Children in dependency and neglect proceedings are one of the most vulnerable groups in our legal system. Nationally, their legal representation comes in many forms. In Colorado, juvenile courts assign guardians ad litem (GALs) to children in these proceedings. GALs are lawyers who represent the children's best interests. For many years, GALs faced an ethical dilemma: should confidentiality, as proscribed by the Colorado Rules of Professional Conduct, apply to the GAL-child relationship. In People v. Gabriesheski, the Colorado Supreme Court held that GALs are not their children's lawyers and, thus, confidentiality does not exist between GALs and children. While this …

Won't You Be My Neighbor? The Fallout From The Colorado Supreme Court's Decision In Cogcc V. Gvca, Luke Mecklenburg

This Casenote asserts that the Colorado Supreme Court's decision in COGCC v. GVCA, while legally adequate, condones a harmful public policy that necessitates legislative correction. The case pitted two landowners whose property was adjacent to a proposed well that would drill down within a three-mile radius of an underground nuclear detonation site known as the Rulison blast zone, as well as a citizens'group from the Rulison area, against the Colorado Oil and Gas Conservation Commission (COGCC). The Spending Power And Environmental Law After Sebelius, Erin Ryan

In National Federation of Independent Business v. Sebelius, a plurality of the Supreme Court held that portions of the Affordable Care Act exceeded federal authority under the Spending Clause. With that holding, Sebelius became the first Supreme Court decision since the New Deal to limit an act of Congress on spending-power grounds, rounding out the "New Federalism" limits on federal power first initiated by the Rehnquist Court in the 1990s. The new Sebelius doctrine constrains the federal spending power in contexts involving changes to ongoing intergovernmental partnerships with very large federal grants. Unbundling Federalism: Colorado's Legalization Of Marijuana And Federalism's Many Forms, Jessica Bulman-Pozen

This short Essay argues that various attributes we associate with federalism should not be deemed necessary components of federalism as a definitional or normative matter. Using Colorado's recent legalization of marijuana as a case study, it shows how two such attributes-an autonomous realm of state action and independent state officials with distinctive interests-can be pulled apart. State officials often further their interests and effectively oppose federal policy when they participate in the same statutory scheme as federal actors instead of operating in a separate, autonomous sphere. Economic Upheaval And Its Impact On U.S. Banks - Considerations For Their Future Success Or Failure?, Rita C. Jones Phd, James L. Hauck, Vicky Langston Phd
Journal of Business, Industry, and Economics
The purpose of this paper is to discuss whether or not U.S. Banks will have to consolidate to survive and succeed in the 21st Century. In the past decade, the financial services industry has experienced one of three periods of great turmoil since the Great Depression. This upheaval has led to dramatic shifts in the competitive and regulatory environments in which financial service providers operate. The result of these changes is that many more small and mid-sized banks will find it necessary, or even attractive, to merge with competitors, either voluntarily or involuntarily, during the course of the next decade.

This study describes the research papers published in the International Journal of Project Management (IJPM) and the Project Management Journal (PMJ) over a ten-year period. The contribution is a picture of the level of rigor and research maturity in project managemen tresearch during this period since each paper is categorized using research design framework. In addition, we determine the authors and institutions that have been the most frequent contributorsin order to provide a foundation for the discussion of communication with the field and related disciplines. Finally, previous studies on industry application areas have been updated for this ten year period.

