Reasonable Accommodation As Professional Responsibility, Reasonable Accommodation As Professionalism, Alex B. Long Jun 2014

Reasonable Accommodation As Professional Responsibility, Reasonable Accommodation As Professionalism, Alex B. Long

Scholarly Works

The American legal profession has been slow to remove the barriers that exclude individuals with disabilities. As a result, people with disabilities remain underrepresented in the practice of law. While the Americans with Disabilities Act prohibits employment discrimination and requires employers to provide reasonable accommodations for employees with disabilities, there remain significant barriers to employment for lawyers with disabilities. This Article argues that the legal profession should view the legal requirements of reasonable accommodation and equal employment opportunities for lawyers with disabilities as fundamental components of professional responsibility and professionalism.

Transcending Pathology, Transforming The Thinkable Transperson: Young Transpeople, The Law And Gender Self-Determination, E. L. Hunter

College of Liberal Arts & Social Sciences Theses and Dissertations

While contemporary attitudes, laws and policies in the U.S. toward lesbian, gay and bisexual people are increasingly more humane and just, transgender and gender nonconforming people continue to experience widespread structural oppression, discrimination and physical and psychological violence. Through a close analytic reading of fourteen contemporary court decisions involving young transgender and gender nonconforming people, this paper examines the seemingly neutral institutions of law and medicine and exposes how access to institutional resources hinges on a medically authorized diagnosis of Gender Identity Disorder. It explores the harm caused by this pathology, its erasure of socialization, and its normalization of gender …

Much Ado About Something: The First Amendment And Mandatory Labeling Of Genetically Engineered Foods, Stephen Tan, Brian Epley

Washington Law Review

This Article evaluates the free speech implications of laws requiring that GE foods be labeled and concludes that such regulations would meet all First Amendment requirements for compelled commercial speech. Part I traces the history of food labeling in the United States, the advent of genetic engineering, and the application of that technology in agriculture and the food industry. Part II evaluates the scope of commercial free speech and the appropriate test to be applied in determining whether a GE food labeling law would violate the First Amendment. Part III examines the impacts of an agricultural and food system increasingly …

The Two Faces Of Bribery: International Corruption Pathways Meet Conflicting Legislative Regimes, Jeffrey R. Boles Jun 2014

The Two Faces Of Bribery: International Corruption Pathways Meet Conflicting Legislative Regimes, Jeffrey R. Boles

Michigan Journal of International Law

Suppose a government agency tasks its purchasing agent with buying a set of computer servers for the agency’s use, and the agent contacts a technology company to make the purchase. After selecting the needed servers, the agent learns of the servers’ fair market value but does not negotiate with the technology company to obtain the lowest possible price. Instead, unbeknownst to the government, the agent agrees with the technology company’s sales manager to purchase the servers on behalf of the government for an amount significantly above their fair market value, and, in return, the company agrees to give the agent …

In Defense Of Disparate Impact: Urban Redevelopment And The Supreme Court’S Recent Interest In The Fair Housing Act, Valerie Schneider Jun 2014

In Defense Of Disparate Impact: Urban Redevelopment And The Supreme Court’S Recent Interest In The Fair Housing Act, Valerie Schneider

Missouri Law Review

Twice in the past three years, the Supreme Court has granted certiorari in Fair Housing cases, and, each time, under pressure from civil rights leaders who feared that the Supreme Court might narrow current Fair Housing Act jurisprudence, the cases settled just weeks before oral argument. Settlements after the Supreme Court grants certiorari are extremely rare, and, in these cases, the settlements reflect a substantial fear among civil rights advocates that the Supreme Court’s recent decisions in cases such as Shelby County v. Holder and Fisher v. University of Texas are working to dismantle many of the protections of the …

Nuisance Suits, William Hubbard Jun 2014

Nuisance Suits, William Hubbard

Public Law and Legal Theory Working Papers

This paper develops a simple but general model of negative-expected-value (NEV) suit and settlement given symmetric information. It accounts for the roles of the merits, litigation costs, and bargaining power; incorporates complaints and answers for which parties' investments in pleading detail are endogenously determined; permits strategic default by the defendant; and nests several existing models of NEV litigation as special cases. It generates testable, counterintuitive, empirical predictions and facilitates normative analysis. For example, the model predicts that plausibility pleading standards will have modest effects in deterring low-merit suits but may be harmful to plaintiffs and defendants settling stronger cases.

