Culture Wars: A Quest For Justice In Arizona, Crystal Lynne Pfeiffer
Culture Wars: A Quest For Justice In Arizona, Crystal Lynne Pfeiffer
Master's Theses
The Southwest is the location of an ongoing culture clash between proponents of a unified "American" culture and Mexican-American culture. The significance of the debate is not just about Mexican-American studies; it reflects a broader debate about individual and collective identity in the United States. The two cultures have historically had a contentious relationship that is further intensified by their geographical proximity to one another. Some of the tensions have culminated in a conflict within the school system between supporters and opponents of Mexican-American studies. One side of the debate sees the program as a means to help students succeed …
Culture Clashes: Indigenous Populations And Globalization-The Case Of Belo Monte, Berta E. Hernández-Truyol
Culture Clashes: Indigenous Populations And Globalization-The Case Of Belo Monte, Berta E. Hernández-Truyol
UF Law Faculty Publications
There exists a significant schism between the world of indigenous persons and the process of globalization. To resolve conflicts at the intersection of these divergent worlds, it is imperative to develop a paradigm that recognizes the trade and human rights discourses are intertwined parts of the larger legal and human universe. Such a framework will enable a bridge between the spheres that will benefit humanity so the world will be not only a richer place, but also a better place.

Borrowing By Any Other Name: Why Presidential "Spending Cuts" Would Still Exceed The Debt Ceiling, Neil H. Buchanan, Michael C. Dorf
UF Law Faculty Publications
On three occasions since mid-2011, the United States has come perilously close to exhausting its borrowing authority under a statutory limit commonly called the "debt ceiling." In prior work, the current authors argued that, in the event that the debt ceiling is reached, the President will face a "trilemma" in which any realistic action he takes — defaulting on government obligations, raising taxes, or issuing debt in excess of the statutory ceiling — would unconstitutionally usurp legislative power. We argued that in such circumstances, violating the debt ceiling would be the "least unconstitutional option." Nonetheless, most pundits and politicians, including …

History In Law, Mythmaking, And Constitutional Legitimacy - Symposium: History And Meaning Of The Constitution, Patrick J. Charles
History In Law, Mythmaking, And Constitutional Legitimacy - Symposium: History And Meaning Of The Constitution, Patrick J. Charles
Cleveland State Law Review
What truly separates an historical inquiry, however, from an originalist inquiry is the degree by which myth consumes fact. Certainly, regardless of whether one is performing an historical or originalist inquiry, the methodological process takes part in generating myth. In terms of where the respective inquiries are to be placed on the spectrum of constitutional mythmaking, however, the standard historical inquiry is far less likely to engage in the process than its originalist counterpart. This is mainly because originalism is not so much about reasoning from known historical truths, but instead about recreating a hypothetical expected legal application of how …
The Abd Of Orthography Testing: Practical Guidelines, Elke Karan
The Abd Of Orthography Testing: Practical Guidelines, Elke Karan
Work Papers of the Summer Institute of Linguistics, University of North Dakota Session
Developing an orthography for a previously unwritten language may prove to be more of a challenge than anticipated. Orthography testing can help field workers and the speech community identify issues which warrant special attention. Subsequent testing will reveal whether or not various factors have been taken into consideration and challenges overcome. Findings might indicate that the orthography functions well or that it requires additional thought, revision, and /or additional testing.
Few how-to helps on orthography testing exist. Drawing from various resources, the author provides practical guidelines and resources for field workers who are planning to engage in orthography testing activities.

