Intellectual Property, The Free Movement Of Goods And Trade Restraint In The European Union, Jarrod Tudor Jan 2014

Intellectual Property, The Free Movement Of Goods And Trade Restraint In The European Union, Jarrod Tudor

The Journal of Business, Entrepreneurship & the Law

The European Union (“EU”) is the most significant trade partner of the United States. Trading in goods protected by intellectual property rights remains a challenge for American business entities as they are forced to sift through a myriad of law consisting of the federal intellectual property law of the EU and the intellectual property law of the member states. The European Court of Justice (“ECJ” or “the Court”) has been faced with dozens of complex cases arising out of conflicts between the national law of the member states and the Articles of the Treaty on the Functioning of the European …

Post Disturbance Coral Populations: Patterns In Live Cover And Colony Size Classes From Transect Studies In Two Oceans, Claire A. Dolphin Jan 2014

Post Disturbance Coral Populations: Patterns In Live Cover And Colony Size Classes From Transect Studies In Two Oceans, Claire A. Dolphin

HCNSO Student Theses and Dissertations

This study analyzes data acquired in French Polynesia in the Pacific and The Bahamas (Atlantic), both oceans affected by recent, well documented and sequential disturbances. For the purposes of this study, a disturbance is defined as a perturbation of environmental, physical or biological conditions that causes a distinct change in the ecosystem. After several decades of coral bleaching events, biological change, and anthropogenic impacts, rapid assessments of the coral community were accomplished by collecting photo-transects across the reefs to extract size structure of the corals, percent live tissue cover and perform a faunal evaluation. Cluster analyses and spatial autocorrelation tests …

The N-Word: Lessons Taught And Lessons Learned, Neal A. Lester

Journal of Praxis in Multicultural Education

A Life History Perspective On Skin Cancer And The Evolution Of Skin Pigmentation, Daniel L. Osborne, Raymond B. Hames Jan 2014

A Life History Perspective On Skin Cancer And The Evolution Of Skin Pigmentation, Daniel L. Osborne, Raymond B. Hames

Department of Anthropology: Faculty Publications

The ancestral state of human skin pigmentation evolved in response to high ultraviolet radiation (UVR) stress. Some argue that pigmentation evolved to limit folate photolysis, therein limiting neural tube defects. Pigmentation also protects against sunburn which decreases the efficiency of sweating and potentiates skin infection. Pigmentation increases the efficacy of skin as a barrier to infection. Skin cancer has been rejected or minimized as a selective pressure because it is believed to have little or no effect on mortality during reproductive years. This argument ignores evidence of human longevity as a derived life history trait and the adaptive value of …

Charting The Legal Geography Of Non-International Armed Conflict, Michael N. Schmitt Jan 2014

Charting The Legal Geography Of Non-International Armed Conflict, Michael N. Schmitt

International Law Studies

This article examines the geographical reach of international humanitarian law (law of armed conflict), particularly during armed conflicts between States and non-State organized armed groups. The issue is operationally critical, since to the extent that IHL applies, practices which are lawful during armed conflicts, such as status-based targeting, may be employed. When IHL does not apply, human rights obligations shouldered by the State govern the conduct of its military operations. The article surveys the various approaches to the the legal geography of non-international armed conflict, arguing that an interpretation by which IHL is not geographically restricted is the most supportable.

A White Nile Megalake During The Last Interglacial Period, Tt Barrows, Maj Williams, Sc Mills, Gat Duller, Et Al Jan 2014

A White Nile Megalake During The Last Interglacial Period, Tt Barrows, Maj Williams, Sc Mills, Gat Duller, Et Al

School of Geography, Earth and Environmental Sciences

The eastern Sahara Desert of Africa is one of the most climatically sensitive areas on Earth, varying from lake-studded savannah woodland to hyperarid desert over the course of a glacial-interglacial cycle. In currently semiarid Sudan there is widespread evidence that a very large freshwater lake once filled the White Nile River valley. Here we present the first quantitative estimate for the dimensions of the lake and a direct age for the emplacement of its shoreline. Using a profile dating approach with the cosmogenic nuclide 10Be, we estimate an exposure age of 109 ± 8 ka for this megalake, indicating that …

Relationship Between Altitude And Lithium In Groundwater In The United States Of America: Results Of A 1992–2003 Study, Rebekah S. Huber, Namkug Kim, Carl E. Renshaw, Perry F. Renshaw, Douglas Kondo Jan 2014

Relationship Between Altitude And Lithium In Groundwater In The United States Of America: Results Of A 1992–2003 Study, Rebekah S. Huber, Namkug Kim, Carl E. Renshaw, Perry F. Renshaw, Douglas Kondo

Dartmouth Scholarship

Therapeutic dosages of lithium are known to reduce suicide rates, which has led to investigations of confounding environmental risk factors for suicide such as lithium in groundwater. It has been speculated that this might play a role in the potential relationship between suicide and altitude. A recent study in Austria involving geospatial analysis of lithium in groundwater and suicide found lower levels of lithium at higher altitudes. Since there is no reason to suspect this correlation is universal given variation in geology, the current study set out to investigate the relationship between altitude and lithium in groundwater in the United …

