A Common Law Constitutionalism For The Right To Education, Scott R. Bauries

This Article makes two claims, one descriptive and the other normative. The descriptive claim is that individual rights to education have not been realized under state constitutions because the currently dominant structure of education reform litigation prevents such realization. In state constitutional education clause claims, both pleadings and adjudication generally focus on the equality or adequacy of the system as a whole, rather than on any particular student's educational resources or attainment. The Article traces the roots of the currently dominant systemic approach, and finds these roots in federal institutional reform litigation. This systemic focus leads to a systemic, rather …

Does Information And Communication Technology Improve Job Satisfaction? The Moderating Role Of Sales Technology Orientation, Yam Limbu, C Jayachandran, Barry J. Babin
Department of Marketing Faculty Scholarship and Creative Works
Empirical research concerning the role of information and communication technology (ICT) in shaping business-to-business salesforce job satisfaction remains relatively scarce. The authors propose and empirically test a causal model that theoretically represents structural relationships among factors comprising ICT and eventual salesperson job satisfaction. Study results indicate that ICT indirectly influences job satisfaction through salesforce administrative performance. While ICT infrastructure, training, and support positively relate to administrative performance, none of them influence outcome performance significantly. In addition, salesperson technology orientation moderates the effect of both ICT infrastructure and support on job satisfaction. Managerial insights and implications from the research are discussed.

Investigating Transnational Collaboration Of Faculty Development And Learning: An Argument For Making Learning Culturally Relevant, Dr. Janine F. Allen
International Journal for the Scholarship of Teaching & Learning
Professional development offered to higher education faculty is meant to enhance pedagogy and improve practice. Inspired by a transnational partnership in Southeast Asia, this study aimed to discover how teacher education faculty perceived faculty development offered to them by university partnership colleagues from the United States. Survey findings indicate that certain faculty development strategies improved teaching and assessment practices and enhanced self-reflection. However, evidence also showed some negative faculty perceptions in relation to the US partner’s methodologies, and qualitative responses indicated a lack of relevancy to the Southeastern Asia context. Furthermore, negative correlations were found between faculty development workshops and …

The paper analyzes the process of global diffusion of Corporate Social Responsibility (CSR) in the oil industry and how interactions between different actors have contributed to this outcome. It starts from the empirical puzzle that CSR has spread globally among transnational corporations since the mid 1990s (diffusion of CSR as a dependent variable). To explain this phenomenon, the paper presents a theoretical argument based on insights from sociological neo-institutionalism. It uses the concept of organizational fields as social spaces where organizations interact with one another. This is chapter 6 of Challenging Boardroom Homogeneity: Corporate Law, Governance, and Diversity (Cambridge University Press, forthcoming in 2015). In this chapter I investigate the disclosure-based approach to addressing diversity in corporate governance. In 2009, the United States Securities and Exchange Commission adopted a rule requiring publicly traded firms to report on whether they consider diversity in identifying director nominees and, if so, how. The rule also requires firms that have adopted a diversity policy to describe how they implement the policy and assess its effectiveness. The rule does not define “diversity,” however, leaving it to corporations to give this …

Recent economic turbulence in the United States has resulted in budget cuts for many city-funded organizations, including high-risk organizations such as local fire departments. Budget cuts trigger organizational change and create uncertainty among employees, which is a major concern for high-risk organizations. This dissertation examined internal communication practices used during organizational change in an urban fire department and the influence of organizational structure and culture on communication satisfaction. Before moving on to my contribution about how the growing reliance on big data analytics may necessitate a slight modification to the ABA Standards on Law Enforcement Access to Third Party Records (LEATPR Standards), I would like first to pay a few compliments to the drafters of the LEATPR Standards for producing such a systematic, thoughtful, and elegant framework for considering Fourth Amendment freedoms. Using data from the 2010 National Survey of Residential Care Facilities, this study estimated the percentage of U.S. residential care communities (RCCs) offering selected medication management services (MMS) and examined differences in prevalence by community characteristics. The most common services were central storage for medications and cueing residents, while the least common were administering injections and intravenous medications. Medication reminders, helping residents take medications, and administering drops/topical ointments and injections varied by RCC characteristics. Characteristics most commonly associated with these differences are size, purposefully built status, nursing hours, and availability of a physician or pharmacist to review medication appropriateness. Authorized in 2006 by the State legislature, Minnesota’s Performance-Based Incentive Program funds nursing home–initiated quality improvement projects for 1 to 3 years through increases of up to 5 percent in the operating per diem rate charged to Medicaid and private-pay residents. Funding decisions are made through a competitive bidding process administered annually by the Department of Human Services, with recommendations from a review committee. Program staff provide support to nursing homes during and after the application process. Nursing homes that do not achieve project-specific performance targets can lose up to 20 percent of the incentive payments. The program has engaged …

