The Marrow Of Tradition: The Roberts Court And Categorial First Amendment Speech Exclusions, Gregory P. Magarian

INTRODUCTION The Roberts Court has made a lot of First Amendment law. Since Chief Justice John Roberts took the Supreme Court’s helm in 2006, the Court has issued decisions on the merits in about thirty-five free speech cases. With greater vigor than the late Rehnquist Court, the present Justices have waded into free speech controversies ranging from violent video games to commercial speech to campaign fi- nance regulation. In all those areas, the Court has handed import- ant victories to First Amendment claimants. Free speech advocates’ conventional (not to say universal) view of this Court is adoring. Environmental And Genetic Risk Factors For Bronchopulmonary Dysplasia In Neonates, Jessica Berger

We hypothesized that early intubation would decrease the hazard of BPD and BPD/death in premature infants regardless of need for reintubation. Specific aims included assessing rates of BPD and BPD/death in infants first extubated between day of life (DOL)1-3 versus 4-7, 8+ and impact of re-intubation. We included infants with gestational age ≤28weeks, birth weight ≤1000g, and intubation on DOL1. Proportional hazards regression modeled time to BPD and BPD/death, adjusting for potential confounders. Of 262 infants, 101 (38.55%), 41 (15.65%) and 120 (45.80%) were extubated between DOL1-3, 4-7, and 8+, respectively. Extubation between DOL4-7 versus DOL1-3 was associated with an …

Extracorporeal photochemotherapy (ECP) is a cellular therapy that is FDA approved for the treatment of a variety of T cell mediated diseases, including cutaneous T cell lymphoma, graft-versus-host disease, and solid organ transplantation rejection. Its ability to selectively suppress and stimulate immunity while causing minimal to no side effects in patients distinguishes it from other therapies including pharmacologic agents. Despite the clinical success of ECP, the exact mechanism by which ECP generates immunotolerance and immunogenicity in patients has been elusive. Langerhans Cell Contributions To Ultraviolet Light-Induced Cutaneous Carcinogenesis, Marianna Freudzon

Epidermal dendritic cells, called Langerhans cells (LC), were recently shown to facilitate DMBA/TPA-induced chemical carcinogenesis. LC contribution to UV-induced carcinogenesis, however, remains to be elucidated. We used the Langerin-DTA transgenic mouse model that lacks LC to characterize early and late effects of DNA damage in epidermis following exposure to UVB light. We found that LC density in LC-intact mice remains unchanged at 1hr and 24hr post 100 J/m2 UVB, suggesting that LC are poised to affect the surrounding epidermal cells following acute low-dose UVB exposure. During this time interval, LC-deficient mice had significantly fewer γH2Ax-positive cells within the epidermis, indicative …

Alterations in membrane capacitance can arise from linear and nonlinear sources. For example, changes in membrane surface area or dielectric properties can modify capacitance linearly, whereas sensor residues of voltage-dependent proteins can modify capacitance nonlinearly. Cancer continues to be a highly prevalent and lethal disease, despite significant advances in understanding tumor biology and developing new chemotherapies. Major obstacles in cancer chemotherapy are drug resistance and systemic toxicities. Potential strategies for addressing these problems include delivering combination therapies to overcome drug resistance, and utilizing synergistic agents to minimize dosing and subsequently drug toxicity. In turn, delivery can also be optimized to target the tumor site and consequently minimize systemic side effects. Polymer nanocarriers are gaining interest as vehicles for cancer therapeutics for their abilities to not only deliver multiple agents, but also target the tumor itself. …

Background: MicroRNAs (miRNAs) are important post-transcriptional regulators which control growth and development in eukaryotes. The cestode Echinococcus granulosus has a complex life-cycle involving different development stages but the mechanisms underpinning this development, including the involvement of miRNAs, remain unknown. Results: Using Illumina next generation sequencing technology, we sequenced at the genome-wide level three small RNA populations from the adult, protoscolex and cyst membrane of E. granulosus. A total of 94 pre-miRNA candidates (coding 91 mature miRNAs and 39 miRNA stars) were in silico predicted. The U.S. Constitution imposes three key limits on the design of federal agencies. It constrains how agency officers are appointed, the extent of their independence from the President, and the range of issues that they can decide. Scholars have trumpeted the importance of these safeguards with soaring rhetoric. And the Supreme Court has permitted regulated parties to vindicate these safeguards through implied private rights of action under the Constitution. Regulated parties, for their part, have been successfully challenging agency structure with increased frequency. There is a disconnect between how legal and sporting authorities, on the one hand, and many elite athletes, on the other, view the use of performance-enhancing substances. While official and popular narratives portray the use of these substances as isolated examples of deviant behavior, to the elite athletes who daily push their bodies beyond societally normal limits of pain and risk, enhancement is oftentimes an accepted part of the job. As a result, efforts to regulate and detect athletes’ use of these substances have consistently captured only a small fraction of the use that exists.

