Disability, Repressive Regimes, And Health Disparity: Assessing Country Conditions In North Korea, Jae-Chun Won, Janet E. Lord, Michael Ashley Stein, Yosung Song Jan 2014

Disability, Repressive Regimes, And Health Disparity: Assessing Country Conditions In North Korea, Jae-Chun Won, Janet E. Lord, Michael Ashley Stein, Yosung Song

Articles

This article examines the potential of international human rights standards to account for heightened risk and vulnerability to human rights abuses for persons with disabilities in politically repressive environments. We offer a preliminary assessment of whether and how a disability-cognizant accounting of human rights in repressive regimes can lead to a more credible and comprehensive understanding of disability in such contexts. In so doing, we make the case for a more thorough and thoughtful application of international disability rights standards to better inform human rights investigations, transitional justice approaches, and international criminal law proceedings. To illustrate this methodology, we analyze …

The Democratic Life Of The Union: Toward Equal Voting Participation For Europeans With Disabilities, Janos Fiala-Butora, Michael Ashley Stein, Janet E. Lord Jan 2014

The Democratic Life Of The Union: Toward Equal Voting Participation For Europeans With Disabilities, Janos Fiala-Butora, Michael Ashley Stein, Janet E. Lord

Articles

This Article puts forward preliminary legal scholarship on equal political participation by persons with disabilities and what international human rights law requires for its attainment. The goal is to provoke an informed dialogue on the neglected but fundamental human right to enfranchisement by persons with disabilities while also acknowledging that a complete and just resolution requires further information and reflection. The Article argues that the fundamental right to vote cannot be curtailed on the basis of an alleged lack of capacity. Disenfranchisement based on individual assessment unjustly excludes a certain number of voting-capable individuals. Since all those affected are persons …

Cause To Believe What? The Importance Of Defining A Search's Object—Or, How The Aba Would Analyze The Nsa Metadata Surveillance Program, Christopher Slobogin Jan 2014

Cause To Believe What? The Importance Of Defining A Search's Object—Or, How The Aba Would Analyze The Nsa Metadata Surveillance Program, Christopher Slobogin

Oklahoma Law Review

Courts and scholars have devoted considerable attention to the definition of probable cause and reasonable suspicion. Since the demise of the “mere evidence rule” in the 1960s, however, they have rarely examined how these central Fourth Amendment concepts interact with the “object” of the search. That is unfortunate, because this interaction can have significant consequences. For instance, probable cause to believe that a search “might lead to evidence of wrongdoing” triggers a very different inquiry than probable cause to believe that a search “will produce evidence of criminal activity.” The failure to address the constraints that should be imposed on …

Lessons From The Nba Lockout: Union Democracy, Public Support, And The Folly Of The National Basketball Players Association, Matthew Parlow Jan 2014

Lessons From The Nba Lockout: Union Democracy, Public Support, And The Folly Of The National Basketball Players Association, Matthew Parlow

Oklahoma Law Review

By most accounts, the National Basketball Players Association (NBPA)—the union representing the players in the NBA—conceded a significant amount of money and other contractual terms in the new ten year collective bargaining agreement (2011 Agreement) that ended the 2011 NBA lockout. Player concessions were predictable because the NBA’s economic structure desperately needed an overhaul. The magnitude of such concessions, however, was startling. The substantial changes in the division of basketball-related income, contract lengths and amounts, salary cap provisions, and revenue sharing rendered the NBA lockout—and the resulting 2011 Agreement—a near-complete victory for the owners. Several interpretations have been offered to …

Treatment Of Infectious Mastitis, Elizabeth Sandberg, Jan 2014

Treatment Of Infectious Mastitis, Elizabeth Sandberg,

Theses and Dissertations

Mastitis is a complication of breast feeding encountered often by primary care providers. The goal of treating mastitis is not only resolution of the infection, but also the continuation of lactation so that both mother and child may continue to enjoy the innumerable health benefits of breastfeeding. The patient discussed in this case study is a first time mother who is exclusively breastfeeding, but whose planned change in feeding schedules places her at risk for developing mastitis as a result of engorgement or plugged milk ducts. This case report examines current recommendations and evidence for treatment of infectious mastitis. Attention …

The Association Between Autobiographical Memory Specificity And Memory Sharing In College Students, Nicola Herting Jan 2014

The Association Between Autobiographical Memory Specificity And Memory Sharing In College Students, Nicola Herting

Theses and Dissertations

The way in which memories are stored and communicated makes the construction of autobiographical memories (AM) both an internal process and a social occurrence. Strong associations between reduced AM specificity and psychological adjustment have been found; however, the role significant others have in the socialization and co-construction of AM may have be overlooked. This study examines whether the process of sharing AMs and the perceived benefits of sharing these memories are associated with differences in specificity of AM, as well as explores methodological differences in how AMs are collected. Data from 177 participants was collected on the Most Important Memories …