This paper investigates the conditions of possibility for innovation in regulatory space. The first-time inclusion of narrative reporting on the agenda of the British Accounting Standards Board (ASB) is studied in terms of a complex web of discursive schemes, which co-constituted the regulatory issue and the context in which it emerged. It seems a self-evident truism to many that performance at school and work is determined by the extent to which one "can do" and one "will do" the task effectively. Grounded in this logic, research, practice, and textbooks in industrial-organizational psychology over the past 60 years have supported the notion that performance is a multiplicative function of ability and motivation, such that P = f(AXM) (where P = performance, A = ability, and M = motivation). Despite the scholarly interest in workplace incivility in the field of organizational behavior, public administration (PA) scholars have paid much less attention to this timely and relevant topic. We explored the relationship between Trust-Based Relational Intervention (TBRI) and treatment outcomes for adopted children participating in treatment services through the Adoption Preservation Program at a Midwest child welfare organization. Adopted children who have trauma histories may have their adoptions disrupted if they do not receive the proper therapy to improve their overall functioning (Purvis, Cross, & Pennings, 2009; Davis, 1 999). We investigated a new intervention, TBRI, and its potential impact on children with trauma histories who are receiving outpatient therapy at a local child welfare center. Librarians traditionally have insisted on designing and developing the library’s website in-house. An inhouse developed website allows librarians full control of its design, content, and delivery. Recent scholarship has documented a growing interest in teaching philanthropy at the undergraduate and graduate level. This study is an overview of the nature and extent of one approach, experiential philanthropy, in which students learn philanthropy by making grants to nonprofit organizations. The study reviewed syllabi and support material for 88 experiential philanthropy courses. The analysis identified four course models offered in a variety of academic settings. These findings suggest a broader range of course options for advancing civic engagement goals that instructors might typically consider. The central goal of this Article is to describe the burgeoning turn to new policing techniques in the business crime context and to offer some initial thoughts on the promises and limits of the approach. Part II begins by explaining the traditional or “old policing” of business crime. After implementing an initial strategy that focused on pursuing individuals, the government turned its attention to the organizations where those individuals operated. This research project explores the predominant leadership characteristics among community college presidents as measured by Bass and Avolio’s transformational leadership continuum, the degree of collective teacher efficacy among faculty, and any correlation that exists between them. The populations studied are the presidents and faculty of community colleges in Alabama. Two instruments were employed, the Multifactor Leadership Questionnaire (MLQ) developed by Bass and Avolio (1995) and Goddard’s CE-SCALE (2000, 2002), as a measure of collective teacher efficacy.
The researcher found evidence of mid-range collective efficacy scores among faculty and strong evidence of pervasive transformational leadership characteristics among college presidents. The researcher …

Cornwall Council is a new ‘unitary’ local authority which was created following the merger of six district councils and one county council on 1 April 2009. A questionnaire survey based on specific ‘dimensions’ of organisational culture was circulated to staff prior to the merger date. Overall, the results indicated a generally congruent culture characterised by a strong team spirit and commitment to the workplace. A number of differences were observed between the cultural orientations of the seven councils, but there was only weak evidence of differences between tiers of management or professional groupings. This critical analysis of the literature explores the construct of self from indigenous perspectives to increase cultural responsiveness in psychological theory, research, and practice. Mainstream psychology addresses various aspects of self, including self-esteem, authentic self, self-actualization, and true self (Elliott & Coker, 2008; Kernis, 2003; Kernis & Goldman, 2006; Maslow, 1964; Rogers, 1961), without defining self or what it means to be a human being. The purpose of this study was to develop a resource manual for teachers, educators, and community officials in the Los Angeles area to facilitate identification of an intervention program that meets their specific needs. The methodology of this project involved several steps. First, Internet research identified bully intervention programs in the Los Angeles area, who were contacted for participation in the research study. A total of seven programs were interviewed regarding program elements, including use of "effective" intervention strategies, as identified by previous research.
