Immaculate Defamation: The Case Of The Alton Telegraph, Alan M. Weinberger Jan 2014

Immaculate Defamation: The Case Of The Alton Telegraph, Alan M. Weinberger

Texas A&M Law Review

At the confluence of three major rivers, Madison County, Illinois, was also the intersection of the nation’s struggle for a free press and the right of access to appellate review in the historic case of the Alton Telegraph. The newspaper, which helps perpetuate the memory of Elijah Lovejoy, the first martyr to the cause of a free press, found itself on the losing side of the largest judgment for defamation in U.S. history as a result of a story that was never published in the paper—a case of immaculate defamation. Because it could not afford to post an appeal bond …

When The Author Owns The World: Copyright Issues Arising From Monetizing Fan Fiction, Steven D. Jamar, Christen B’Anca Glenn Jan 2014

When The Author Owns The World: Copyright Issues Arising From Monetizing Fan Fiction, Steven D. Jamar, Christen B’Anca Glenn

Texas A&M Law Review

Fan fiction is amateur writing that imaginatively reinvents a work in pop culture while maintaining the identifiable aspects of the preexisting work. Fans of various books, films, and television series write their own versions of the stories and post them online in fan fiction communities. Fan fiction as practiced today is a way for fans to creatively express themselves and become integrated into the story and world they love. The stories range from highly derivative works, where relatively few plot points are changed, to entirely new plot lines using the same world and characters of the original, underlying work. Some …

The Environment Of Poverty And The Limits Of Girlhood: The Struggle For The Right To An Education In North India. Gareebi Ka Mahual Aur Ladkeo Ki Hud, Imandeep Kaur Grewal

Master's Theses and Doctoral Dissertations

This qualitative dissertation explored the lived worlds and educational experiences of adolescent girls living in poverty in North India. Class, caste, gender, and regionally-based inequalities result in striking disparities leading to restricted, gendered opportunities and individual freedoms. The purpose of this ethnographic study was an in-depth exploration of the lives of 20 girls living in poverty, and how their own educational futures were impacted by educational policy and practices. Illustrative case studies were used to explore the broader question of educational access. In keeping with Article 12 of the Convention on the Rights of the Child (CRC), the primary focus …

The Choice Is Yours! Researchers Assign Subject Metadata To Their Own Materials In Institutional Repositories, Maira Bundza

University Libraries Faculty & Staff Publications

The Digital Commons platform for institutional repositories provides a three-tiered taxonomy of academic disciplines for each item submitted to the repository. Since faculty and departmental administrators across campuses are encouraged to submit materials to the institutional repository themselves, they must also assign disciplines or subject categories for their own work. The expandable drop-down menu of about 1,000 categories is easy to use, and facilitates the growth of the institutional repository and access to the materials through the Internet.

Use Of Incentive-Based Pricing: Cataloguing Current Water Rate Structures And Analyzing Community Adopter Characteristics For Select Municipalities In New Mexico, Ashley M. Hooper Jan 2014

Use Of Incentive-Based Pricing: Cataloguing Current Water Rate Structures And Analyzing Community Adopter Characteristics For Select Municipalities In New Mexico, Ashley M. Hooper

Water Resources Professional Project Reports

Facing water scarcity, population growth, and issues of climate change, New Mexico municipalities should consider incentive-based pricing (IBP), empirically shown to encourage conservation. Given that adoption of IBP will likely be affected by community and political will, it is important to know what socio-economic and demographic factors may influence a municipalitys decision to adopt. As such, this research descriptively summarizes and catalogues the use of IBP structures for a select sample of 30 NM communities; further, t-tests are used to statistically investigate significant differences in a select set of 12 community characteristics between those that adopt IBP and those that …

Detecting The Influence Of Best Management Practices On Vegetation Near Ephemeral Streams With Landsat Data, Matthew Rigge, Alexander Smart, Bruce Wylie, Kendall De Van Kamp Jan 2014

Detecting The Influence Of Best Management Practices On Vegetation Near Ephemeral Streams With Landsat Data, Matthew Rigge, Alexander Smart, Bruce Wylie, Kendall De Van Kamp

