Lincoln's Legacy For American International Law, Antonio F. Perez Jan 2014

Lincoln's Legacy For American International Law, Antonio F. Perez

Emory International Law Review

Is the United States, as an international actor, different from all other international actors? If so, how is it different? What makes it different? How does American sovereignty fit into a larger conception of international law? These questions go back to the beginning of the Republic, and they remain pressing today. Many have debated this question in terms of the legacy of the Founding. Some find in the Founding the seeds of multilateralism and perhaps even cosmopolitanism; others, rejecting this interpretation, advance a nationalist and unilateralist account of the Founding. But the Founding is not the whole story.

Sinister Translations: Law's Authority In A Post-9/11 World, Jothie Rajah Jan 2014

Sinister Translations: Law's Authority In A Post-9/11 World, Jothie Rajah

Indiana Journal of Global Legal Studies

What does the killing and burial of bin Laden tell us about the sites, sources, and nature of law's authority in a post-'9/11' world?1 If law is constituted by "acts of language [that] are actions in the world,'2 then the law embodied by these events is discernible through an analysis of Obama's announcement on the killing of bin Laden. Obama's announcement avoids the term 'law' yet makes present the relationship between 'law,' justice,' legitimacy, and violence. Through critical theory on language, translation, and political myth, this paper explores the translations at work in constructing law's authority for a post-9/11 world. …

Reconstruction Of Recent And Palaeo Sea Ice Conditions In The Barents Sea, Alba Navarro-Rodríguez Jan 2014

Reconstruction Of Recent And Palaeo Sea Ice Conditions In The Barents Sea, Alba Navarro-Rodríguez

School of Geography, Earth and Environmental Sciences Theses

IP25 is a highly branched isoprenoid alkene derived from certain Arctic sea ice diatoms that, when detected in marine sediments, has been used as a proxy for past Arctic sea ice over the last decade. In the current study, the structure of this biomarker was determined following large-scale extraction from sediment material collected from the Canadian Arctic. After purification, the structure of IP25 was confirmed by NMR spectroscopy as being the same as that of a laboratory standard. The purified IP25 was subsequently used to obtain a quantitative (GC-MS) instrumental response factor that could be used to improve the future …

Determinants Of State Level Support For The Patient Protection And Affordable Care Act, David Brockington Jan 2014

Determinants Of State Level Support For The Patient Protection And Affordable Care Act, David Brockington

School of Law, Humanities and Social Sciences

What accounts for variance in public opinion support for the PPACA? The political science (and social science in general) literature is relatively sparse on this question. This paper suggests that state level support for the PPACA has a largely political, rather than economic, motivation. Multivariate models are estimated, with support measured at the state level using 2010 data from Gallup; explanatory variables (per capita where necessary) include uninsured percentage, change in uninsured, unemployment, Medicaid recipients, state GDP, poverty rate, percents African- American and Latino, and the state PVI. A bivariate relationship is counter-intuitive; as the rate of uninsured in a …

Government Procurement In The United States– Korea Free Trade Agreement: Great Opportunities For Both Sides?, Hong-Sik (Justin) Chung Jan 2014

Government Procurement In The United States– Korea Free Trade Agreement: Great Opportunities For Both Sides?, Hong-Sik (Justin) Chung

Northwestern Journal of International Law & Business

Abstract: The Free Trade Agreement entered into between the United States and the Republic of Korea (KORUS FTA) contains government procurement provisions in Chapter 17. Although each respective procurement market has already been opened to the other party under the WTO Government Procurement Agreement, this access has been very limited, not only because the market has traditionally been exclusive against foreign suppliers, but also because there were several preferential regulations and policies for domestic firms in the course of awarding procurement contracts. This Article analyzes how Chapter 17 of the KORUS FTA expands upon the WTO Government Procurement Agreement with …

Targeted Social Transparency As Global Corporate Strategy, Stephen Kim Park Jan 2014

Targeted Social Transparency As Global Corporate Strategy, Stephen Kim Park

Northwestern Journal of International Law & Business

Recent years have seen the emergence of mandatory disclosure regimes under U.S. federal securities law with the express purpose of advancing geographically defined, issue-specific social policy objectives, which I collectively refer to as “targeted social transparency” (TST) regimes. This Article addresses the appeal and shortcomings of mandatory disclosure as a means of regulating global corporate conduct—focusing on the unique challenges posed by TST. Two contemporary examples of TST are analyzed: (i) the “conflict minerals” provisions in the Dodd-Frank Act, which require the disclosure of minerals whose mining is associated with human rights violations in the Democratic Republic of Congo; and …

Emerging Issues: The Underlying Economics Of The South China Sea Conflict, Christopher Stock Jan 2014

Emerging Issues: The Underlying Economics Of The South China Sea Conflict, Christopher Stock

University of Baltimore Journal of International Law

The countries of southeastern Asia and China are currently in a territorial dispute over the Spratly and Paracel island chains in the South China Sea. The South China Sea encompasses roughly 1.4 million square miles of the Pacific Ocean, spanning throughout most of southeastern Asia. A majority of the islands located within the sea are uninhabited and have never had an indigenous population, which makes it nearly impossible to track the lineage to determine sovereignty over the islands. Because there has never been an indigenous population on a majority of the islands, there are now competing claims for many of …