Structures And Strategies For Science Teacher Education In The 21st Century, Douglas Larkin
Department of Teaching and Learning Scholarship and Creative Works
In order to determine the ways in which teacher preparation programs will need to change in order to meet the needs of preparing STEM teachers in the near future, it is necessary to ascertain what STEM teacher preparation programs are actually doing in the present. This article presents a comparative analysis of six different science teacher education pathways in order to portray, compare, and contrast the structures and strategies used by each. The central premise is that there is much to learn from what is already being done in this field from the different visions of science teacher education currently …
Defining A Vessel In Admiralty: I Know It When I See It, Daniel Faessler
Defining A Vessel In Admiralty: I Know It When I See It, Daniel Faessler
St. Thomas Law Review
Defining the term "vessel," while seemingly inconsequential at first blush, is an essential preliminary inquiry in almost any maritime law dispute. In Lozman v. City of Riviera Beach, Florida. the Supreme Court's latest pronouncement on what it means to be a vessel, the Court inserts a "reasonable observer" standard and a "designed to a practical degree" element into the vessel inquiry, which may upset long-settled law in admiralty. Part I explains through various examples why status as a vessel is important in admiralty jurisdiction. Part II discusses the Supreme Court's latest cases defining a vessel including Stewart v. Dutra Construction …

What Is In A Percentage?: Calculation As The Poetic Translation Of Human Rights, Andrea Ballestero
Indiana Journal of Global Legal Studies
Increasingly, the efficacy of human rights, international norms, and commercial standards is deposited in numbers as measures of social and financial value. Taking the form of indicators, goals, and targets, these numbers are active participants in the everyday practices through which the law is constituted around the world. This paper examines the normative ability of percentages as numeric devices that transform measures of value across legal domains. The paper draws on two examples: a) the generation of indicators by NGOs promoting the Human Right to Water, and b) the technical work of regulators attempting to regulate water prices to follow …
Lost Without Translation?: Cross-Referencing And A New Global Community Of Courts, Antje Wiener, Philip Liste
Lost Without Translation?: Cross-Referencing And A New Global Community Of Courts, Antje Wiener, Philip Liste
Indiana Journal of Global Legal Studies
Anne-Marie Slaughter has described the "new world order" as characterized by some "conceptual shifts," including an increasing cooperation of domestic courts across nation-state boundaries. The cross-jurisdictional referencing of legal norms and decisions, as Slaughter holds, would lead into a "global community of courts." This article takes issue with that observation. We argue that for such a community to emerge, cross-referencing would need to be followed by an effective transmission of meaning from one (legal) context to another. Following recent insights in the field of International Relations norm research, however, we can expect such meanings to be contested-in particular, when different …

An Information Security Control Assessment Methodology For Organizations, Angel Rafael Otero
CCAC Theses and Dissertations
In an era where use and dependence of information systems is significantly high, the threat of incidents related to information security that could jeopardize the information held by organizations is more and more serious. Alarming facts within the literature point to inadequacies in information security practices, particularly the evaluation of information security controls in organizations. Research efforts have resulted in various methodologies developed to deal with the information security controls assessment problem. A closer look at these traditional methodologies highlights various weaknesses that can prevent an effective information security controls assessment in organizations. This dissertation develops a methodology that addresses …

La Educación Como Camino Hacia La Revitalización De Lenguas Indígenas: Problemas Y Prospectivas, Isabella Hendry
Scripps Senior Theses
Many indigenous languages have suffered irreparable damage or even extinction due to the violence of colonization and the violences that continue to be perpetrated by its successor institutions of neo-liberalism and global “development” projects. This thesis focuses on the attempts of two groups of indigenous people, the Imazighen (or Berbers) of Algeria and Morocco and the Runa (or Quechua) of Peru and Bolivia, to break these cycles of repression and revitalize their languages. A close comparison of these two groups’ struggles reveals the difficulty of transcending this assimilationist, imperialist framework, but it also highlights several successes that bode well for …