Institutional Response To The Changing Legal Environment Regarding Student Safety: A Multi-Campus Case Study, Joy Blanchard Jan 2014

Institutional Response To The Changing Legal Environment Regarding Student Safety: A Multi-Campus Case Study, Joy Blanchard

Kentucky Journal of Higher Education Policy and Practice

Confusion regarding liability for student safety and whether federal regulations prohibit information sharing have become a concern on campuses. Do current policies mitigate liability yet still serve the best interest of students? Based on interviews of nearly 30 administrators at three campuses in 2008 and 2011, this case study examines the legal considerations used when responding to such concerns, particularly alcohol and mental health. Organizational capacity and culture structure are discussed; recommendations for practice are provided.

The Inclusive Dynamics Of Islamic Universalism: From The Vantage Point Of Sayyid Qutb's Critical Philosophy, Andrea Mura Jan 2014

The Inclusive Dynamics Of Islamic Universalism: From The Vantage Point Of Sayyid Qutb's Critical Philosophy, Andrea Mura

Comparative Philosophy

This article pursues a topological reading of Milestones, one of the most influential books in the history of Islamism. Written by Muslim thinker Sayyid Qutb, the general interest in this crucial text has largely remained restricted to the fields of Islamic Studies and Security Studies. This article aims to make the case for assuming a philosophical standpoint, relocating its significance beyond the above-mentioned fields. A creative and topological reading of this text will allow the spatial complexity of Qutb’s eschatological vision to be fully exposed, while also unpacking the way in which antagonistic relations have variously been articulated by this …

The Four Townships Area Economic, Housing, And Development Survey, Engin Sungur Phd, Kelly Asche, David Fluegel, Reid Ronnander, Jacob Bibeau, Meara Hove

Center for Small Towns

Statistics Professor Engin Sungur and student researcher Reid Ronnander collected all publicly available data relating to the four townships region and developed a comprehensive report. Phase two of the project included the development, implementation and analysis of a survey that measured the economic and demographic information, as well as development opinions of the region. This information also led to the development of a seasonal and permanent resident profile to help better explain the similarities and differences between the two types of populations. Lastly, property tax information was gathered to assess how much the two types of residents were paying in …

Linking Research And Teaching: Context, Conflict And Complementarity, W Pan, D Cotton, P Murray Jan 2014

Linking Research And Teaching: Context, Conflict And Complementarity, W Pan, D Cotton, P Murray

Plymouth Institute of Education

Although research and teaching have often been regarded as complementary in enhancing the quality of student learning, little previous research has explored the conflicts associated with linking the two activities. This paper aims to examine specific issues arising within the environmental building disciplines at a UK university, and to explore strategies for achieving optimal research-teaching links. The results reveal that research-teaching linkages within these disciplines were interrelated and dynamic, but could be controversial, evidenced in coexisting multifaceted conflicts and complementarities. The research pointed towards a number of potential strategies for achieving optimal research-teaching linkages. In particular, it is critical to …

Impact Of Rural Infrastructure On Farm And Non-Farm Enterprise Choice And Income In Bangladesh, S Rahman Jan 2014

Impact Of Rural Infrastructure On Farm And Non-Farm Enterprise Choice And Income In Bangladesh, S Rahman

School of Geography, Earth and Environmental Sciences

Impact of rural infrastructure on economic development is indirect and complex. The present study jointly determines the impact of rural infrastructure on the decision to choose between farm and non-farm enterprises vis-à-vis income by Bangladeshi rural households (4,195 households from 139 villages) using a bivariate Tobit model. The model diagnostic reveals that the decision to choose enterprises is significantly correlated, justifying use of a bivariate approach. Rural infrastructure has a significant but opposite impact on enterprise choices vis-àvis income. Other major determinants with varying level of influences are farm size, livestock resources, education, farming experience and household assets. However, female-headed …

Molluscs From A Shallow-Water Whale-Fall And Their Affinities With Adjacent Benthic Communities On The Swedish West Coast, S Danise, S Dominici, Ag Glover, Tg Dahlgren Jan 2014

Molluscs From A Shallow-Water Whale-Fall And Their Affinities With Adjacent Benthic Communities On The Swedish West Coast, S Danise, S Dominici, Ag Glover, Tg Dahlgren

School of Geography, Earth and Environmental Sciences

We conducted a species-level study of molluscs associated with a 5-m long carcass of a minke whale at a depth of 125 m in the Kosterfjord (North Sea, Sweden). The whale-fall community was quantitatively compared with the community commonly living in the surrounding soft-bottom sediments. Five years after the deployment of the dead whale at the sea floor, the sediments around the carcass were dominated by the bivalve Thyasira sarsi, which is known to contain endosymbiotic sulphur-oxidizing bacteria, while background sediments were dominated by another thyasirid, T. equalis, less dependent on chemosynthesis for its nutrition. The Kosterfjord samples were further …