Natural Resource Management Faculty Publications

Various best management practices (BMPs) have been implemented on rangelands with the goals of controlling nonpoint sourcepollution, reducing the impact of livestock in ecologically important riparian areas, and improving grazing distribution.Providing off-stream water sources to livestock in pastures, cross-fencing, and rotational grazing are common rangeland BMPsthat have demonstrated success in drawing livestock grazing pressure away from streams. We evaluated the effects of rangelandBMP implementation with six commercial-scale pastures in the northern mixed-grass prairie. Four pastures received a BMPsuite consisting of off-stream water, cross-fencing, and deferred-rotation grazing, and two pastures did not receive BMPs. Wehypothesized that the BMPs increased the quantity …

Breaking Up Payday: Anti-Agglomeration Zoning & Consumer Welfare, Sheila R. Foster Jan 2014

Breaking Up Payday: Anti-Agglomeration Zoning & Consumer Welfare, Sheila R. Foster

Faculty Scholarship

In the last decade, dozens of local governments have enacted zoning ordinances designed to limit the concentration of payday lenders and other alternative financial services providers (AFSPs), such as check-cashing businesses and auto title loan shops, in their communities. The main impetus for these ordinances is to shield economically vulnerable residents from the industry’s lending practices in the absence of sufficiently aggressive federal and state consumer protection regulation. This Essay casts considerable doubt on whether zoning is the appropriate regulatory tool to achieve the consumer protection and welfare goals animating these ordinances. The author’s analysis of the aftermath of payday …

The Adult Scale Of Parental Attachment-Short Form: Item Selection, Factor Structure, And Psychometric Properties, Anthony Aron Michael

Electronic Theses and Dissertations

The purpose of this study was to examine if an abbreviated version of the Adult Scale of Parental Attachment (ASPA; Snow, Sullivan, Martin, & Helm, 2005) could be developed with an emphasis on the instrument's item selection, factor structure, and psychometric properties. The ASPA, building upon attachment theory, is a self-report measure that assesses individuals' patterns of relating based on their relationships with both mother and father figures in childhood. Utilizing the conceptual underpinnings of Classical Test Theory and factor analysis, a 40-item version of the ASPA (called the ASPA-SF) was created from 1,075 archived responses through a test construction …

International Institute for Infrastructure Resilience and Reconstruction (I3R2) Conference

Normative solutions for the successful recovery from large-scale disasters have been presented by various researches, but implementation requires a long process, and mechanism for the process to continue is necessary. We consider the consistency among strategies of stakeholders such as government and NGOs. These players make a decision based on not only direct motive but various complex motives and interaction with other players. This paper considers interactive decision-making as a game among stakeholders. As a case to study, we analyze housing reconstruction project in Sri Lanka after the 2004 Indian Ocean Tsunami. There was relatively abundant financial support, but the …

Building Educator Capacity In Support Of Student Achievement On Florida's United States History End-Of-Course Assessment, Stacy Skinner

Electronic Theses and Dissertations

Florida's United States History End-of-Course (EOC) Assessment performance outcomes are scheduled to impact student course grades, educator evaluation scores, and school grades. A professional learning plan to improve teaching and learning in support of student achievement on the Assessment does not exist. Neither Florida Statute nor the Florida Department of Education (FDOE) facilitate or fund professional learning in support of these influences. This dissertation in practice proposes the use of the U.S. History EOC Assessment Professional Learning Series to build educator capacity in support of student achievement on the Assessment. Implementation of professional learning could address the disparity between the …

Cognitive Effects And Academic Consequences Of Video Game Playing, Sean Hollis

Electronic Theses and Dissertations

Introduction: prior video game playing (vgp) research has generated mixed empirical findings. Recent studies suggested positive effects vgp may have on cognitive skills, particularly improvements in visuospatial skills, processing speed, working memory, multitasking, and problem solving skills. By contrast, other studies have suggested that vgp leads to lower academic performance - indicating further research on vgp effects is needed. This study investigated the effects of vgp on cognitive skills and academic performance. Methods: 208 participants were recruited from the University of Mississippi psychology department in exchange for research participation credit. The sample was 68.9% female and 31.1% male. Ages ranged …

