If forced to be concise and pithy, what would a room full of negotiation scholars cook up? The compilation of recipes was in response to the request for each person’s own definition of negotiation effectiveness put in the form of a recipe. Not only is this interesting in terms of seeing the similarities and differences among this leading and diverse group of scholars, the exercise itself is one that can easily be replicated in negotiation or dispute resolution classes. It forces each participant to think about (a) ingredients; (b) amount of each; and (c) the order in which each skill …

Disclosing Big Data, Michael Mattioli Jan 2014

Disclosing Big Data, Michael Mattioli

Articles by Maurer Faculty

This Article reveals that the law is failing to adequately encourage producers of “big data” to disclose their most innovative work to the public. “Big data” refers to a new industrial and scientific phenomenon that holds the potential to transform diverse industries—from medicine, to energy, to online services. At the heart of this phenomenon are innovative and complex practices by which experts shape featureless digital records into valuable information products. The fact that these big data practices are unlikely to be widely disclosed to the public is worrisome for familiar reasons: the law generally prefers to induce technological disclosure in …

What Jurors Want To Know: Motivating Juror Cognition To Increase Legal Knowledge And Improve Decisionmaking, Sara Gordon Jan 2014

What Jurors Want To Know: Motivating Juror Cognition To Increase Legal Knowledge And Improve Decisionmaking, Sara Gordon

All Faculty Publications

What do jurors want to know? Jury research tells us that jurors want to understand the information they hear in a trial so they can reach the correct decision. But like all people, jurors who are asked to analyze information in a trial—even jurors who consciously want to reach a fair and accurate verdict—are unconsciously influenced by their internal goals and motivations. Some of these motives are specific to individual jurors; for instance, a potential juror with a financial interest in a case would be excluded from the jury pool. But other motivations, like the motive to understand the law …

L'Intention Mal Comprise : Les Meres Indignes De La Comtesse De Segur, Kristina Kiisk Jan 2014

L'Intention Mal Comprise : Les Meres Indignes De La Comtesse De Segur, Kristina Kiisk

Graduate Theses, Dissertations, and Problem Reports (ETD)

Sophie de Segur is a very well-known 19th century French children's author. Her books were and are still widely read and appreciated by children. However, she has been often criticized by literary scholars of the 20th and 21st century due to the fact that there is a lot of violence present in her novels. In addition, it has been suggested that her only goal was to educate and moralize her young readers. This opinion, however, reduces the multifaceted work of the comtesse to a purely didactic literature and we fail to recognize that her writing suggests a much deeper significance …

Raising Soviets On Imported Goods. Socialist Realism In Estonian Secondary Education, Helen Saask Jan 2014

Raising Soviets On Imported Goods. Socialist Realism In Estonian Secondary Education, Helen Saask

Graduate Theses, Dissertations, and Problem Reports (ETD)

This thesis examines how the political leadership of the Soviet Union tried to cultivate its desired values and principles among the people of the Estonian Soviet Socialist Republic. It illuminates one aspect of all the ideologically charged activities, and looks at Soviet Estonian schools through the lens of compulsory reading --- how were socialist realist cultural goods used to promote Sovietization in Estonian secondary schools? Moreover, the study tries to evaluate to what degree the propagandistic intention was realized in literature lessons. Emphasis lies on exploring traces of the so-called 'double-thinking,' the notion that Estonians had the tendency to separate …

The Impact Of Religion On Minority Identity And Community: A Case Study Of Russian Orthodoxy And The Russian Minority In Estonia, Elizabeth Cleary Jan 2014

The Impact Of Religion On Minority Identity And Community: A Case Study Of Russian Orthodoxy And The Russian Minority In Estonia, Elizabeth Cleary

Graduate Theses, Dissertations, and Problem Reports (ETD)

Minority groups and their integration and inclusion into the greater society are important political and sociological concerns for many states. This is especially true for the states that more recently regained their independence following the dissolution of the Soviet Union. The realm of religion has remained largely untapped as an area in which minority identity can be cultivated and expressed or used as a platform towards productively integrating or isolating minority members.;This thesis seeks to contribute to the scholarship on this underdeveloped topic of how religion, minority identity, and issues of integration intersect. Its key questions are a) whether religion …

Defeasible Reasoning And Argument-Based Systems In Medical Fields: An Informal Overview, Luca Longo, Pierpaolo Dondio Jan 2014

Defeasible Reasoning And Argument-Based Systems In Medical Fields: An Informal Overview, Luca Longo, Pierpaolo Dondio

Conference papers

The first aim of this article is to provide readers informally with the basic notions of defeasible and non-monotonic reasoning, logics borrowed from artificial intelligence. It then describes argumentation theory, a paradigm for implementing defeasible reasoning in practice as well as the common multilayer schema upon which argument-based models are usually built. The second aim is to describe the selection of argumentbased applications in the medical and health-care sectors. Finally, the paper will conclude with a summary of the features, which make defeasible reasoning and argumentation theory attractive, that emerge from the applications under review. The target reader is a …