Predictors Of Sexual Assertiveness In Women: A Comparative Study Of Women During Different Life-Stages, Eevett Alane Loshek

Theses and Dissertations

Sexual assertiveness is a beneficial skill-set for women, which is associated with several positive sexual health outcomes. The goals of the current project were to 1) develop a comprehensive measure of sexual assertiveness that could be used for women across the adult life span, 2) to better understand the predictors of specific dimensions of sexual assertiveness, 3) to investigate differences in the dimensions of sexual assertiveness across age groups, and 4) to examine how the predictors of sexual assertiveness vary by age. In Study 1 and Study 2, a three-factor comprehensive measure of sexual assertiveness was developed. These three factors …

Self-Esteem, Emotions And Relationships, Kristyn Smith Jan 2014

Self-Esteem, Emotions And Relationships, Kristyn Smith

Theses and Dissertations

Presently there is a lack of research examining how geographical differences may related to different manifestations of hook up culture. Females from rural communities' were focused on in order to try to account for the gap in literature focusing on whether females' affect and self-esteem predicted future hook-up behaviors. Among young females, those who are from a rural community engage in hook-ups more frequently than those from an urban area; as well as report negative experiences within the community after they engage in a hook-up. The relationship between female's self-esteem and their intent to participate in a hook-up in the …

The Self-Objectification Scale: A New Measure For Assessing Self-Objectification, Sarah Dahl Jan 2014

The Self-Objectification Scale: A New Measure For Assessing Self-Objectification, Sarah Dahl

Theses and Dissertations

Many of the measures for self-objectification have theoretical or psychometric issues related to their use. For this reason, the development of a new measure addressing these concerns would be beneficial to the research on self-objectification. Towards this goal of developing and validating a new measure for self-objectification, the Self-Objectification Scale (SOS) was developed. The Self-Objectification Scale is the first scale to be created with two alternative forms for measuring trait and state self-objectification that have undergone analyses for reliability and validity with both men and women. A pilot study of 40 undergraduate men and women was conducted to check the …

A "Keeping Place For Souls": Photo, Body, And Narrative Impulse In Cormac Mccarthy's Suttree, Melissa Anne Mondry Jan 2014

A "Keeping Place For Souls": Photo, Body, And Narrative Impulse In Cormac Mccarthy's Suttree, Melissa Anne Mondry

Theses and Dissertations

This paper examines how the treatment of photographs in Cormac McCarthy's novel Suttree sheds light on its main character's narrative project, his motivation for writing and his approach to his subjects. It extends the work of critics who have identified the character of Suttree as a burgeoning writer in order to examine what this narrative subplot might indicate about the purpose of narrative in McCarthy's world. It also responds to previous readings of the novel's photo album scene, which have focused on photographs as reminders of death. I argue that Suttree's adverse reaction to photographs is more complicated than fear …

Potential Juror Credibility Evaluations Of Gay And Lesbian Witnesses, Lisa Mae Olson Jan 2014

Potential Juror Credibility Evaluations Of Gay And Lesbian Witnesses, Lisa Mae Olson

Theses and Dissertations

This study looked at whether the sexual orientation of a witness has an effect on a potential juror's determination of the witness's credibility, and examined traits such as respondent gender and college major, that may predict high levels of sexual prejudice. The sample consisted of 379 undergraduate students at a medium sized, upper Midwestern university. Results did not reveal an overall link between witness credibility ratings and sexual orientation, with the gay male witness receiving the highest credibility rankings followed by the heterosexual male witness, heterosexual female witness, and lastly, the lesbian female witness. It does not appear that the …

Mathematics, Physics, and Computer Science Faculty Articles and Research

A dust storm of fearful proportions hit Phoenix in the early evening hours of 5 July 2011. This storm, an American haboob, was predicted hours in advance because numerical, land–atmosphere modeling, computing power and remote sensing of dust events have improved greatly over the past decade. High-resolution numerical models are required for accurate simulation of the small scales of the haboob process, with high velocity surface winds produced by strong convection and severe downbursts. Dust productive areas in this region consist mainly of agricultural fields, with soil surfaces disturbed by plowing and tracks of land in the high Sonoran Desert …

Allosteric Regulation Of The Hsp90 Dynamics And Stability By Client Recruiter Cochaperones: Protein Structure Network Modeling, Kristin Blacklock, Gennady M. Verkhivker Jan 2014

Allosteric Regulation Of The Hsp90 Dynamics And Stability By Client Recruiter Cochaperones: Protein Structure Network Modeling, Kristin Blacklock, Gennady M. Verkhivker

