Does death row incarceration for upwards of thirty years or more impermissibly impose the suffering of additional punishment or permissibly bestow the benefit of death delayed and thus the enjoyment of life extended? Most commentators conceive of it as an unconstitutional additional punishment that is either cruel and unusual or disproportionally excessive. Most courts construe it as a constitutional nonpunishment that the death row prisoner opts for and benefits from. Sparking a long-running debate at the Supreme Court, Justices Stevens and Breyer view prolonged death row incarceration as unconstitutional additional punishment. The effects of forest management on soil carbon (C) and nitrogen (N) dynamics vary by harvest type and species. We simulated long-term effects of bole-only harvesting of aspen (Populus tremuloides) on stand productivity and interaction of CN cycles with a multiple model approach. Five models, Biome-BGC, CENTURY, FORECAST, LANDIS-II with Century-based soil dynamics, and PnET-CN, were run for 350 years with seven harvesting events on nutrient-poor, sandy soils representing northwestern Wisconsin, USA. Twenty CN state and flux variables were summarized from the models' outputs, and statistically analyzed using ordination and variance analysis methods. Effective plant conservation includes addressing basic needs such as information about species distribution and rarity; research, management, education, and training capacity to mitigate threats facing threatened species; policy and funding to support continued capacity and conservation; and, ultimately, a public that understands and supports the importance of plants and the need for their conservation. Coordination of plant conservation efforts is also needed to ensure that resources and expertise are used in a strategic, efficient, and effective manner.We argue that no country is currently getting plant conservation right; plants are becoming increasingly rare around the world. Employment discrimination claimants in general, and racial minority claimants in particular, disproportionately lack access to legal counsel. When employment discrimination claimants lack counsel, they typically abandon their claims, or if they pursue their claims, they do so pro se (without counsel), a strategy that is seldom successful in court. Access to counsel is, hence, a decisive component in whether employment discrimination victims realize the potential of civil rights enforcement. Psychological science analyzes access to counsel by identifying psychological barriers—such as threatened social identity, mistrust in legal authorities, and fear of repercussions—that prevent employment discrimination victims from pursuing counsel. Urban transportation professionals are under increasing pressure to perform data-driven decision making and to provide data-driven performance metrics. This pressure comes from sources including the federal government and is driven, in part, by the increased volume and variety of transportation data available. This sudden increase of data is partially a result of improved technology for sensors and mobile devices as well as reduced device and storage costs. However, using this proliferation of data for decisions and performance metrics is proving to be difficult. Significant harms raise the question of whether victims stand in truly reciprocal practices of accountability; if they do, they enjoy the power of calling others to account as well as bearing the liability of being accountable to others. When questions are raised regarding a law firm attorney’s representation of a firm client, the questioned attorney often wishes to seek legal counsel. A conferral will often benefit the attorney, the firm and the client. Conferences regarding questioned conduct should be encouraged, not discouraged. To encourage these beneficial conferrals, a broad attorney-client communication privilege and a broad work product protection (or privilege) should be available. Availability should not be dependent upon whether in-house, outside or other legal counsel are employed. Did Schelling Misunderstand Fichte’S Transcendental Method?, Michael Vater

The Fichte-Schelling Correspondence interweaves intriguing personal stories and philosophical combat. One of the sadder personal stories involves Schelling getting wind of Fichte’s remark to Friedrich Schlegel that he did not understand transcendental method. The letters document several clumsy attempts by Fichte to minimize the criticism only to have it surface again in a letter Fichte wrote to a former student, Jean Baptiste Schad, who showed the letter to Schelling. In it, Fichte claimed that Schelling understood Wissenschaftslehre no better than Friedrich Nicolai, whom Fichte had publicly excoriated for critiquing as “I-philosophy” a superficial assemblage of random quotes from mixed sources.

The improvement and utility of crosslinkers are important topics of molecular imprinting. Crosslinker significance is evident when molecularly imprinted polymer (MIP) composition related to performance as separation media is examined. Crosslinkers account for the bulk of MIP formulations made through traditional imprinting (80-90%) and is even greater when the One Monomer Molecularly Imprinted Polymer (OMNiMIP) approach is utilized (100%.) It is not surprising that alteration of the bulk component will result in different separation performances. The primary purpose of this study was to examine the impact of postsecondary transition programs on the college self-efficacy beliefs of first-generation college students. Postsecondary transition programs were developed to address the challenges that all first-time freshmen face, including all first-generation students. Obesity has become a widespread concern to human health largely over the past three decades. It is thought that obesity is associated with the over consumption of calorically dense diets. The rewarding value of food is mediated through the mesolimbic dopamine system, though is less understood how appetitive control circuits relay information to existing reward circuitry. The adiposity signaling hormone, leptin, is a critical mediator of food intake and fat storage. Grateful patient fundraising, defined as the solicitation of philanthropic donations by health care providers from current and former patients, raises a number of legal and ethical issues. Elsewhere, I detailed the confidentiality issues raised by the use and disclosure of patient identifiable information by hospital development officers, major gifts officers, institutionally-related foundations, and commercial fundraisers, and proposed corrections to federal health information confidentiality regulations to better balance the competing aims of health care philanthropy and health information confidentiality. In this dissertation, novel fluorescent materials, which are referred to as a group of uniform materials based on organic salts (GUMBOS) are synthesized, characterized, and studied for different applications. GUMBOS are solid state organic salts having melting points from 25°C to 250°C. Similar to ionic liquids, GUMBOS are highly tunable and can be designed for specific applications by incorporating multiple-functions into a single ion pair by selection of cation-anion combinations. Until the late twentieth century, courses in voice and diction were a staple of the field of communication studies. Increasingly these classes are disappearing from departments around the country, largely over concerns regarding the prescription of strict speech standards. At the same time, an interest in vocal training has increased in BFA and MFA actor training programs.
