Overstepping Ethical Boundaries? Limitations On State Efforts To Provide Access To Justice In Family Courts, Jessica Dixon Weaver May 2014

Overstepping Ethical Boundaries? Limitations On State Efforts To Provide Access To Justice In Family Courts, Jessica Dixon Weaver

Fordham Law Review

Family law courts in America are overwhelmed with self-represented parties who try their best to navigate an unfamiliar territory laden with procedural and evidentiary rules. Efforts to level the playing field in these courts have resulted in state entities and judges taking on roles that previously belonged to attorneys. State supreme court judges and state agencies draft and promulgate family law forms, such as divorce pleadings and paternity acknowledgments, to provide poor citizens access to justice. While these efforts have resulted in positive outcomes for some families, reliance on the state’s imprimatur has caused significant harm to others. Upon closer …

An Exclusionary Revolution: Marginalization And Representation Of Trans Women In Print Media (1969 – 1979), Emylia N. Terry May 2014

An Exclusionary Revolution: Marginalization And Representation Of Trans Women In Print Media (1969 – 1979), Emylia N. Terry

Honors College Theses

Stonewall, the act most associated with sparking gay liberation in 1969, was preceded by several events of queer insurrection. These events, which often featured trans people of color playing central roles, are not widely known. Similarly, Stonewall itself has been mythologized in order to be palatable within mainstream society, effectively whitewashing its history. This research utilized archival investigation and discourse analysis, as well as the concepts of symbolic annihilation and trans-misogyny, in order to examine certain publications’ representations of trans women from 1969 – 1979. I found that mainstream publications such as the Chicago Daily Tribune and the Los Angeles …

Always In The Back Of Your Mind: Experiences Of Latina/O U.S. Citizens From Mixed-Immigration Status Households In Higher Education, Alicia Dominguez

Department of Educational Administration: Dissertations, Theses, and Student Research

This qualitative research explores the experiences of students who are United States citizens, first-generation students, and members of mixed-status households. The aim of the research is to understand the complex experiences of navigating higher education as a student from a mixed-status household. Through a semi-structured interview protocol interviews were conducted with six Latina/o identifying students who were first-generation students and members of mixed-status households. All participants were enrolled at a Midwestern, predominantly white institution (PWI). Through LatCrit (Bernal, 2002) and Counterstorytelling (Yosso, 2002) these students were given the space and opportunity to tell their stories and experiences as U.S. citizens …

Crowdsourcing Traffic Data For Travel Time Estimation, Chanukya Chowdary Gadde May 2014

Crowdsourcing Traffic Data For Travel Time Estimation, Chanukya Chowdary Gadde

Graduate Theses, Dissertations, and Problem Reports (ETD)

Travel time estimation is a fundamental measure used in routing and navigation applications, in particular in emerging intelligent transportation systems (ITS). For example, many users may prefer the fastest route to their destination and would rely on real-time predicted travel times. It also helps real-time traffic management and traffic light control. Accurate estimation of travel time requires collecting a lot of real-time data from road networks. This data can be collected using a wide variety of sources like inductive loop detectors, video cameras, radio frequency identification (RFID) transponders etc. But these systems include deployment of infrastructure which has some limitations …

Printing And Protestants: An Empirical Test Of The Role Of Printing In The Reformation, Jared Rubin May 2014

Printing And Protestants: An Empirical Test Of The Role Of Printing In The Reformation, Jared Rubin

Economics Faculty Articles and Research

The causes of the Protestant Reformation have long been debated. This paper seeks to revive and econometrically test the theory that the spread of the Reformation is linked to the spread of the printing press. I test this theory by analyzing data on the spread of the press and the Reformation at the city level. An econometric analysis that instruments for omitted variable bias with a city's distance from Mainz, the birthplace of printing, suggests that cities with at least one printing press by 1500 were at minimum 29 percentage points more likely to be Protestant by 1600.

