Am I My Brother’S Keeper? A Tax Law Perspective On The Challenge Of Balancing Gatekeeping Obligations And Zealous Advocacy In The Legal Profession, Richard L. Lavoie

In recent years the question of whether lawyers have a general ethical obligation to serve a gatekeeping function has been raised in a number of legal contexts. The reaction of the practicing bar generally has been unenthusiastic. While asserting that a gatekeeping function should be generally applicable to all attorneys is a relatively recent stance, such an obligation historically has been acknowledged to various degrees in several specific practice areas, including particularly in the field of federal income taxation. Effects Of Intimate Partner Violence On Maternal Reflective Functioning And Attachment Relationship In Hispanic/Latina Women And Their Preschool-Age Children: A Qualitative Study, Patricia Martinez Burr

Research indicates that thousands of women across the world suffer intimate partner violence (IPV) under the hands of their partner on a daily basis. Understanding the effects of intimate partner violence on their psychological functioning and maternal response to very young children is crucial to our understanding and provision of appropriate treatment. This qualitative study used a transcendental phenomenological approach designed to analyze the in-depth interview responses of ten Hispanic/Latina mothers of preschool-age children, who had been victims of IPV within the last year to examine these effects. This article challenges the legal profession's foundational assumption that legal services must be delivered in an adversarial posture, with lawyers compelled to engage in robust partisan advocacy on behalf of their clients' individualized interests. This narrow conception of the lawyer's role is particularly inapt in family law because many divorcing spouses actually seek joint counsel, understanding that they have profound shared interests in minimizing transaction costs, maximizing the value of the marital estate, and reducing the hostility and animosity that are so harmful to children. Couples who wish to advance these interests by retaining joint counsel are poorly served by …

Delaware Public Benefit Corporations 90 Days Out: Who's Opting In?, Alicia E. Plerhoples

The Delaware legislature recently shocked the sustainable business and social enterprise sector. On August 1, 2013, amendments to the Delaware General Corporation Law became effective, allowing entities to incorporate as a public benefit corporation, a new hybrid corporate form that requires managers to balance shareholders’ financial interests with the besat interests of stakeholders materially affected by the corporation’s conduct, and produce a public benefit. For a state that has long ruled U.S. corporate law and whose judiciary has frequently invoked shareholder primacy, the adoption of the public benefit corporation form has been hailed as a victory by sustainable business and …

Farm Bill Trends And Food Insecurity: Impacts On Rural And Urban Communities, Adell Brown Jr., Susan E. Nelson
Professional Agricultural Workers Journal
With the constraints in federal budgeting requiring the shrinkage of federal programs, programs outlined in the 2014 Farm Bill are significantly impacted, showing a thirteen year trend toward funding reduction. This paper examines historical Farm Bill programs, including crop subsidies and the nutritional assistance programs and how these programs historically addressed food insecurity versus how they are impacted by today’s budgetary constraints. The paper also examines new models for addressing food insecurity and how communities are pulling together resources to address food insecurity. In discussing the new models, the paper focuses on policy trends and funding structures; for example community …