Permeability of the endothelial monolayer is increased when exposed to the bacterial endotoxin LPS. Our previous studies have shown that heat shock protein (Hsp) 90 inhibitors protect and restore LPS-mediated hyperpermeability in bovine pulmonary arterial endothelial cells. In this study, we assessed the effect of Hsp90 inhibition against LPS-mediated hyperpermeability in cultured human lung microvascular endothelial cells (HLMVECs) and delineated the underlying molecular mechanisms. We demonstrate that Hsp90 inhibition is critical in the early phase, to prevent LPS-mediated hyperpermeability, and also in the later phase, to restore LPS-mediated hyperpermeability in HLMVECs. During the period after the United States’ Civil War, numerous wealthy, northern philanthropists turned their attention to the plight of Southern African Americans’ health care, social services, social equity, and education. As time passed, these philanthropists explored Southern African Americans’ well-being with the purpose of helping all poor and disadvantaged peoples. In the early-twentieth century, the General Education Board (GEB) and the Julius Rosenwald Fund, two foundations particularly active toward meeting these ends, frequently worked on similar projects and, from time to time, even funded one another’s projects. La dispersion des polluants des émissions de cheminées de toit dans la couche limite est fortement influencée par la présence de bâtiments avoisinants et la topographie locale. Il est donc très difficile d’évaluer précisément les concentrations dans le panache sur différentes surfaces de bâtiments. La prédiction de la dispersion des émissions polluantes de cheminées de toit en milieu urbain est extrêmement complexe, tout particulièrement en présence de bâtiments voisins. Le comportement du panache dépend des caractéristiques du vent, mais il est aussi lourdement influencé par l’environnement. Il se peut ainsi que les effluents émis par une cheminée de toit se réintroduisent dans le bâtiment émetteur ou dans un bâtiment adjacent, exposant du coup les occupants à d’éventuels problèmes de santé. Entre 2005 et 2007, les accidents de type glissades, trébuchements et chutes de même niveau ont représenté 12,6 % de l’ensemble des lésions indemnisées par la Commission de la santé et de la sécurité du travail du Québec (CSST) et ont entraîné des débours de 90 millions de dollars. Deux secteurs professionnels, soit les policiers et les brigadiers scolaires, ont sollicité l’appui de l’Institut de recherche Robert-Sauvé en santé et en sécurité du travail (IRSST) pour les aider à réduire et/ou prévenir les glissades qui, globalement, représentent près de la moitié de ces accidents. Les nanotechnologies présentent aujourd’hui des enjeux majeurs en termes technologique, économique, éthique, social et environnemental, car elles offrent le potentiel d’améliorer de façon substantielle les propriétés de multiples produits dans tous les secteurs d’activité tant en matière de production de matériaux aux performances inédites que de diagnostic et de traitement médical. L’activité de pêche commerciale est l’une des plus dangereuses du domaine industriel. Des chutes par-dessus bord se produisent chaque saison de pêche et leurs conséquences sont généralement graves, parfois mortelles. Au cours des dernières années, deux décès sont survenus dans ces circonstances au Québec lors d’activités de pêche au homard. De façon générale les causes documentées des chutes par-dessus bord sont la perte d’équilibre et l’entraînement par le gréement de pêche. Les risques liés à l’interaction entre les presses à injection de plastique et leurs équipements périphériques (ex. : robots, convoyeurs) sont peu connus des gens du milieu et ces risques peuvent mener à des accidents du travail parfois mortels. Alors que les nanotechnologies émergentes ouvrent des voies prometteuses dans plusieurs secteurs d’activité, des études suggèrent que les nanoparticules (NP) qu’elles génèrent pourraient avoir des effets négatifs, notamment sur la santé et sur l’environnement. Celles-ci peuvent être générées lors de la fabrication, de la manutention et de l’assemblage de pièces métalliques ordinaires et de celles à base de nanomatériaux. Avec le vieillissement de la population, la demande de soins palliatifs (SP) de fin de vie est croissante et les services de santé s’organisent. Au Québec, les SP de fin de vie sont surtout intégrés aux soins curatifs et on retrouve peu d’unités de SP spécialisées. Ces soins s'incorporent alors aux soins à domicile ou à ceux dispensés dans les unités de soins spécialisés en centre hospitalier, comme l’oncologie et les soins critiques. Une nouvelle technologie d’alarmes de recul de véhicule lourd a fait récemment son apparition sur le marché. Cette technologie, basée sur l’utilisation d’un signal large-bande (bruit de type « pschitt- pschitt ») serait, selon le manufacturier, plus sécuritaire pour les travailleurs tout en causant moins de nuisance environnementale que l’alarme tonale conventionnelle (bruit de type « beep-beep »). Il demeurait toutefois difficile de se prononcer sur la supériorité de cette technologie puisqu’il existe très peu d’études scientifiques indépendantes et rigoureuses portant sur celle-ci.

En 2001, l'IRSST a demandé à l'équipe de recherche du Dr Rivard d'évaluer le programme PRÉVICAP (PRÉVention des situations de handICAP au travail) mis en place dans quatre centres de réadaptation du Québec et impliquant onze directions régionales de la CSST. Ce projet pilote lancé en 2000 était le fruit d'une entente entre la CSST, l'IRSST et le Réseau en réadaptation au travail du Québec (RRTQ). Il a permis la prise en charge PRÉVICAP de 571 travailleurs ayant subi une lésion professionnelle entre 2001 et 2004.

The purpose of this scholarly project is to identify a need and to guide occupational therapists during the treatment of adolescents who have acquired a spinal cord injury. During the adolescence stage, an individual begins to develop a sense of self and sense of direction, as well as formulate values which all contribute to personal identity formation (Erickson, 1968). The manual will guide the occupational therapist to address identity formation through use of the chosen assessments and interventions.