Trans Enough : Trans/Gender Identities And (Mis)Representation In Social Work, Christopher C. Hamann
Theses, Dissertations, and Projects
This study critically examines the current discourse in social work on transgender individuals in an attempt to be a starting point for those seeking to gain a better understanding of the ways in which the profession has conceptualized and served this population over the last 25 years. Queer theory and critical discourse analysis were used to analyze a final sample of 30 social work articles that focus on the transgender subject. Analytical focus was aimed at the production and reproduction of social norms, particularly those that function through heteronormativity, as well as forces of power operating within the discourse. Through …
Structural Racism, Institutional Agency, And Disrespect, Andrew J. Pierce
Structural Racism, Institutional Agency, And Disrespect, Andrew J. Pierce
Philosophy, Theology and Religious Studies Faculty Publications
In recent work, Joshua Glasgow has offered a definition of racism that is supposed to put to rest the debates between cognitive, behavioral, attitudinal, and institutionalist definitions. The key to such a definition, he argues, is the idea of disrespect. He claims: "φ is racist if and only if φ is disrespectful toward members of racialized group R as Rs." While this definition may capture an important commonality among cognitive, behavioral, and attitudinal accounts of racism, I argue that his attempt to expand the definition to cover institutional or "structural" racism is less persuasive. Alternatively, I argue that structural racism …

Imagine that a group of activist American journalists and lawyers launch a new Internet site called "AmeriLeaks." The site is incorporated as a nonprofit organization with its principal place of business in Washington, D.C. The announced purpose of the site is to provide an American alternative to the WikiLeaks site led by Julian Assange. AmeriLeaks encourages whistleblowers across the United States to post documents on the site exposing corruption and crime in government, with an emphasis on American foreign policy and national security issues. Technical And Structural Experimentation In Dave Eggers' A Heartbreaking Work Of Staggering Genius And Jonathan Safran Foer's Extremely Loud And Incredibly Close, Samantha Branin
Theses, Dissertations and Culminating Projects
This thesis discusses the experimental writing techniques of two contemporary American authors, Dave Eggers and Jonathan Safran Foer, in their works A Heartbreaking Work o f Staggering Genius and Extremely Loud and Incredibly Close, respectively. These authors’ narrative experiments are examined and contextualized through the lens of trauma theory, a practice of literary analysis that relies upon studies of the effects of trauma, most specifically the symptoms of post-traumatic stress disorder. Branin posits that Eggers’ and Foer’s experimental narrative choices—e.g. shifts in form and narrator, the use of circuitous and non-chronological narratives, typographical experiments, and the use of images instead …

An Examination Of Narrative And Thematic Devices In Virginia Woolf's To The Lighthouse And Mrs. Dalloway, Mary Houghtaling
Theses, Dissertations and Culminating Projects
The purpose of this master’s thesis is to examine the narrative and thematic devices Virginia Woolf employs in her two novels, To the Lighthouse and Mrs. Dalloway and how her techniques impact the way in which the readers view the characters and their relationships. Her use of narrator and themes in both novels helps develop more complex characters, making them more relatable and their situations examples that readers can use in life outside the novels. This thesis looks directly at her use of language and character development in order to examine how she achieves success in her novels.

How The Meaning Of Incorporation Over Time Lends Support For Corporate Free Exercise Rights, Emily C. Cook
Georgia Law Review
Incorporated churches, mosques, synagogues, and the like enjoy the same protection as individuals under the Free Exercise Clause of the First Amendment. What about corporationsthat strive to follow religiousprinciples while earning profits? Do these corporations possess free exercise rights? This question has surfaced in response to a provision in the Affordable Care Act requiring employment- based group health plans to provide health insurance coverage for certain FDA-approved contraceptive methods. Numerous for-profit corporations that adhere to religious faiths that consider these contraceptive methods sinful have challenged the ACA provision as an undue burden on their free exercise because it forces them …

The Future Of Law School: Three Visions And A Prediction, Harry W. Arthurs
The Future Of Law School: Three Visions And A Prediction, Harry W. Arthurs
Articles & Book Chapters
In this article, the author examines three visions of the future of law schools. The first vision is that they should focus on producing “practice ready lawyers” to meet the immediate needs of today’s legal profession. The second is that law schools should focus on training “tomorrow’s lawyers,” graduates who are able to adapt to a rapidly-changing world. The third insists that law schools are knowledge communities whose many functions include, but are not limited to, providing students with a large and liberal understanding of law that will prepare them for a variety of legal and non-legal careers and for …
