African-American Grandmothers Raising Grandchildren: Results Of An Intervention To Reduce Caregiver Psychological Distress, Susan J. Kelley, Peter E. Campos, Deborah M. Whitley

International Nursing Research Congress (INRC)

Session presented on Sunday, July 27, 2014:

Purpose: Globally, millions of grandmothers are assuming full-time caregiving responsibilities for grandchildren when birth parents are unable to do so. While the reasons for this caregiving arrangement vary by global region, they often include HIV/AIDS, child maltreatment, workforce migration, mental health issues, and substance abuse. The purpose of this study is to determine the results of an intervention to improve the well-being of grandmothers who are raising grandchildren in parent-absent homes. More specifically, we examine the role of a home-based, interdisciplinary intervention in reducing psychological distress in caregiving grandmothers.

Methods: The sample comprised …

Face-To-Face To Email To Helpp Zone App: Delivering Intervention In Intimate Partner Violence, Rose E. Constantino

International Nursing Research Congress (INRC)

Session presented on Thursday, July 24, 2014:

Intimate Partner Violence (IPV) is a pervasive but preventable social and public health problem but if left unresolved results in millions of injuries and more than 1000 deaths in the U. S. annually. In addition, IPV comes at an enormous cost to physical, mental, economic, and social well-being at $13.6 billion and is expected to rise to $15.6 billion by 2021. Survivors of IPV do not receive the needed intervention because they may not seek it, if they seek it, they may present a different unrelated cause of the injury. The Department of …

Patch Or Rebuild: A Comparative Analysis Of Multi-Agency Regime Vs. Single-Agency Regime Within Us Domestic Space Traffic Management Regulation, Susan L. Willshire

Space Traffic Management Conference

It has been suggested that expansion and modification of the current US regulatory regime is sufficient to regulate space traffic. It has also been suggested that a consolidation of the existing fragmented structure into a single agency would be superior. This article provides a detailed pro vs. con comparative analysis of the two approaches as they relate to civil space traffic and commerce. Expanding commercial needs place specific demands on the regulatory next steps and require thoughtful prioritization and coordination of efforts to ensure a successful future regulatory regime that addresses the competing needs of agencies and industry. The proper …

A Tiger With No Teeth: The Case For Fee Shifting In State Public Records Law, Heath Hooper, Charles N. Davis

Missouri Law Review

A federal lawsuit filed against the city of Columbia, Missouri, alleging police brutality seemed destined for headlines in 2010. At its core was an incident in which a routine traffic stop for a broken taillight erupted into a “fracas” in which police allegedly both tased and beat a man and threw a woman to the ground. A Columbia Daily Tribune reporter following the case filed a public records request for any documents concerning the incident. A police spokesperson contacted him days later to let him know the records were ready for pickup.

Chinese Law Reform: Its Recent Past And Uncertain Future, Stanley B. Lubman Nov 2014

Chinese Law Reform: Its Recent Past And Uncertain Future, Stanley B. Lubman

Hong Yen Chang Center for Chinese Legal Studies

Just as economic reforms were beginning in 19789-1979 and China’s leaders announced that China was going to create a “socialist market economy,” a prominent Chjinese economist said.

“Market economy” should be “a bird in the cage” of the socialist economy.

Today, Chinese law reform reflects a mixed picture: The cage has grown since the onset of reform, but the law is still a bird inside of it.

Delaware Law As Lingua Franca: Theory And Evidence, Brian Broughman, Jesse A. Fried, Darian Ibrahim Nov 2014

Delaware Law As Lingua Franca: Theory And Evidence, Brian Broughman, Jesse A. Fried, Darian Ibrahim

Vanderbilt Law School Faculty Publications

Why would a firm incorporate in Delaware rather than in its home state? Prior explanations have focused on the inherent features of Delaware corporate law, as well as the positive network externalities created by so many other firms domiciling in Delaware. We offer an additional explanation: a firm may choose Delaware simply because its law is nationally known and thus can serve as a “lingua franca” for in-state and out-of-state investors. Analyzing the incorporation decisions of 1,850 VC-backed startups, we find evidence consistent with this lingua-franca explanation. Indeed, the lingua-franca effect appears to be more important than other factors that …

Rights Speech, Timothy Zick Nov 2014

Rights Speech, Timothy Zick

Faculty Publications

Freedom of expression has a complex and dynamic relationship with a number of other constitutional rights, including abortion, the right to bear arms, equal protection, the franchise, and religious liberty. This Article discusses one aspect of that relationship. It critically analyzes the regulation of "rights speech" - communications about or concerning the recognition, scope, or exercise of constitutional rights. As illustrative examples, the Article focuses on regulation of speech about abortion and the Second Amendment right to bear arms. Governments frequently manage, structure, and limit how individuals discuss constitutional rights. For example, laws and regulations compel physicians to convey information …

Speedy Trial As A Viable Challenge To Chronic Underfunding In Indigent-Defense Systems, Emily Rose Nov 2014

Speedy Trial As A Viable Challenge To Chronic Underfunding In Indigent-Defense Systems, Emily Rose

Michigan Law Review

Across the country, underresourced indigent-defense systems create delays in taking cases to trial at both the state and federal levels. Attempts to increase funding for indigent defense by bringing ineffective assistance of counsel claims have been thwarted by high procedural and substantive hurdles, and consequently these attempts have failed to bring significant change. This Note argues that, because ineffective assistance of counsel litigation is most likely a dead end for system-wide reform, indigent defenders should challenge the constitutionality of underfunding based on the Sixth Amendment guarantee of speedy trial. Existing speedy trial jurisprudence suggests that the overworking and furloughing of …

Coercing Justice? Exploring The "Aspirations And Practice" Of Law As A Tool In Struggles Against Social Inequalities, Karen Schucher Oct 2014

Coercing Justice? Exploring The "Aspirations And Practice" Of Law As A Tool In Struggles Against Social Inequalities, Karen Schucher

PhD Dissertations

This dissertation examines the role of law as a tool in struggles against social inequalities, by tracing the history of Ontario’s human rights legislation and enforcement from the enactment of fair practices statutes in the 1950s through the restructuring of the enforcement regime in 2006. Ontario was the first Canadian province to pass anti-discrimination legislation and to establish a human rights commission enforcement process. This legislation and the commission enforcement process were the models for all other Canadian jurisdictions.

The dissertation approaches the role of law through the framework of tensions between the “aspirations” and the “practices” of law. On …