The Fiduciary Standard: It's Not What It Is, But How It's Made, Measured, And Decided, Mercer Bullard Apr 2014

The Fiduciary Standard: It's Not What It Is, But How It's Made, Measured, And Decided, Mercer Bullard

St. John's Law Review

(Excerpt)

This Article addresses the SEC’s fiduciary rulemaking under Section 913 of the Dodd-Frank Act, but takes a step back from the debate to frame the discussion in a more holistic context. This author’s previous article on the fiduciary standard discussed how the implementation of a fiduciary duty is largely contextual; a variety of factors other than the scope and substance of the fiduciary duty are proximately related to achieving the social benefits that the fiduciary duty is intended to create. Achieving these benefits may depend on, among other things: (1) the limiting of “investment advice” to advice regarding securities, …

Chapter 11 Reorganization And The Fair And Equitable Standard: How The Absolute Priority Rule Applies To All Nonprofit Entities, Pamela Foohey Apr 2014

Chapter 11 Reorganization And The Fair And Equitable Standard: How The Absolute Priority Rule Applies To All Nonprofit Entities, Pamela Foohey

St. John's Law Review

(Excerpt)

The remainder of this Article proceeds in two stages. First, Parts II, III, and IV provide the background necessary to develop the theory. Part II chronicles the development of the fair and equitable standard and the absolute priority rule. This history is important to understanding the interconnectedness of the rule with the standard. Part III details the key functions of the absolute priority rule and the rule’s application to for-profit entities, with an emphasis on concerns regarding its compatibility with close corporations. This review highlights how courts’ current application of the absolute priority rule to nonprofits contravenes the rule’s …

Sex-Trafficking In Cambodia: Assessing The Role Of Ngos In Rebuilding Cambodia, Katherine M. Wood Apr 2014

Sex-Trafficking In Cambodia: Assessing The Role Of Ngos In Rebuilding Cambodia, Katherine M. Wood

Senior Honors Theses

The anti-slavery and other freedom fighting movements of the nineteenth and twentieth centuries did not abolish all forms of slavery. Many forms of modern slavery thrive in countries all across the globe. The sex trafficking trade has intensified despite the advocacy of many human rights-based groups. Southeast Asia ranks very high in terms of the source, transit, and destination of sex trafficking. In particular, human trafficking of women and girls for the purpose of forced prostitution remains an increasing problem in Cambodia. Cambodia’s cultural traditions and the breakdown of law under the Khmer Rouge and Democratic Kampuchea have contributed to …

Subprime Scriveners, Milan Markovic

Faculty Scholarship

Although mortgage-backed securities ('MBS") and other financial products that nearly caused the collapse of the global financial system could not have been issued without attorneys, the legal profession's role in the financial crisis has received relatively little scrutiny. This Article focuses on lawyers' preparation of MBS offering documents that misrepresented the lending practices of mortgage loan originators. While attorneys may not have known that many MBS would become toxic, they lacked incentives to inquire into the shoddy lending practices of prominent originators, such as Washington Mutual Bank ('WaMu"), when they and their clients were reaping considerable profits from MBS offerings. …

Vendor Firm Characteristics And Buyers' Perceptions Of Transaction Costs And Relationship Governance, Imran M. Khan Apr 2014

Vendor Firm Characteristics And Buyers' Perceptions Of Transaction Costs And Relationship Governance, Imran M. Khan

Dissertations, Theses and Capstone Projects (Full IR Collection)

The utilization of outsourced business services continues to grow as organizations focus on core competencies. Outsourced services span the gamut from financial services to information processing to engagement of third party logistic services by enterprise customers. When outsourcing business services, organizational buyers often have to select from a plethora of small, mid-sized, and large vendors that offer competing services at comparable prices. Given this choice conundrum, what factors influence buyers’ perceptions of vendors and their capacity to deliver expected value?

The current research integrates three distinct, yet related, theoretical streams including transaction cost, vendor selection, and buyer-seller relational exchange in …
