The Improbability Of Positivism, Andrew Tutt Sep 2014

The Improbability Of Positivism, Andrew Tutt

Pace Law Review

Ronald Dworkin’s contributions to legal philosophy have been subject to severe criticism in recent years. Other legal philosophers call his arguments “deflected or discredited,” laced with “philosophical confusions,” and “deeply embedded” mistakes. As Brian Leiter writes, “[t]he only good news in the story about Dworkin’s impact on law and philosophy is that most of the field declined to follow the Dworkinian path . . . .”

This Article endeavors to show that, far from an effort beset with primitive errors, Dworkin’s challenge to legal positivism in the opening pages of his seminal work was neither misguided nor trivial. Rather, Dworkin’s …

A Research Framework For The Impact Of Cultural Differences On It Outsourcing, Anil Gurung, Edmund Pratter Sep 2014

A Research Framework For The Impact Of Cultural Differences On It Outsourcing, Anil Gurung, Edmund Pratter

Management Information Systems Faculty Research

Contracting Global Virtual Teams as part of global IT outsourcing is currently en vogue. As might be expected when virtual team members are from different countries, cultural factors play an important role in the success of outsourcing. However, there have been very few studies that assess the effect of culture on IT outsourcing and virtual teams. This conceptual paper addresses this oversight by looking at the effect of cultural differences on IT outsourcing and virtual teams' performance. The applicable literature on outsourcing, virtual teams and culture is analyzed and a framework of offshore outsourcing success is developed. This framework includes …

Communications Audit In Measuring The Effectiveness Of Communication Strategies In Companies, Michał Wilczewski Sep 2014

Communications Audit In Measuring The Effectiveness Of Communication Strategies In Companies, Michał Wilczewski

Studia i Materiały Wydział Zarządzania Uniwersytet Warszawski

The article presents the role a communications audit plays in diagnosing the current efficacy of a communication policy implemented in a company. To do so, such concepts as well as their theoretical implications are explicated as: corporate communications, communication strategy, communications audit and its subjects of interest, methods and procedures recommended for conducting a communications audit, and major problems revealed in the auditing process. The right diagnosis and knowledge of existing drawbacks in company’s communication strategy is an absolute prerequisite for designing such a strategy which will be known to the employees and supported by them, so that information in …

"Del Campo Ya Pasamos A Otras Cosas--From The Field We Move On To Other Things": Ethnic Mexican Narrators And Latino Community Histories In Washington County, Oregon, Luke Sprunger

Dissertations and Theses

This work examines the histories of the Latino population of Washington County, Oregon, and explores how and why ethnic Mexican and other Latino individuals and families relocated to the county. It relies heavily on oral history interviews conducted by the author with ethnic Mexican residents, and on archival newspaper sources. Beginning with the settlement of a small number of tejano families and the formation of an ethnic community in the 1960s, a number of factors encouraged an increasing number of migrant Latino families--from tejanos to Mexican nationals to Central and South Americans to indigenous migrants of various nationalities--to settle permanently …

Regulatory Adaptations For Delivering Information: The Case Of Confession, Daniel Sznycer, Eric Schniter, John Tooby, Leda Cosmides Sep 2014

Regulatory Adaptations For Delivering Information: The Case Of Confession, Daniel Sznycer, Eric Schniter, John Tooby, Leda Cosmides

ESI Publications

Prior to, or concurrent with, the encoding of concepts into speech, the individual faces decisions about whether, what, when, how, and with whom to communicate. Compared to the existing wealth of linguistic knowledge however, we know little of the mechanisms that govern the delivery and accrual of information. Here we focus on a fundamental issue of communication: The decision whether to deliver information. Specifically, we study spontaneous confession to a victim. Given the costs of social devaluation, offenders are hypothesized to refrain from confessing unless the expected benefits of confession (e.g. enabling the victim to remedially modify their course of …

Build Emotion Lexicon From Microblogs By Combining Effects Of Seed Words And Emoticons In A Heterogeneous Graph, Kaisong Song, Shi Feng, Wei Gao, Daling Wang, Ling Chen, Chengqi Zhang Sep 2014

Build Emotion Lexicon From Microblogs By Combining Effects Of Seed Words And Emoticons In A Heterogeneous Graph, Kaisong Song, Shi Feng, Wei Gao, Daling Wang, Ling Chen, Chengqi Zhang

Research Collection School Of Computing and Information Systems

As an indispensable resource for emotion analysis, emotion lexicons have attracted increasing attention in recent years. Most existing methods focus on capturing the single emotional effect of words rather than the emotion distributions which are helpful to model multiple complex emotions in a subjective text. Meanwhile, automatic lexicon building methods are overly dependent on seed words but neglect the effect of emoticons which are natural graphical labels of fine-grained emotion. In this paper, we propose a novel emotion lexicon building framework that leverages both seed words and emoticons simultaneously to capture emotion distributions of candidate words more accurately. Our method …

Speaking Two Languages Enhances An Auditory But Not A Visual Neural Marker Of Cognitive Inhibition, Mercedes Fernandez, Juliana Acosta, Kevin Douglass, Nikita Doshi, Jaime L. Tartar Sep 2014