Tracking Discourses Of Occupation And Genocide In Lithuanian Museums And Sites Of Memory, Alexander Craig Wight Jan 2014

Tracking Discourses Of Occupation And Genocide In Lithuanian Museums And Sites Of Memory, Alexander Craig Wight

Plymouth Business School Theses

Tourism visits to sites associated to varying degrees with death and dying have for some time inspired academic debate and research into what has come to be popularly described as ‘dark tourism’. Research to date has been based on the mobilisation of various social scientific methodologies to understand issues such as the motivations of visitors to consume dark tourism experiences and visitor interpretations of the various narratives that are part of the consumption experience. This thesis offers an alternative conceptual perspective for carrying out research into museums that represent genocide and occupation by presenting a discourse analysis of five Lithuanian …

Personality Trait Theory And Multitasking Performance: Implications For Ergonomic Design, Andrea D. Guastello, Stephen J. Guastello, Denise D. Guastello Jan 2014

Personality Trait Theory And Multitasking Performance: Implications For Ergonomic Design, Andrea D. Guastello, Stephen J. Guastello, Denise D. Guastello

Psychology Faculty Research and Publications

Although system designers usually minimise the role of individual differences in operation, personality variables could explain differences in multitasking performance. A concomitant theoretical issue is whether primary or surface personality traits do a better job of predicting performance than the Five-Factor Model (FFM) or global traits. A sample of 174 undergraduates completed the Sixteen Personality Factor Questionnaire (16PF), which was followed by a performance task. A computer-based task that measured simultaneous performance on an arithmetic task and a mental rotation task was used to measure multitasking performance; scores measured the percent accuracy. Primary traits for low emotional sensitivity and high …

Library As Place: Being Human In A Digital World, Amanda C.R. Clark Jan 2014

Library As Place: Being Human In A Digital World, Amanda C.R. Clark

The Christian Librarian

Despite the increasingly digital nature of information retrieval, both users and computers continue to occupy physical space, and the library – as place – offers an essential location for inspiration. In an age when one might assume that the digital negates the physical, a finite place can root the individual within space regarding both composition and information retrieval. In this seeking for the essentially human element of the physical book within space, we may also discover a need for the library as place.

Efficacy Of Cultural-Based Psychoeducational Group Therapy For Increasing Marital Satisfaction Among Latino Couples, Maria Jesus Ampuero Jan 2014

Efficacy Of Cultural-Based Psychoeducational Group Therapy For Increasing Marital Satisfaction Among Latino Couples, Maria Jesus Ampuero

Walden Dissertations and Doctoral Studies

Previous research has indicated the importance of providing marriage education to ethnic minority couples who are struggling with their marital relationships. Despite this known importance, significantly fewer resources are available for Latino couples, who have a high rate of divorce. The purpose of this quantitative, randomized, wait-list control group trial design was to determine whether Couples in Contact, a culturally-based, psychoeducational intervention group program for Latino couples, increases marital satisfaction, as measured by the Marital Satisfaction Inventory, Revised (MSI-R). This study drew on cognitive behavioral therapy applied to couples, and the supportive theories underlying family systems theory and Gottman's theory. …

Ap And Ib Instructional Practices For Students Who Demonstrate Advanced Proficiency In Spanish, Carol Mable Andersen Jan 2014

Ap And Ib Instructional Practices For Students Who Demonstrate Advanced Proficiency In Spanish, Carol Mable Andersen

Walden Dissertations and Doctoral Studies

Linguistically gifted and talented students often do not receive appropriate instruction in the classroom. Little research has been conducted about how teachers of Advanced Placement and International Baccalaureate courses provide instruction to students who demonstrate advanced proficiency in a second language. The purpose of this multiple case study was to explore how teachers of these courses provided instruction for students who demonstrate advanced proficiency in Spanish. The conceptual framework was based on Krashen's second language acquisition theory and Gardner's multiple intelligences theory. Participants included 2 teachers from 2 high schools in 1 county in a western state. Data were collected …

Students' Perceptions And Experiences Of A Diversity And Inclusion Training Program At A Community College, Norma I. Corral-Chandler

Walden Dissertations and Doctoral Studies

A community college developed a diversity and inclusion training program, Maximizing Our Strengths as an Inclusive Community (MOSAIC), to address the lack of diversity training for students and staff. However, the program had not been evaluated. The purpose of this study was to learn about students' perceptions and experiences of the MOSAIC program. Guided by theories of constructivism and components of critical race theory related to critical studies in Whiteness, social identity theory, and best practices for diversity and inclusion training, this study explored how students described the effectiveness of the program. Interview data for this responsive program evaluation using …