United States Department of Agriculture Wildlife Services: Staff Publications

We present a unique water-balance approach for modeling snowpack under historic, current and future climates throughout the Sierra Nevada Ecoregion. Our methodology uses a finer scale (270 m) than previous regional studies and incorporates cold-air pooling, an atmospheric process that sustains cooler temperatures in topographic depressions thereby mitigating snowmelt. Our results are intended to support management and conservation of snow-dependent species, which requires characterization of suitable habitat under current and future climates. We use the wolverine (Gulo gulo) as an example species and investigate potential habitat based on the depth and extent of spring snowpack within four National …

Leveraging The Power Of Social Media To Maximize Organizational Learning And Drive Performance, Camilla C. Nguyen

Theses and Dissertations

This qualitative ethnographic study addresses the phenomenon of rapid social media expansion, which creates organizational challenges. Ongoing development of advanced technology products means that effective organizations must be more adaptive and receptive to new approaches and changes in their environment. In a hyper connected society, one where workers are linked through social media--at work, home, vacation, in a restaurant, or anywhere else--organizations need to unify their communication systems to leverage the potential that enhanced and collaborative communication can yield (Meister & Willyerd, 2010). The research undertaken is directed at obtaining data on levels of social media penetration into organizational learning …

Ethnic Differences In Delusional Content In Schizophrenia: A Comparative Analysis Of Delusional Symptoms In Individuals Of White European Descent And Latino Descent, Jessica A. Valluzzi

Theses and Dissertations

Although the phenomenon of psychosis in schizophrenia has been extensively studied, limited attention has been paid to the relationship of ethnicity/culture and the form and quality of psychotic symptoms. It is widely assumed that culture significantly influences the phenomenology of mental illness. Psychotic experiences, such as delusions and hallucinations, are likely no exception. There is a relatively small body of literature on cross-cultural differences in delusional symptoms that has yielded mixed findings. The purpose of this study was to contribute to the literature by examining potential differences in delusional symptoms among 2 cultural groups of schizophrenia patients: individuals of Latino …

Performance And Leadership In Multiplayer Online Gaming, Timothy Joseph Magner

Theses and Dissertations

Multiplayer online video games are an increasingly popular form of entertainment, and many individuals spend a considerable amount of time playing them. One hallmark of these multiplayer games has been the need for collaboration and teamwork for both individual enjoyment and game success. At the same time the needs of a global marketplace have led to the evolution of the geographically separated, but technology linked, distributed team as a critical business function. The elements and functions of these business-oriented distributed teams closely align with the types of groups that often come together to play online video games. A common trait …

Cracks In The Profession's Monopoly Armor, John Sahl Jan 2014

Cracks In The Profession's Monopoly Armor, John Sahl

Akron Law Faculty Publications

This article examines the legal profession’s long-held monopoly in the nation’s legal services market in the context of two recent developments. The first development concerns the Conference of Chief Justices’ (CCJ) recent adoption of Resolution 15, “Encouraging Adoption of Rules Regarding Admission of Attorneys Who Are Dependents of Service Members.” Resolution 15 urges state bar authorities to develop and implement rules permitting admission without examination of lawyers who are military dependents. The CCJ’s rule promotes competition by facilitating the movement of lawyers from one geographic market to another.

The second development is Washington Supreme Court’s new Admission to Practice Rule …

The Farmer In Chief: Obama's Local Food Legacy, Sarah J. Morath Jan 2014

The Farmer In Chief: Obama's Local Food Legacy, Sarah J. Morath

Akron Law Faculty Publications

As criticism over America’s food policy has grown, many scholars have offered suggestions for reform. Complementing this body of scholarship, The Farmer In Chief identifies and assesses recent changes to federal laws and policies as they affect ‘local food’ and describes local farmers’ awareness of and reaction to these changes. These changes and the farmers’ responses show greater recognition of local food by the President and federal government in three ways: increased inclusion of local food in legislation and policy discussions; increased awareness of the benefits of local food production and consumption; and increased consumer access to local food. But …
