Retaining Color, Veronica Root Apr 2014

Retaining Color, Veronica Root

University of Michigan Journal of Law Reform

It is no secret that large law firms are struggling in their efforts to retain attorneys of color. This is despite two decades of aggressive tracking of demographic rates, mandates from clients to improve demographic diversity, and the implementation of a variety of diversity efforts within large law firms. In part, law firm retention efforts are stymied by the reality that elite, large law firms require some level of attrition to function properly under the predominant business model. This reality, however, does not explain why firms have so much difficulty retaining attorneys of color — in particular black and Hispanic …

Pro Bono Grievances, Danielle R. Cover Apr 2014

Pro Bono Grievances, Danielle R. Cover

Cardozo Public Law, Policy & Ethics Journal

Partially as a result of the 2008 economic collapse, the need for pro bono representation has increased steadily over the last five years, while simultaneously the funding for legal services programs and non-profits has decreased. The profession, as a result, has turned to pro bono as a means of addressing the expanding gaps in representation that the economic crisis has fostered. Unfortunately, there is no central authority governing how volunteer attorneys should conduct their pro bono practice. Attorneys are often not taught or exposed to the skills necessary to provide pro bono clients with high quality representation. In addition, two …

Learning By Doing: Adding A Clinical Component To A Traditional Family Law Course, Cynthia Grant Bowman Apr 2014

Learning By Doing: Adding A Clinical Component To A Traditional Family Law Course, Cynthia Grant Bowman

Cornell Law Faculty Publications

This paper describes a clinical component recently added to the course in Family Law at Cornell Law School. Students who are either co-registered for or have previously taken Family Law receive an extra two credits for clinical work under the instructor's supervision. Each student undertakes to represent at least one client, who is referred from Neighborhood Legal Services, from the initial client interview through drafting, filing and service of the many documents required to obtain a final judgment for dissolution of marriage in New York State. In order to complete this work in one semester, the students do relatively simple …

Criminal Liability Of Arbitrators In China: Analysis And Proposals For Reform, Duan Xiaosong Apr 2014

Criminal Liability Of Arbitrators In China: Analysis And Proposals For Reform, Duan Xiaosong

Washington International Law Journal

This article is prompted by a Chinese criminal provision governing the impartiality of arbitration. The goals of the article are to critically examine the criminal statute created by the provision and to put forward some proposals for reform, which can be employed to resolve the tension that exists between arbitrator impartiality and deference to arbitration. Although the provision appears to eliminate the abuse of arbitral power, it may raise more questions than it resolves. This article explores the problems and undertakes a comparative analysis of the corresponding United States provision as well as an analysis of some cultural and traditional …

Troubling Feelings: Moral Anger And Clinical Legal Education, Sarah Buhler Apr 2014

Troubling Feelings: Moral Anger And Clinical Legal Education, Sarah Buhler

Dalhousie Law Journal

Many law students experience strong and sometimes difficult emotions during their time in clinical lawprograms: sadness at clients'stories of trauma, excitement about a victory in court, or anger at the injustices faced by clients. In this article, I focus on the emotion of "moral anger,"or "moral outrage" experienced by lawyers and students in clinicalcontexts, and consider how educators and students might address manifestations of moral anger in clinical law contexts in ways that ignite a critical and social-justice oriented approach to legal practice. By drawing on theoretical insights from the emerging field of critical emotion studies, I argue that a …

Starting An Adoption Agency And The Major Benefits Of Adoption, Dylan D. Lingerfelt Apr 2014

Starting An Adoption Agency And The Major Benefits Of Adoption, Dylan D. Lingerfelt

Senior Honors Theses

Adoption impacts families’ lives. There are many benefits of adoption. Some key concepts of adoption are what the process of adoption entails and the different decisions potential adoptive parents need to make when starting the process, a philosophy and mission in terms of a business entity and their importance to an adoption firm, how to start a law firm as a business within the United States, and how to adapt that business to expand to areas like South Asia. South Asian etiquette issues need to be considered and understood from a business perspective. Another area to consider when doing international …

Paternalistic Interventions In Civil Rights And Poverty Law: A Case Study Of Environmental Justice, Anthony V. Alfieri Apr 2014

Paternalistic Interventions In Civil Rights And Poverty Law: A Case Study Of Environmental Justice, Anthony V. Alfieri

Michigan Law Review

Low-income communities of color in Miami and in cities across the nation both share aspirations of equal justice and democratic participation and suffer the burdens of legal underrepresentation and political disenfranchisement. Such burdens become crippling when, as in Miami, local legal aid offices, public interest organizations, and bar associations lack the resources to provide meaningful private access to justice or to muster significant public engagement in the political process. These burdens become especially crippling when, again as in Miami, local and state governments adopt policies that engender inner-city neglect, economic displacement, and racial exclusion. In these circumstances, volunteer lawyers from …

Race And Immigration, Then And Now: How The Shift To "Worthiness" Undermines The 1965 Immigration Law's Civil Rights Goals, Elizabeth Keyes Apr 2014

Race And Immigration, Then And Now: How The Shift To "Worthiness" Undermines The 1965 Immigration Law's Civil Rights Goals, Elizabeth Keyes

All Faculty Scholarship

This essay looks at how far immigration reform has come from the explicit civil rights character of the 1965 immigration law that reshaped America. The optimism surrounding that law’s dismantling of national-origins barriers to immigration proved to be overstated in the intervening decades, as the factors determining an immigrant’s “worth and qualifications” too often became proxies for race. After briefly looking at work done by critical race theorists tracing some of ways race and immigration have long intersected in immigration legal history, the article closely examines modern-day immigration reform proposals, particularly the Senate bill that remains the most complete articulation …