Speaking Two Languages Enhances An Auditory But Not A Visual Neural Marker Of Cognitive Inhibition, Mercedes Fernandez, Juliana Acosta, Kevin Douglass, Nikita Doshi, Jaime L. Tartar

Faculty Articles

The purpose of the present study was to replicate and extend our original findings of enhanced neural inhibitory control in bilinguals. We compared English monolinguals to Spanish/English bilinguals on a non-linguistic, auditory Go/NoGo task while recording event-related brain potentials. New to this study was the visual Go/NoGo task, which we included to investigate whether enhanced neural inhibition in bilinguals extends from the auditory to the visual modality. Results confirmed our original findings and revealed greater inhibition in bilinguals compared to monolinguals. As predicted, compared to monolinguals, bilinguals showed increased N2 amplitude during the auditory NoGo trials, which required inhibitory control, …

Metacognition And Decision-Making Style In Clinical Narratives, Limor Hochberg Sep 2014

Metacognition And Decision-Making Style In Clinical Narratives, Limor Hochberg

Theses

Clinical decision-making has high-stakes outcomes for both physicians and patients, yet little research has attempted to model and automatically annotate such decision-making. The dual process model (Evans, 2008) posits two types of decision-making, which may be ordered on a continuum from intuitive to analytical (Hammond, 1981). Training clinicians to recognize decision-making style and select the most appropriate mode of reasoning for a

particular context may help reduce diagnostic error (Norman, 2009).

This study makes preliminary steps towards detection of decision style, based on an annotated dataset of image-based clinical reasoning in which speech data were collected from physicians as they …

Plyler Children: 21st Century Challenges With Judicial-Policy Implementation Affecting Immigrant Children In New Jersey, Christine T. Brenner, Kirk A. Leach, David Tulloch Sep 2014

Plyler Children: 21st Century Challenges With Judicial-Policy Implementation Affecting Immigrant Children In New Jersey, Christine T. Brenner, Kirk A. Leach, David Tulloch

Journal of Public Management & Social Policy

Denying unauthorized immigrant children access to a free public education through incomplete judicial policy implementation may lead to an illiterate underclass. Communicating, implementing, and enforcing Plyler v. Doe school registration documentation requirements continue to be difficult at the district level. In 2008, an ACLU study in New Jersey found that 187 of 516 school districts were mandating inappropriate documentation from parents registering their children. Separation of powers requires that executive agencies proactively implement transformative judicial decisions.

Hla Class Ii Alleles In The Otomi Population Of The Mezquital Valley. A Genetic Approach To The History Of Interethnic Migrations In The Mexican Central Plateau, Ana Itzel Juárez-Martín, Blanca Zoila González-Sobrino, Ángel Eduardo Camarena Olvera, Ramcés Falfán-Valencia

Human Biology Open Access Pre-Prints

From a historic and genetic point of view, the Otomi of the Mezquital Valley are a frontier people that have played an important role in the making of the population dynamics of the Mexican Central Plateau. Due to their antiquity in the area, the Otomi may be bearers of ancient genetic variability, shared mainly today with other groups belonging to the Otomanguean linguistic family and with the Nahua.

This study analyzes the HLA class II allele frequencies reported in Mexican indigenous populations, in order to provide an intra-regional level historical perspective of the genetic relationships between the Otomi of the …

Continuity, Constellation, And Unworking: An Exploration Of Language In Nietzsche, Alicen L. Beheler Sep 2014

Continuity, Constellation, And Unworking: An Exploration Of Language In Nietzsche, Alicen L. Beheler

College of Liberal Arts & Social Sciences Theses and Dissertations

This project is an investigation of language in the work of Friedrich Nietzsche. The framing question is whether Nietzsche’s treatment of language as an explicit philosophical theme in published work and notes of the early 1870s is in fact only an early interest abandoned by the later work and notes in which the treatment of language as such does not assume such a central role. I suggest that if we consider language not as a unitary concept but as a constellation, a network of shifting thematic nodes, we find that language remains a chief interest throughout the Nietzschean corpus, but …

Some Aggregation Operators With Intuitionistic Trapezoid Fuzzy Linguistic Information And Their Applications To Multi-Attribute Group Decision Making, Yanbing Ju, Shanghong Yang, Aihua Wang Sep 2014

Some Aggregation Operators With Intuitionistic Trapezoid Fuzzy Linguistic Information And Their Applications To Multi-Attribute Group Decision Making, Yanbing Ju, Shanghong Yang, Aihua Wang

Applied Mathematics & Information Sciences

We study the multi-attribute group decision making (MAGDM) problems in which the attribute values provided by the decision makers take the form of intuitionistic trapezoid fuzzy linguistic (ITrFL) information considering the uncertainty and inaccuracy of input arguments. Some new aggregation operators called intuitionistic trapezoid fuzzy linguistic weighted average (ITrFLWA), intuitionistic trapezoid fuzzy linguistic ordered weighted average (ITrFLOWA) and intuitionistic trapezoid fuzzy linguistic hybrid weighted average (ITrFLHWA) operators are proposed at first. Then, we study some desirable properties of the proposed operators, such as monotonicity, idempotency, commutativity and boundedness. Next, two novel approaches based on the proposed operators are developed to …
