Across the animal kingdom it has been observed that outcomes of conflicts are influenced by past experiences, whereby previous winners are likely to keep winning and losers are likely to lose again. These so-called “winner and loser effects” are hypothesized to result from factors such as information acquisition and endocrine responses following the initial bouts. This paper applies the understanding of this phenomenon to a novel domain: patterns of winning and losing in Major League Baseball (MLB) double headers. Litigation often pivots on the testimony of fact witnesses. Unfortunately, serving as a witness may take people away from their jobs or interrupt their lives. It is therefore understandable that fact witnesses may want to be paid for devoting time to litigation.

It was once the rule that fact witness compensation was limited to statutory witness fees. A wide array of questions arises from global change to confront environmental law. The IPCC has examined social decisions affecting the climate in the design of human settlements, transport systems, industrialisation, agriculture and silviculture, waste management, provisions for energy, and virtually all other socio-economic dimensions of human life. The AR-5, too, cannot avoid raising issues of human ethics and values at local and regional scales. Such issues reach environmental policy and law directly. The IPCC’s AR-5 report furthers widespread public debate about the human dimensions of climate change, and how social theory relates to environmental change. Already, climate change has …

Carnivores substantially impact humans, but are elusive and difficult to monitor. Although less precise than intensive methods (e.g., capture-recapture), indices of relative abundance are widely used to monitor carnivore numbers. This study assessed public sightings and hunter surveys as approaches to monitoring the distribution and relative abundance of bobcats (Lynx rufus) in New Hampshire. To validate indices, I used a telemetry-based model of habitat suitability and information from camera surveys conducted by volunteers in three study areas. In cattle sub-acute inflammatory disorders are difficult to assess because visual symptoms of diseases are not easily detectable with large numbers of dairy cattle in loose housing. In addition, inflammation is not always followed by leukocytosis in cattle, which makes the use of common blood tests like total white blood cell counts less reliable as a diagnostic tool. More sensitive and objective methods are needed to evaluate health status. The Ipswich River Watershed, a 401 km2 watershed located in northeastern Massachusetts, has been observed to be undergoing increasing urbanization with resulting increases in nutrient loading, in particular, nitrogen. Nitrogen uptake occurs in a 1st-order process which is dependent on the concentration of nitrogen as well as the amount of time the water containing nitrogen remains within the wetland, which is described as the residence time distribution (RTD). During the winter months in the northern hemisphere, above 40 degrees latitude, a freezing event occurs that can last several months. Some lakes may have large portions of the shallow littoral zone frozen completely solid down into the sediments. Invertebrates affected by these events have developed survival strategies to cope with the harsh environment. The two main strategies for invertebrates in these areas are to either migrate to a different area and recolonize the original area when it becomes available again, or to burrow into the sediments and withstand the freezing. Scientific visualization can be viewed as a subset or a type of data visualization in which the data can be mapped to a geometric shape or spatial coordinate system. Geovisualization is a type of scientific visualization in which the data represented are earth data (e.g., bathymetry). Immunohistochemical Localization Of The Neuropeptide Rfamide In The Hypostomal Nerve Net Of Hydra Vulgaris, Bailey Munro

This study examined the distribution and localization of the neuropeptide arginine-phenylalanine-amide (RFamide) in the hypostomal and tentacular nerve net of the cnidarian polyp Hydra vulgaris. Immunohistochemical techniques were used to visualize three RFamide-positive distinct nerve ring structures, nerves and neurites throughout the ectoderm of the hypostome and tentacles of ablated hypostomes. Two RFamide-positive circumhypostomal nerve rings are reported here: an inner ring located near the mouth and an outer ring located beneath the tentacle attachment sites. Both rings are consistent with rings labeled with anti-α-tubulin; the outer ring is also coincident with a GABAB receptor-antibody-labeled ring previously described …

