Before he redefined antitrust, Judge Robert Bork took aim at the First Amendment. Though his work in this area was not nearly as influential, it received substantial attention, particularly after President Ronald Reagan nominated Judge Bork to replace Justice Lewis Powell on the Supreme Court in 1987. Judge Bork's 1971 article, Neutral Principles and Some First Amendment Problems challenged the prevailing wisdom on the proper scope of First Amendment protections. In this article, published seven years before The Antitrust Paradox, Bork maintained that only "explicitly political" speech warranted constitutional protection. States And Status: A Study Of Geographical Disparities For Immigrant Youth, Laila Hlass

This article looks at the legal and practical challenges arising out of a particular immigration protection for abandoned, abused, and neglected child migrants called “Special Immigrant Juvenile Status” (SIJS). This benefit, which is a pathway to legal permanent residence and citizenship, is the only area within federal immigration law that requires a state court to take action in order for immigration authorities to consider an individual’s eligibility for relief. Using an original data set of roughly 12,000 SIJS applications from the Department of Homeland Security in June 2013, this article describes trends over time and by state regarding the number …

This report describes the initial findings of an on-going evaluation of the Housing with Services project based in Portland, OR. Housing with Services was supported, in part, with funding from Oregon’s State Innovation Model (SIM) project grant from the Center for Medicare and Medicaid Innovations to Cedar Sinai Park.

Housing with Services, LLC is a collaborative model of supportive services delivered or made available to low-income residents of affordable housing. The SIM grant helped to establish the project and funded the evaluation of the program implementation and resident- and system-level outcomes.

The Application Of Gladue To Bail: Problems, Challenges, And Potential, Jillian Anne Rogin

This paper argues that the principles articulated by the Supreme Court of Canada in R. v. Gladue and re-iterated in R. v. Ipeelee are being interpreted and implemented at the bail phase in a manner that exacerbates, rather than ameliorates the systemic failures of the criminal justice system in its dealings with Aboriginal people. Aboriginal people are grossly over-represented in Canadian prisons including those being detained in remand custody. It is now settled that the principles expressed in Gladue are applicable outside of the context of sentencing and in many jurisdictions have been found to be applicable to judicial interim …

This article offers information on the history, development and significance of the adoption and implementation of the alternative dispute resolution (ADR) techniques in Nicaragua and Rwanda. The ADR system addresses the issues of women and children suffering from domestic abuse and from the repercussions of the Rwandan Genocide and helps in rebuilding and restoring traditional values of family and community in the context of human rights.

Goldberg discusses traditional law school curriculums and how the addition of ADR courses has supplemented the traditional law school curriculum in a way that helps law schools achieve educational and academic recommendations, suggested by various studies including the Carnegie Report and the Best Practices for Legal Education. The Early Resolution Program (ERP), the first program of its kind in the nation, was developed by the Alaska Court System's Family Law Self-Help Center to provide self-represented litigants in family law cases with free legal assistance and mediation to help resolve issues and reach settlements without protracted court trials. This article discusses the ERP's goals and development, describes how cases are screened and processed, and presents ERP statistics though August 2014.