Mathematics, Physics, and Computer Science Faculty Articles and Research

The fundamental role of the Hsp90 chaperone in supporting functional activity of diverse protein clients is anchored by specific cochaperones. A family of immune sensing client proteins is delivered to the Hsp90 system with the aid of cochaperones Sgt1 and Rar1 that act cooperatively with Hsp90 to form allosterically regulated dynamic complexes. In this work, functional dynamics and protein structure network modeling are combined to dissect molecular mechanisms of Hsp90 regulation by the client recruiter cochaperones. Dynamic signatures of the Hsp90-cochaperone complexes are manifested in differential modulation of the conformational mobility in the Hsp90 lid motif. Consistent with the experiments, …

Computational Modeling Of Allosteric Regulation In The Hsp90 Chaperones: A Statistical Ensemble Analysis Of Protein Structure Networks And Allosteric Communications, Kristin Blacklock, Gennady M. Verkhivker

Mathematics, Physics, and Computer Science Faculty Articles and Research

A fundamental role of the Hsp90 chaperone in regulating functional activity of diverse protein clients is essential for the integrity of signaling networks. In this work we have combined biophysical simulations of the Hsp90 crystal structures with the protein structure network analysis to characterize the statistical ensemble of allosteric interaction networks and communication pathways in the Hsp90 chaperones. We have found that principal structurally stable communities could be preserved during dynamic changes in the conformational ensemble. The dominant contribution of the inter-domain rigidity to the interaction networks has emerged as a common factor responsible for the thermodynamic stability of the …

This Article analyzes the possibility of creating a program to provide representation to workers bound to arbitrate their legal disputes with their employers, while at the same time building a movement to challenge the practice of compulsory arbitration and its impact on workers' rights. First, I briefly review the Supreme Court's recent arbitration jurisprudence and its impact on workers, with a particular focus on the limitations on class actions. Then I move to a discussion of the advantages and challenges to the creation of such a program. Finally, I examine some alternative visions of what such a program might look …

Copyright's Topography: An Empirical Study Of Copyright Litigation, Christopher A. Cotropia, James Gibson Jan 2014

Copyright's Topography: An Empirical Study Of Copyright Litigation, Christopher A. Cotropia, James Gibson

Law Faculty Publications

One of the most important ways to measure the impact of copyright law is through empirical examination of actual copyright infringement cases. Yet scholars have universally overlooked this rich source of data. This study fills that gap through a comprehensive empirical analysis of copyright infringement litigation, examining the pleadings, motions, and dockets from more than nine hundred copyright lawsuits filed from 2005 through 2008. The data we collect allow us to examine a wide variety of copyright issues, such as the rate of settlements versus judgments; the incidence of litigation between major media companies, small firms, and individuals; the kinds …

Using International Law In Somalia’S Post- Conflict Reconstruction, Chiara Giorgetti Jan 2014

Using International Law In Somalia’S Post- Conflict Reconstruction, Chiara Giorgetti

Law Faculty Publications

For the first time since 1991, Somalia has an internationally- recognized government. Established in August 2012, the Somali Federal Government (SFG) has been officially recognized by many nations and international organizations. The process of bringing Somalia fully back into the international community, however, remains long and complex. This Article argues that, in order to be successful, Somalia’s reconstruction must include a robust international law component. By mandating frameworks for action and establishing best practices, international law should guide and strengthen reconstruction efforts.

Cultural Determinants Of Workplace Arbitration In The U.S. And Italy, Ann C. Hodges Jan 2014

Cultural Determinants Of Workplace Arbitration In The U.S. And Italy, Ann C. Hodges

Law Faculty Publications

Although Italy and the United States are both advanced industrial economies, the law and practice of workplace arbitration differs significantly in the two countries. This Article explores those variations and analyzes the reasons lbr the divergent evolution of arbitration. The Article concludes that histon'cal and cultural differences in legal systems and labor and employment relations are explanatory forces. While the United States could provide a more balanced system of arbitration by learning from the Italian systems greater protection of workers, given the current reality neither system seems likely to undergo significant change in the near fiiture.

The Arbitral Tribunal: Selection And Replacement Of Arbitrators, Chiara Giorgetti Jan 2014

The Arbitral Tribunal: Selection And Replacement Of Arbitrators, Chiara Giorgetti

Law Faculty Publications

The great majority of international investment arbitrations are decided by a three-member arbitral panel, where each party selects one arbitrator, and the presiding arbitrator is selected either by agreement of the parties, the party-appointed arbitrators, or, more often, by a neutral appointing authority. Their selection is not only a characteristic feature of international investment arbitration, but also one of the most important and delicate acts taken by the parties during the proceedings. Indeed, as frequent arbitrator Professor William W. Park noted, while “in real estate the three key elements are ‘location, location, location,’ . . . in arbitration the applicable …