Animal law is a little-known subject in Singapore. However, the increase in public awareness and concern about animal welfare issues demand that more attention is directed at the legal aspects of such issues. An opportunity to examine this area of the law arose in the case of Ling Chung Yee Roy. The District Court, presided by District Judge Ng Peng Hong, had to decide whether the accused was guilty of an animal cruelty offence under s. 42(1)(e) of the Animals and Birds Act. In this article, I criticize what I call “ambiguous geographical origin” in the concept of geographical indications of origin (GIs) and note that the current definition of GIs in Art. 22(1) of TRIPS essentially misuses, or at least misinterprets, of the terms “geographical origin.” More specifically, I expose the partial inconsistency between the legal definition under TRIPs and the dictionary definition of the terms “geographical” and “origin”. The remnants of the wetland reclamation era of the early 1900s are visible in the leveed, drained, and failed impoundments across the United States, and especially in coastal regions. The common themes of their history are flooding, restoration, and – sometimes - community resilience. The physical changes occurring during and after impoundment, and after failure includes subsidence, erosion, and flooding are well-documented. Here I construct an environmental history that integrates data on these physical changes with archival records, historical documents, site visits and personal interviews. This study analyzes the rates at which students in their undergraduate years alter their career aspirations within the medical field. Additionally, it investigates the causes of this change. Primary data was collected through a survey e-mailed to all Grand Valley State University Allied Health Sciences and Biomedical Sciences majors, while additional personal anecdotes were gathered through one on one interviews. All information was compared along traditional, binary gender lines to determine if differences exist between males and females. This study found, while males and females experience similar overall rates of career goal change, women alter their career goals to professions …

Models and representations help us understand complex phenomena. The Mercator map presents a familiar, two-dimensional view of our three-dimensional world, for example, but it can distort as much as it clarifies. In the natural sciences, too, there are very different ways of framing reality. The classic method developed by Leonard Euler measures a system from a fixed point. A competing method developed by Joseph Louis Lagrange measures from the perspective of a particle moving within the system. These Eulerian and Lagrangian methods of measurement dominate the physical sciences and provide different, though equally valid, measures of how the system operates. …

The Supreme Court’s interpretation of the Recess Appointments Clause in NLRB v. Noel Canning stands as one of the Supreme Court’s most significant endorsements of the relevance of “historical gloss” to the interpretation of the separation of powers. This Article uses the decision as a vehicle for examining the relationship between interpretive methodology and historical practice, and between historical practice and textual ambiguity. As the Article explains, Noel Canning exemplifies how the constitutional text, perceptions about clarity or ambiguity, and “extra-textual” considerations such as historical practice operate interactively rather than as separate elements of interpretation. The greenhouse gas methane mainly regulated by microbial processes. Methanogenic archaea, a major biological source of methane, are a diverse group of organisms that produce methane as a metabolic byproduct. The generation of methane takes place in diverse anoxic environments using CO2 and other reduced substrates. The release of methane into oxic environments often is regulated by methanotrophic Proteobacteria and Archaea, specialized groups of bacteria that use methane as sole sources of carbon and energy. These organisms can play major roles in the regulation of methane transport into the atmosphere and make up one part of the methane cycle. Pools …

As one of the most valued and treasured natural resources, today many lakes in the world face degradation of their water quality due to nutrient enrichment, toxic contamination, and hydrological modification from their drainage areas. Among various water quality impairments, dissolved oxygen (DO) depletion is often a leading stressor in lake systems. The population of Bald Eagles (Haliaeetus leucocephalus) nesting in Louisiana reached precariously low numbers in the early 1970’s, and although the population has since increased markedly, resident eagles remain a species of conservation concern in Louisiana. Using statewide aerial nest survey data from 1975–2008, I documented the history and quantified the recovery of the nesting population in Louisiana. Known active nests increased exponentially from 7 to 387 during this period, exhibiting a mean annual rate of increase of 11.1 ± 0.3% per year with no indications of slowing. By 1990, the nesting population in Louisiana had exceeded all goals of …

Asthma is defined as the chronic inflammation of the large airways that is characterized by reversible airflow obstruction and airway hyper-responsiveness. On the other hand, Chronic Obstructive Pulmonary Disease (COPD) is a chronic inflammation that is marked by progressive and irreversible airflow obstruction. Both conditions are manifested by symptoms of wheezing, coughing, and shortness of breath. Similarity in symptoms between these two conditions could lead to misdiagnosis and mistreatment. Although inflammation is present in both conditions, there are some marked differences. BACKGROUND AND AIMS: Although urban gardens provide opportunities for pollinators in an otherwise inhospitable environment, most garden plants are not native to the recipient biogeographical region and their value to local pollinators is disputed. This study tested the hypothesis that bumblebees foraging in English urban gardens preferentially visited sympatric Palaearctic-range plants over species originating outside their native range. METHODS: Twenty-seven surveys of flower availability and bumblebee visitation (Bombus spp.) were conducted over a 3-month summer period. Plants were categorized according to whether they were native British, Palaearctic or non-Palaearctic in origin. A phylogeny of the 119 plant species recorded was …
