This paper describes discipline-specific transition support utilised to follow-up the Post-Entry Language Assessment (PELA) recently introduced at Edith Cowan University as one strategy to address declining rates of English language proficiency. Transition support was embedded within a first year core unit and emphasis was placed on assisting students to develop spoken and written communicative competencies by scaffolding assessment tasks and providing other academic supports that used contextualised examples. While general satisfaction with the academic support offered during the course was high, the program achieved limited success in encouraging at-risk students to seek support. Apprenticing children into discourses necessary for success at school begins at a very early age. In this paper I look at five-years-olds being introduced to Science and Technology while at the same time being involved in talk around literacy. The various adults who surround the children engage differentially in talk and action while merging the discourses of literacy and science. The Australian Respiratory Early Surveillance Team for Cystic Fibrosis (AREST-CF) conducts an early surveillance program (ESP) for children with cystic fibrosis (CF). The program has the potential to modify long term health outcomes for children through early detection of lung disease, long before signs and symptoms are apparent. The program is aimed specifically at infants and preschool children (~3 months to 6 years) who undergo annual, detailed and relatively invasive surveillance. The human capacity to marginalise and discriminate against others on the basis of innate and constructed characteristics is evident from the long history of discrimination against people whose existence is ‘illegitimate’, defined as being outside the law. What is inside or outside the law depends upon the context under consideration. For example, in societies such as ancient Greece and the antebellum United States, where slavery was legal, people who were constructed as ‘slaves’ could legitimately be treated very differently from ‘citizens’: free people who benefit from a range of human rights (Northup). With the impending introduction of the Australian Curriculum in the arts, there is cause to reflect on primary pre-service teacher education courses, and how effectively they prepare graduates to facilitate the curriculum. Reflecting on pre-service teachers’ experiences in the arts, at both entry and graduation of their degree, may afford insight into improving arts instruction in Bachelor of Education. Theory linked to visual arts’ responding outcomes, is fundamental to the visual arts curriculum in facilitating visual literacy, or students’ ability to assemble meaning from, and construct new imagery. Without visual literacy, year 11 students are limited in understanding and fully participating in our technological, image-based society. Resilience is a widely researched phenomenon, it means different things to different people and is perceived and measured according to the theoretical lens being applied. The following thesis reviews the theoretical development of resilience that has led to contemporary understandings, to establish a platform for the research topic - understanding and building resilience with Art. Narrative research methods are combined with art processes to illuminate the stories of eight culturally diverse women participating in a community based mental health art program, in Western Australia. The topic of training specifically designed for investigators of sexual offences has received little attention from academic researchers to date. Previous studies have not described training provided to police investigators of sexual offences in Australia. This thesis developed Turnley’s Framework for the Examination of Police Training in Sexual Assault Investigation, to examine and describe a Sexual Offences and Child Abuse Investigative Teams (SOCIT) Course, provided to Victorian Police from 2009 to 2011. Speech and swallowing difficulties are common sequelae for people who have suffered a stroke. Recently, there has been an increase in early discharge, community rehabilitation and the use of therapy assistants to support health professionals in stroke rehabilitation. However, the impact of these factors on communication and swallowing outcomes remains under researched. This research explored Rehabilitation in the Home (RITH) Speech Pathology (SP) services for stroke survivors with dysarthria and dysphagia. Governing By Guidance: Civil Rights Agencies And The Emergence Of Language Rights In Schools And Workplaces, Ming Hsu Chen

On the fiftieth anniversary of the Civil Rights Act of 1964, this Article asks federal civil rights laws evolved to incorporate the needs of non-English how speakers following landmark immigration reform (the 1965 Hart-Cellar Act) that led to unprecedented migration from Asia and Latin America. Based on a comparative study of the emergence of language rights in schools and work­ places from 1965 to 1980, the Article demonstrates that regulatory agencies used nonbinding guidances to interpret the undefined statutory term "national origin discrimination" during their implementation of the Civil Rights Act of 1964. Recent studies of the legislative process have questioned the rationales for many principles of statutory interpretation. One of those traditional rationales is the so-called fiction of legislative omniscience, understood to underpin many judicial approaches to statutory decisions. This Article presents the first comprehensive analysis of judicial assertions about legislative awareness and proposes a new way to understand them. The proposed perspective compares fictions of legislative omniscience with similar but more widely accepted imputations of knowledge in other areas of law; it also draws on recent findings from other disciplines regarding how we use and respond to statements about fictional states …
