional portfolio as part of their Honors program. The Honors Program takes work students have already completed, then asks them to revise it, or even do it again. That way, when we leave the program, we’re ready to start sending out portfolios and resumés to potential employers. My portfolio is dominated by work that I wrote for a print medium because that’s what our program focuses …

Risk Propensity, Self-Efficacy And Driving Behaviors Among Rural, Off-Duty Emergency Services Personnel, Michelle Yvonne Mclernon May 2014

Risk Propensity, Self-Efficacy And Driving Behaviors Among Rural, Off-Duty Emergency Services Personnel, Michelle Yvonne Mclernon

Dissertations

Emergency medical services personnel work in a fast-paced, stressful environment requiring rapid, efficient response to critical situations, creating unique safety considerations within the workforce. With an occupational fatality rate notably higher than average, most of which are attributed to vehicular crashes, compounded by risks faced on rural roadways, rural EMS personnel face unique driving challenges that may be exacerbated by the very traits, self-efficacy and risk propensity, that may have initially drawn them to the profession. The purpose of this study was to identify the extent to which rural EMS personnel engage in off-duty, risky driving behaviors and to examine …

Renée Crown University Honors Thesis Projects - All

This paper examines the problem that Carnival Cruise Lines (Carnival), a famous cruise ship line for vacationing, continues to endure crisis situations yet fails to take the appropriate actions for rectification.

It is common knowledge within the public relations field that a crisis can make or break the sustainability of a successful organization. This study focuses on three major incidents. The first one involves a fire in …

From Legalized Business Ethics To International Trade Regulation: The Role Of The Foreign Corrupt Practices Act And Other Transnational Anti-Bribery Regulations In Fighting Corruption In International Trade, Eric C. Chaffee May 2014

From Legalized Business Ethics To International Trade Regulation: The Role Of The Foreign Corrupt Practices Act And Other Transnational Anti-Bribery Regulations In Fighting Corruption In International Trade, Eric C. Chaffee

Mercer Law Review

The Foreign Corrupt Practices Act of 1977 (FCPA) has never had a clearly defined place in American law. Part of the problem is the enigmatic nature of the FCPA itself. Codified in scattered provisions among the statutes of the Securities Exchange Act of 1934 (Exchange Act), the FCPA contains provisions requiring companies issuing securities registered with the Securities and Exchange Commission (SEC) to maintain both accurate books and records and adequate internal accounting controls.? In addition, the FCPA also has provisions rendering unlawful transnational bribery, in other words, bribes paid directly and indirectly by individuals and entities residing or operating …

Personal Roots Of Representation: Applying Burden's Model To Female Leaders In State Legislatures, Lindsey Juszczak May 2014

Personal Roots Of Representation: Applying Burden's Model To Female Leaders In State Legislatures, Lindsey Juszczak

Undergraduate Honors Theses

The role of women in politics is not a new concern in the United States. However, the number of women being elected into leadership positions at all levels of government is growing. Reasons for women's political drive and ambition stem from various aspects of their life. Barry Burden believes that the roots of personal representation like a representative's religion, education, and home life are important factors that drive politicians in their careers. Burden's model can be used to understand why women in leadership roles are motivated in a certain way to represent and respond to constituents. Specifically, this research studies …

“As travelers, business leaders, employees, parents and consumers, we make decisions related to countries every day: how we describe our identity, where we choose to live, who and where we buy our products from, where we educate our children, where we set up our companies and where we go on holiday…Every time we make a decision informed by an association with a place, it creates the future” (Country Brand Index). For the past eight years, FutureBrand has released a Country Brand Index Report that polls thousands of people worldwide to gather their perceptions of countries and rank the countries according …

Construct Validity Of The Hare Psychopathy Checklist Revised (Pcl-R) For The Purposes Of Predicting Recidivism In Sex Offenders, Courtney Mccue May 2014

Construct Validity Of The Hare Psychopathy Checklist Revised (Pcl-R) For The Purposes Of Predicting Recidivism In Sex Offenders, Courtney Mccue

Master's Theses or Doctor of Nursing Practice

To be eligible for civil commitment under the Kansas Sexually Violent Predator Act (K.S.A 59-29a02,1994), three criteria must be satisfied; being the person must have past sex offenses, a mental abnormality, and be likely to sexually recidivate within the community. The Hare Psychopathy Checklist-Revised (PCL-R) (Hare, 2003) is a tool often used by clinicians completing sexual predator evaluations as a means to assess for psychopathy, a mental disorder capable of satisfying criteria two. However, due to the amount of literature linking psychopathy to recidivism, the PCL-R has been presented and/or interpreted to also satisfy criteria three within the law, likely …

Procedural Due Process In Modern Problem-Solving Courts: An Application Of The Asymmetric Immune Knowledge Hypothesis, Leah C. Georges May 2014

Procedural Due Process In Modern Problem-Solving Courts: An Application Of The Asymmetric Immune Knowledge Hypothesis, Leah C. Georges

Department of Psychology: Dissertations, Theses, and Student Research

Problem-solving courts, such as drug and mental health courts, function under the model of therapeutic jurisprudence—the idea that legal policies and procedures should help and not harm clients, within the confines of the law (Winick & Wexler, 2002). Although it would seem that the lack of procedural due process in most problem-solving courts is in direct opposition to the best interests of a client, it is possible that observers find this more of a problem than do the court clients themselves. This two-experiment study applied Igou’s (2008) AIK hypothesis to problem-solving courts’ practice of sanctioning in the absence of due …

Sexual Offender Treatment: A Paradigm Analysis Of Academic Journals, Vijay Chillar May 2014

Sexual Offender Treatment: A Paradigm Analysis Of Academic Journals, Vijay Chillar

HIM 1990-2015

Many criminologists and psychologists have theorized the possible causes behind an individual who engages in sex offenses; some of which will be reviewed. Through this paradigm analysis, I hope to identify how each discipline addresses the causes of sex offending and what treatments they offer in response to their theories. Additionally, this thesis will examine the Good Lives, Relapse Prevention, and the Risks, Need, Responsivity (RNR) models of treatment. The main objective of this thesis is to address the different facets of sex offending, so that the importance of finding an effective treatment model can be understood. By raising awareness …

Recidivism Prevention Through Prosocial Support: A Systematic Review Of Empirical Research, Kimber Mcdaniel

HIM 1990-2015

Of the 700 offenders that are released from prison each year, seven in ten will be rearrested. There are a number of barriers face by released offenders that inhibit their successful reentry. These barriers include: mental health illness, limited work experience, lower education, substance abuse, lack of transportation, homelessness and poverty strain of family ties and/or close relationships. This paper explores the impact of social support on recidivism rates through a systematic review of the literature surrounding prosocial support. The implications for social work practice and research are also discussed.

Pedicures In Combat Boots: Navigating Gender In The Syracuse Police Department, An Ethnographic Analysis, Rebecca Ierardo

Renée Crown University Honors Thesis Projects - All

In an ethnographic analysis, I seek to answer the question: how, if at all, does gender interact with police work? Using the women of the Syracuse Police Department (SPD) as the defined population for my study, I conducted 4 in-depth ethnographic interviews along with 5 sessions of participant observation, accompanying female officers during their shifts for anywhere from 4-8 hours at a time. Historically, women’s presence in law enforcement has been almost nonexistent, particularly in police work which is overwhelmingly perceived as the domain of men. Women in police work have made some progress parallel to social progress over time, …
