Advantages Of The One-Client Model In Insurance Defense, Jean Fleming Powers
New Mexico Law Review
This article explores the debate first by describing the one-client and two-client models that are at the heart of the disagreement, and second, by looking at the relationships and obligations that create conflicts and concerns. It explains how the one-client model is consistent with the obligations undertaken in the contract of insurance, better fosters the attorney’s professional obligations, better protects the insured as a consumer of insurance and of legal services, and ultimately better protects the interests of the insurer and the attorney. Toward A Patent Exhaustion Regime For Sustainable Development, 32 Berkeley J. Int'l Law. 330 (2014), Benjamin Liu

This Article argues that the current exhaustion doctrine, when applied to the refurbishing industry, fails to balance its mandate of promoting technological progress with the broader program of sustainable development and is therefore unsuitable for countries on the modernization path. First, what constitutes an infringing “making” remains underdetermined. Second, the evidentiary hurdle for proving legal refurbishment is too onerous for the low margin and under-resourced refurbishing industry. Finally, the all-or-nothing approach to judging infringement fails to account for the nuanced cost-benefit nexus that exists between patentees, refurbishers, and society at large and discourages private ordering. Due to great effort from mathematicians, physicists and computer scientists, network science has attained rapid development during the past decades. However, because of the complexity, most researches in this area are conducted only based upon experiments and simulations, it is critical to do research based on theoretical results so as to gain more insight on how the structure of a network affects the security. This dissertation introduces some stochastic and statistical models on certain networks and uses a k-out-of-n tolerant structure to characterize both logically and physically the behavior of nodes. Higher education institutions commonly play a role in community development. Rural communities may be even more dependent on the university's investment. As higher education has looked to meet demands of stakeholders calling for greater accountability, it has become necessary for universities to be able to justify the effectiveness of these efforts. The purpose of this study was to determine the elements necessary for successful rural community development in Western Oklahoma. Utilizing the Delphi research method, 20 community development experts in rural Western Oklahoma participated in the three-round survey process. Although the realm of political theory has often focused on what makes an individual happy, there is a lack of analysis on what factors within a career environment best serve to increase an individual’s satisfaction. By comparing indicators such as the region a workplace is located in, the ability of an individual to pursue career goals and the amount of autonomy an employee is allowed, a better understanding can be made on what conditions are optimal for satisfaction in the workplace. Under most standard insurance policies, an insurer has a duty to defend its policyholder in the event a third party brings a claim against that policyholder. To fulfill this duty, an insurer may either retain a private attorney or use its own staff attorney to represent the policyholder. Choosing the latter option has become common practice throughout the country, and with that decision comes certain challenges. First, critics argue that the use of staff counsel by an insurance company constitutes the unauthorized practice of law by the insurer. Intimate partner violence (IPV) against women has been recognized as a serious issue which requires attention. Over the past 40 years there has been an increase in sensitivity to female victims of intimate partner violence, but the same has not been true for male victims. This may be attributed to the substantial influence the feminist perspective has had upon the development of the IPV resource system. Furthermore, certain research indicates IPV resource centers may refuse to help or demean men who seek assistance as victims (Hines, Brown, & Dunning, 2007).

Fate Control And Human Rights: The Policies And Practices Of Local Governance In America's Arctic, Mara Kimmel

The loss of territoriality over lands conveyed under the Alaska Native Claims Settlement Act had adverse impacts for Alaskan tribal governance. Despite policy frameworks that emphasize the value of local governance at an international, regional, and statewide level, Alaskan tribes face unique obstacles to exercising their authority, with consequences for both human development and human rights. This Article examines how territoriality was lost and analyzes the four major effects of this loss on tribal governance. It then describes two distinct but complimentary strategies to rebuilding tribal governance authority that rely on both territorial and non-territorial authority.

This Comment contends that the Ninth Circuit’s opinion in Pimentel v. Dreyfus employed a legal formalist approach and that by applying this framework, the court prevented legal immigrants, who were caught between the strict eligibility restrictions of welfare reform, from asserting their rights through the justice system. The legal formalist approach “treats the law as a set of scientific formulae or principles that are derived from the study of case law. These principles create an internal analytical framework which, when applied to a set of facts, leads the decision maker, through logical deduction, to the correct outcome in a case.” …
