Debtors' rights and the due process of debt collection have received increasing attention recently in legislative as well as judicial spheres. There have been many efforts to rectify basic contractual inequities, to abolish summary prejudgment remedies and to limit extra-judicial collection abuses. However, comparatively little scrutiny has been focused on postjudgment or post-hearing remedies in the later stages of the collection process. Until recently, Maine's legal remedies for postjudgment debt collection were notorious for their harshness. Jail, the principal sanction, was freely used as a creditors' club to make debtors settle claims. Although inability to pay was not in itself …

During the past ten years the United States Supreme Court has engineered a major reworking of criminal procedure through judicial review. In no area of criminal procedure has the overhaul been so drastic as in the right to court appointed counsel. From a time when court appointment of counsel was virtually nonexistent, the right has been expanded to the extent that counsel is now available in nearly all cases and stages of the proceedings. It’s no secret: Artificial Intelligence (“AI”), for better or worse, is revolutionizing the world. The legal field and legal education at large are not immune to this explosion of possible uses for AI technology. However, as with any technological advancement, AI and Generative Language Models bring with them many challenges, including the implications of their use. The Violence Against Women Act has protected victims of domestic violence, dating violence, stalking and sexual harassment for over 30 years now. The Act has been reauthorized four times, providing stronger protection for victims each time. The most recent reauthorization in 2022 includes protection for domestic violence victims against chronic nuisance ordinances. These ordinances allow municipalities to punish landlords and tenants if a tenant calls the police too many times to the property, including times in which a domestic violence victim, seeking help, calls the police on their perpetrator. Many states have enacted statutes that align with the 2022 Reauthorization …

This Essay reflects on a Rule of Law course taught at the University of Arkansas School of Law since 2009, exploring its evolution and purpose over fifteen years. In this paper, I argue that World Bank policies, democratization, and globalization are not geared to uplift the dire conditions facing the majority in Africa. In post-Cold War Africa, the contested arena is over control of African cheap labor, markets and resources. In such a scenario, the greatest enemies of "globalization," "democratization" and "freedom" will be African leaders or groups that try to meet their populations' basic needs by focusing on food production rather than export. By releasing conference notes and internal communications, Supreme Court Justices provide insight into the otherwise private decisionmaking process, shedding light on how case outcomes and legal reasoning are framed and negotiated. The watershed case of Argersinger v. Hamlin (1972) extended the constitutional right to counsel to some, but not all, misdemeanor defendants. The case was argued twice, and the Court relied on empirical and authoritative sources to answer complex and practical questions about requiring counsel. This case study employs critical discourse analysis to uncover what influenced the Justices’ decisions and how they framed, shaped, and constructed social realities to foreground …

The purpose of this paper is to explain the potential gaps in U.S. state-level policies from Illinois, Utah, and California. The scope of this paper focuses on policies that specifically address the emerging issue of child influencers. Through a comparative analysis, I found that states like Illinois, California, and Utah all lack enforcement mechanisms, which rational choice theory explains are crucial for ensuring policy effectiveness. Many states, such as California and Utah, followed Illinois’s legal framework through policy diffusion. Therefore, I propose that, in order for states to adopt stronger measures, they should implement France’s more developed legal framework. Through …

This Note will attempt to highlight important aspects of Hawaiian history to provide readers with a clear picture on how Native Hawaiians are still impacted by colonialism, specifically when plaintiffs bring a quiet title or partition action against Native Hawaiian owners of kuleana lands. Before colonization, the concept of private land ownership did not exist in Hawai‘i, and Native Hawaiians adopted a feudal system by dividing land into geographical areas. Missionaries and businessmen brought Western ideas to Hawai‘i and influenced legislation such as the Great Māhele and the Kuleana Land Act of 1850, which solidified the concept of private property. …

The prevalence of default judgments in eviction cases affects housing stability and raises concerns about access to procedural justice for tenants. There is substantial variation across states in the rules governing default judgments that may contribute to variation in the frequency of eviction cases ending in defaults. In this Article, we first construct an original dataset of eviction case data from one jurisdiction and analyze that quantitatively, assessing the share of eviction cases that experience a default, the share of cases that are cured, and the correlates of cases ending in default judgment. Domestic violence is a pervasive and systemic issue that affects millions of people worldwide and has serious repercussions for families, individuals, and society at large. The research investigates how legal frameworks, societal conventions, and cultural values interact to impact the prevalence and resolution of domestic violence in contemporary society. The study looks at the extent institutional biases, social stigma, and deeply ingrained legal policies hinder efficient victim support, prevention, and intervention. Meetings are crucial for small businesses, yet many struggle to plan them effectively due to limited resources. This study examines the gap between the perceived importance and actual performance of 14 meeting planning attributes in small businesses. Through an online survey and Importance-Performance Analysis (IPA), the study finds that attributes such as setting SMART goals and having employees arrive on time and engage before meetings are highly valued but underperformed. The study also emphasizes the importance of leadership, communication, and technology skills for successful meeting planning. International Financial Centers (IFCs) are hubs of legal and financial innovation, developing specialized frameworks that facilitate cross-border investment, enhance global capital mobility, and support economic growth. Through jurisdictional competition, professional clustering, and adaptive regulatory frameworks, IFCs have pioneered legal structures that enable enterprises of all sizes to participate in the global economy. The medical-legal partnership (MLP) model is a multidisciplinary intervention with demonstrated success in addressing health-harming legal needs. We analyzed initial data from the Georgetown University Health Justice Alliance’s Cancer Legal Assistance and Well-being Project (Cancer LAW), an MLP between Georgetown University and MedStar Health serving cancer patients receiving care at an urban, safety-net hospital in Washington, D.C. The sample included 81 patients, who had an average of two legal issues, most commonly in the areas of Social Security, estate planning, housing, and health insurance. Data collected during legal representation captured both financial and non-financial benefits to patients. Patients who responded …

The American public places a high value on access to justice and having the opportunity to be heard. These values can either be upheld or diminished by routine procedural rules. The first-to-file rule is an example of an innocuous procedural rule that is a barrier to justice. Under the first-to-file rule, when two parallel suits are filed in different federal district courts, the first-filed suit will proceed, and the second-filed suit will ordinarily be dismissed or transferred to the venue of the other suit. Transfers often terminate an individual’s case because most people cannot afford to litigate far from home. …

Utah’s Wasatch Front is an urban area with a growing population that faces looming environmental challenges, such as the desiccation of the Great Salt Lake, worsening air quality, water scarcity, and the impacts of urban sprawl. If not prevented, the lake’s desiccation or other environmental challenges could result in dangerous air pollution, biodiversity loss, and disruptions to local economies. Immigrant populations may be uniquely vulnerable to these environmental changes because of economic, social, and political marginalization. Domestic violence survivors are affected by long-term trauma from abuse, which can lead to them being more vulnerable and susceptible to sex trafficking tactics. Sex trafficking survivors are also at risk of becoming involved in an abusive relationship because they may have been previously exposed or due to a normalization of abuse. A heighted velocity of change enveloped the legal profession over the last three decades. From big law to rural practitioners, the traditional law firm model of billing time by the hour proved ripe for disruption. Technological advances automated many once-billable activities; enhanced client sophistication and cost-consciousness restricted law firm revenue by imposing billing guidelines and alternative fee arrangements; clients increasingly retain legal work in-house; and global competition allowed legal services to be disaggregated and outsourced to the lowest cost provider. The net effect of this disruption is reflected in the revenue of the legal services sector, which adjusted for inflation, …