A Historical Analysis Of The Relationship Of Faith And Science And Its Significance Within Education, John Gerard Yegge Jan 2014

A Historical Analysis Of The Relationship Of Faith And Science And Its Significance Within Education, John Gerard Yegge

Walden Dissertations and Doctoral Studies

Science curriculum and pedagogy are at the center of a centuries-long debate concerning the appropriate relationship of faith and science. The difficulties that science educators face seem to be based in misinformation about the historical roots of this conflict. To address that conflict, the goals of this research were to separate myth from reality and to provide a necessary context to the current tensions that are disrupting science pedagogy and curriculum content within American public schools. Working within a theoretical framework of historical literacy, this qualitative, historical analysis was a comprehensive examination of the relationship of faith and science from …

School Leaders' Perceptions Of Caribbean Students' English Language Needs, Erica Pike Jan 2014

School Leaders' Perceptions Of Caribbean Students' English Language Needs, Erica Pike

Walden Dissertations and Doctoral Studies

Although British West Indian Caribbean (BWIC) immigrant students are considered to be English speaking students by U.S. public schools, many of them speak other languages. These students experience hardships and have unique remediation needs that many schools are not providing. The conceptual frameworks that guided this case study were sociocultural theory, acculturation theory, and leadership theory. These theories postulate that culture influences learning, second language acquisition is linked to adapting to a new culture, and leadership is important to implement system-wide changes. Qualitative data included interviews with 6 teachers and 3 administrators who work closely with BWIC students, New York …

The Relationship Between Social Media And Empathy, Franklin M. Collins Jan 2014

The Relationship Between Social Media And Empathy, Franklin M. Collins

College of Graduate Studies: Theses & Dissertations

The relationship between social media and empathy has not been explored extensively. Research on the expression of emotion and the association with empathy displayed on social media websites have been minimally explored. This study sought to support findings that chatting online leads to expressions of empathy (Rosen, 2012) and a positive relationship exists between conversing with others online and empathic expression (Ivcevic & Ambady, 2012. Empathic concern was hypothesized to show a positive relationship with one’s likelihood to chat, time on Facebook, and emotional connection to Facebook or Facebook usage. Empathic concern also was predicted to be greater among computer …

The purpose of this study was to determine whether a relationship exists between the humor style and the perceived effectiveness of school principals, the leadership style and the perceived effectiveness of school principal, as well as possible relationships between and …

Embracing A Diverse Curriculum In University Teacher Preparation Programs, Stascia R. Hardy Jan 2014

Embracing A Diverse Curriculum In University Teacher Preparation Programs, Stascia R. Hardy

College of Graduate Studies: Theses & Dissertations

Student diversity in public schools has escalated dramatically, and it is a reality that must be accepted by university teacher preparation programs. Teacher candidates need to be taught the necessary skills to successfully teach diverse student populations. Children come from many different cultures and backgrounds and pre-service teachers must be equipped to effectively teach them all. Culturally relevant teacher preparation programs are crucial to preparing teachers to teach across diverse boundaries and have culturally responsive classrooms. Teacher education programs must recognize the necessity to provide learning experiences for pre-service teachers to receive different perspectives of diversity. Demographic differences between teachers …

Anna Parnell and others galvanized women in both Ireland and the United States over land reform issues. This paper examines the evidence of the Ladies’ Land League actions in the historic Georgia newspapers in an effort to better understand the roles of print capitalism and the development of Southern Irish-American identity.

The edTPA is a performance-based assessment that aims to measure teacher candidates’ readiness for teaching. Beginning in the fall of 2015, this assessment will be a mandatory requirement for those seeking certification in Georgia. General agreement exists in the field of education about the basic knowledge and skills essential for beginning teachers to demonstrate in classroom teaching. Does edTPA measure the knowledge and skills essential for beginning mathematics teachers in particular? Assuming that edTPA can successfully measure that knowledge and skills for beginning teachers, the use of the assessment could be valuable.

One of the critical components of edTPA is …

A Wrong Turn In History: Re-Understanding The Exclusionary Rule Against Prior Negotiations In Contractual Interpretation, Yihan Goh Jan 2014

A Wrong Turn In History: Re-Understanding The Exclusionary Rule Against Prior Negotiations In Contractual Interpretation, Yihan Goh

Research Collection Yong Pung How School Of Law

A reason justifying the exclusionary rule against prior negotiations in the interpretation of contracts is its longevity. Yet, the authorities commonly cited in support of the exclusionary rule are mostly traceable to Lord Wilberforce’s speech in the relatively recent case of Prenn v Simmonds. This article suggests that the law took a wrong turn in that case and caused later courts to support the exclusionary rule by recourse to policy-oriented justifications, instead of principle-based ones. The emphasis on policy-oriented justifications, and the recantation of Prenn v Simmonds as reason enough for the exclusionary rule, support an independent rule against prior …
