This article explores the implication of the legal monopoly that occurs through the current attorney regulation system used in most states. Through the lens of consumer protection, the author discusses how the current regulatory regime, limiting the practice of law to only those who have law licenses and law degrees, effects a landscape where many potential legal consumers' needs are not being met. First, the author provides a general discussion of consumer protection and the public interest. Despite the fact that many new lawyers are struggling today to find employment, there are a few regulators of the legal profession willing to consider how non-lawyers can help to close the gap in consumer access to legal services. One would expect strong resistance from the legal profession to any competition for legal work, particularly in these economic times. With the proliferation of opportunities for consumers to review a variety of services on the Internet, it is probably only a matter of time until more clients review their attorneys’ services on the Internet. This raises a variety of potential ethical and public policy issues that will be discussed in this article. First, what can attorneys do to try to control their on-line reputations? Legal research is complicated by the growing amount of information available, and there is evidence that legal practitioners require additional training in order to enhance their information literacy and legal research skills. Librarians have a key role to play in developing legal research training, and examples taken from Middle Temple's library are used to illustrate ways in which librarians can offer beneficial training to their library users. This involves assessing the skills, motivation, and needs of the average library user in order to design legal research training that is educationally sound and appealing to the target audience.

This article describes the founding and evolution of a “Thai-style” NGO dedicated to consumer protection. Through a description of the NGO and the career of its founder, the article brings to light features of the evolution of NGO based advocacy in Thailand from the student uprising in 1973 to the present. The legacy of the 1973 October Generation of activists continues to influence development of NGOs but new emphasis on rights has emerged since the era of constitutional reform in the 1990s. When Law Reform Is Not Enough: A Case Study On Social Change And The Role That Lawyers And Legal Clinics Ought To Play, Jeff Carolin

Journal of Law and Social Policy

Based on his experience as a law student in the clinical legal education program at Parkdale Community Legal Services in 2010, the author draws on poverty law scholarship to better understand his frustrations with a law reform campaign he worked on related to refugee family reunification. The scholarship’s central critique of law reform campaigns is that they are excessively narrow: they focus on a particular law and construct the law itself as the social injustice. This leads to two subsidiary problems. First, law reform campaigns ignore the underlying socio-political context that produced the law, foregoing opportunities for broader societal transformation. …

The aim of this essay, prepared for a symposium on dispute resolution in special education held at The Ohio State University Moritz College of Law in February 2014, is to highlight ways that advocates for children with disabilities can use federal agencies to improve the implementation and enforcement of federal laws protecting children with disabilities in schools—that is, the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act of 1973, and the Americans with Disabilities Act as it relates to schools.

In the current conversation about reforming legal education, one of the constant refrains is that law schools must graduate students who are "practice ready." Commentators go on to argue that for law schools to produce "practice ready" students, they must expand how they offer experiential learning. One potential way to do that is to expand clinical legal education programs. I worry that law schools (and others) are envisioning clinical legal education as a magic bullet that will solve all of the ills and imbalances present in current legal education. This Essay discusses how comparative law played and plays a role in the statutory development of corporate laws. The influence of laws of other systems on the development of statutory law is common, explicit, and represents a tradition that accompanied legal reforms since the very beginning of the development of legislation.

Focusing on modern corporate law, I argue (but the argument could be extended to many other legal fields) that it is necessary to distinguish two basic ways in which comparative law influences legal reforms in one particular jurisdiction. The United States is among one of the only democratic industrialized nations in the world that does not provide guaranteed access to civil representation in cases involving basic human need. This leaves indigent litigants who are at risk of losing their homes or their children left to seek counsel through insufficient pro-bono programs or limited scope legal self-help centers. This thesis provides a history of the struggle for the right to civil counsel, known as Civil Gideon, and explores a variety of proposed solutions to bridge the justice gap for indigent litigants. Sexual violence in Minnesota impacts hundreds of thousands of lives and costs billions of dollars each year. This qualitative case study describes how victims that are people of color experience sexual violence at disproportionately high rates and face additional barriers when seeking legal, medical, and mental health and crisis advocacy services in Minnesota. The methodology employed includes secondary data collection using books, scholarly articles, and archival data. Individual interviews and a focus group interview were used to collect primary research. Queensland's Budget Austerity And Its Impact On Social Welfare: Is The Cure Worse Than The Disease?, Gregory Marston

The Journal of Sociology & Social Welfare

While considerable attention has been paid to the austerity experiments in Europe, much less attention has been paid to austerity case studies from other parts of the world. This paper examines the case of Queensland, Australia, where the government has pursued austerity measures, while making dire warnings that unless public debt was slashed and the public service sector downsized, Queensland risked becoming the Spain of Australia. The comparison is incomprehensible, given the very different economic situation in Queensland compared with Spain. This comparison constructed a sense of crisis that helped to mask standard neoliberal economic reform. While pursuing neoliberal economic …

Medical-legal partnerships (MLPs) secure the health-related needs of an affected patient-client by identifying upstream determinants of health for which the law provides a remedy. Some healthcare professionals have noted key activities of MLPs, including the provision of legal assistance, educating providers about social determinants of health, and advancing policy change by addressing existent laws and regulations that may impede the maintenance of good health.1 Although these efforts are essential, they do not fully capture the potential of MLPs to serve as a locus of research and intervention to strengthen the evidence base to advance individual and population health.