Physical disruption of cellular membranes arising from interactions with engineered nanoparticles is an important, but poorly understood aspect of nanotoxicology and nanomedicine. Model cellular membranes (i.e. lipid bilayers) can be used to identify interaction mechanisms, and most studies have largely focused on lipid bilayers supported on solid planar or spherical substrates. While useful and informative, these systems do not accurately represent an intact cell membrane because they restrict the elastic motion of the bilayer and the capacity for mechanical changes. The overall survival rate for patients diagnosed with lung cancer is still extremely low and many affected patients are not eligible for first-line treatments such as surgery, chemotherapy, and radiation for the treatment due to the severe side effects associated with these therapies. Paclitaxel (PTX) along with imatinib mesylate are currently first-line therapies for many types of cancer (Kelly 2001, Schiller 2002). Despite concerns that the Louisiana Pine Snake (Pituophis ruthveni) has been extirpated from large portions of its historic range, only a limited number of studies on their movement patterns have been published. Winter movement patterns are of particular interest since it has been hypothesized that impacts of management practices would be reduced during the winter. Using radiotelemetry, we determined winter movement patterns of Louisiana Pine Snakes (11 males, 8 females) in 5 study areas (2 in Louisiana and 3 in Texas). Judge Richard Posner's well-known view is that constitutional theory is useless. And Judge J Harvie Wilkinson III has lambasted constitutional theory for the way in which its "cosmic" aspirations threaten democratic self-governance. Many other judges hold similar views. And yet both Posner and Wilkinson-in the popular press, in law review articles, and in books-have advocated what appear to be their own theories of how to judge in constitutional cases. Judicial pragmatism for Posner and judicial restraint for Wilkinson seem to be substitutes for originalism, living constitutionalism, political process theory, and so on. Over the past few decades, as corporate criminal liability rules, sentencing guidelines, and settlement incentives have changed, there has been increased emphasis on and resources devoted to the compliance function at large publicly held companies. In this article, Professor DeStefano traces the development of the compliance function at large corporations and questions the recent mandate by certain governmental entities that malfeasant corporations designate a chief compliance officer and separate the compliance gatekeeping function from the legal department so that this chief compliance officer does not report to the general counsel. As of 2005, about 80,000 prisoners were housed in solitary confinement in jails and in state and federal prisons in the United States. Prisoners in solitary confinement are generally housed in a cell for twenty-two to twenty-four hours a day with little human contact or interaction. The number of prisoners held in solitary confinement increased 40 percent between 1995 and 2000, in comparison to the growth in the total prison population of 28 percent. Concurrently, the duration of time that prisoners spend in solitary confinement also increased: nationally, most prisoners in solitary confinement spend more than five years there. The …

The abuse of methylenedioxymethamphetamine (MDMA) during pregnancy is of concern. MDMA treatment of rats during a period of brain growth analogous to late human gestation leads to neurochemical and behavioral changes. MDMA from postnatal day (P)11–20 in rats produces reductions in serotonin and deficits in spatial and route-based navigation. In this experiment we examined the impact of MDMA from P11 to P20 (20 mg/kg twice daily, 8 h apart) on neuronal architecture. Golgi impregnated sections showed significant changes. In the nucleus accumbens, the dendrites were shorter with fewer spines, whereas in the dentate gyrus the dendritic length was decreased but …

Objectives: The purpose of this investigation was to determine what effect a bilateral strength training regimen has on isometric force production symmetry and if changes in force production symmetry can be accounted for by differences in pre-intervention strength levels. Design: Sixteen recreationally trained males (1-RM squat: 146.8 ± 23.0 kg.) were assigned to two groups for the 7-week training intervention: strong (S) and weak (W) based on pre-training squat isometric peak force allometrically scaled (IPFa) at 120° knee angle. The purpose of this article is make connections between two content areas, reading and writing, which have traditionally been separated and consider the relationship between their theoretical underpinnings. Based on their reciprocal nature, the authors posit that students could greatly benefit by reading and writing being taught simultaneously. Relying on this premise, this article provides the reader with three practical strategies that could be applied in the literacy classroom to intertwine reading and writing. These practical strategies include: classroom blogs, graphic depictions, and pen pal responses to literature.