Foreigners In Burma: A Framework For Responsible Investment, Rachel E. Ryon Jun 2014

Foreigners In Burma: A Framework For Responsible Investment, Rachel E. Ryon

Washington International Law Journal

Burma is hailed as a great democratic success story: a once-rogue nation holding elections, releasing political prisoners, and promising human rights reforms. The people elected to Parliament Aung San Suu Kyi, the leader of the democratic movement who was under house arrest for more than twenty years. The world responded with applause and open pocketbooks. In April of 2012, Ban Ki-moon, Secretary General of the United Nations, asked members to lift their sanctions on the formerly “rogue” nation and begin investing. But for a resource-rich country with a long track record of corruption, this flood of foreign investment will likely …

The Reality Of Refugee Rights In Africa: How To Implement The Right To Work In An Era Of Refugee Camps, Nezia Munezero-Kubwayo

Theses and Dissertations

The importance of one’s ability to pursue fulfilling employment is undeniable. People all over the world spend most of their days at work in various fields in order to find or maintain a fulfilling life. They imagine a stable future in which their children and communities will benefit from their hard work. Unfortunately, this hope is often not practical for people who flee persecution and war and become refugees in other countries. With over 45 million refugees in the world, it is critical to evaluate existing systems that either provide or prevent refugees from accessible gainful employment in their host …

Are Non-Profit Immigration Organizations Ready For A Comprehensive Immigration Reform?, Sandra Lizeth Molina, Deserae Leanna Quezada

Electronic Theses, Projects, and Dissertations

The purpose of this study was to explore whether non-profit immigration organizations are ready for a comprehensive immigration reform. Social workers need to recognize that a lack of readiness among non-profit immigration organizations for a comprehensive immigration reform will lead to a lack of required services for undocumented populations. The sample consisted of twelve religious and non-religiously affiliated non-profit immigration organizations. A qualitative research method was used to analyze the data.

The results of the study concluded that non-profit immigration organizations are not ready for a CIR. Although the organizations are not ready, several factors were found to affect their …

Chronically Homeless: Service Needs, Patricia Carole Beamer Ms, Sharon Ella Hodges Ms

Electronic Theses, Projects, and Dissertations

The purpose of this study was to determine the service needs being met and the needs not being met as perceived by the chronically homeless who call the park their home. The authors thought this an important study to examine to better understand the service needs of the homeless. The study used a qualitative design for collecting data which involved face-to-face interviews with ten of the homeless people at the park. Four primary themes, three of which had two subthemes each, were identified through a thematic analysis. The primary theme of mistrust of services had subthemes of safety and restrictions …

Geographies Of Containment: Logics Of Enclosure In Aboriginal And Asylum Seeker Policies In Australia's Northern Territory, Kate Shipley Coddington May 2014

Geographies Of Containment: Logics Of Enclosure In Aboriginal And Asylum Seeker Policies In Australia's Northern Territory, Kate Shipley Coddington

Dissertations - ALL

In this dissertation, I explore how logics of enclosure underscore policies about national identity, citizenship, and belonging in Australia. Darwin, the capital of Australia's Northern Territory, has become a central place for policy struggles over migration and Aboriginal communities over the past ten years. The city offers a lens through which to read geopolitical processes of migration and detention, sovereignty and citizenship, and settler colonialism and consider their consequences for people's everyday lives. Asylum seekers in Australia face policies of mandatory detention while they wait and hope for refugee status, and Darwin's many immigration detention centers have earned it the …

The State Of Aftercare: A Critical Look At The Response To Victims Of Human Sex Trafficking In The United States, Richelle Ashley Mcghee Long

Electronic Theses and Dissertations Archive

This study explored the services available to survivors of sex trafficking in the United States. Thirty organizations completed an online survey addressing the needs of the survivors who accessed their services, and how they addressed survivors' psychological, sexual, substance abuse, legal, educational and vocational, spiritual, and physical needs. The findings provided descriptions of the complex needs of trafficking survivors when they seek help, and the types and forms of services available to address those needs. Results showed how few programs are providing direct services and highlighted the challenge for survivors to get their needs met if they are in an …
