The applicable international legal framework for the governance of marine genetic resources from areas beyond national jurisdiction is difficult to sort out- at best, it is unclear under which regime such resources fall, and at worst, there is no applicable regime. Despite the ambiguity, the bioprospecting of these resources is ongoing and increasingly being undertaken for commercial purposes. It follows that intellectual property claims, such as patents on inventions and copyrights on publications describing discoveries, are being sought in relation to inventions and publications deriving from these bioprospecting efforts. As a result, nation states are raising important questions regarding the …

Renewable energy is an increasingly important topic in today's global world and marketplace. This Comment analyzes the current World Trade Organization plan for addressing renewable energy and proposes an alternate solution to that plan modeled on the Agreement on Agriculture. This Comment notes how, with the present lack of a specific WITO agreement on renewable energy, these subsidies must be treated like all other industrial subsidies, despite their environmental benefits. Current WUTO exceptions for environmentally beneficial programs require relatively pure environmental motives in order to be exempt, and thus do not embrace subsidies with a developmental focus. High water quality and natural buffers exist on Kingswood Lake located in Brookfield, New Hampshire. A comprehensive lakes inventory (CSI) was recorded and health of the land, wildlife, and waterways were observed. Educational outreach was taken to inform the local community and to instruct them on proper stewardship of the land. A completed watershed management plan was constructed including key recommendation of limiting nitrogen loading in the area, checking septic systems for leaching, stabilizing shoreline from erosion, and establishing man-made rain gardens to help preserve water quality. Will bundling savings accounts with loans increase the effectiveness of microfinance as a tool for alleviating poverty? Microfinance is the practice of offering small loans to poor people in developing countries. The development of this practice into a poverty dimishining, self-sustaining business won Muhammad Yunus a Nobel Prize in 2006. Today, there are thousands of microfinance institutions (MFIs) serving millions of people in developing countries. However, there is recent evidence that these loans do not help reduce poverty, and may do as much ahrm as good.

Soft-tissue fossils capture exquisite biological detail and provide our clearest views onto the rise of animals across the Ediacaran-Cambrian transition. The processes contributing to fossilization of soft tissues, however, have long been a subject of debate. The Ediacaran Gaojiashan biota displays soft-tissue preservational styles ranging from pervasive pyritization to carbonaceous compression, and thus provides an excellent opportunity to dissect the relationships between these taphonomic pathways. Here geochemical analyses of the Gaojiashan fossil Conotubus hemiannulatus show that pyrite precipitation was fuelled by the degradation of labile tissues through bacterial sulfate reduction (BSR). Cutaneous melanoma is the sixth most common cancer in the United States, and its incidence continues to rise steadily at a rate of 2-3% per year. Meanwhile nearly 11% of the general population is treated with antidepressant medication. Laboratory studies suggest a number of theoretical links between antidepressants and melanoma. Serotonin is a growth factor for melanocytes, and antidepressants upregulate components of the Wnt/beta-catenin, mTOR, and MAP kinase signaling pathways, all …

Despite the rise in percutaneous interventions, bypass surgery is an essential therapy for patients with advanced coronary and peripheral artery disease. Nearly half of the saphenous vein grafts used in these operations are eventually complicated by pathologic remodeling known as neointimal hyperplasia (NIH). Recent work in animal models has shown that the development of NIH can be reduced by stimulation of the receptor tryrosine kinase Eph-B4 by systemic injections of its ligand ephrin-b2. The purpose of this study was to determine whether the reduction of intimal hyperplasia observed with Eph-B4 stimulation in animal models translated into human tissues. Specifically we …

As the United States and Europe have progressed to the issue of same-sex marriage, countries that are still working through antecedent issues, such as the decriminalization of anti-sodomy laws, are regarded by international gay rights advocates as lagging behind the times. This often leads to pressures from the Western-dominated international community for reform. Responding to a changing landscape of law practice, law schools are searching for ways to structure the classroom experience and broader curriculum to promote more efficient and better learning outcomes. Although imitation, modeling, and the use of examples have become pre-eminent features of modern legal education, these pedagogies have remained largely unexamined. This article shows the power of teaching with examples in both the traditional and legal writing classroom, as well as how skillfully to limit the use of such pedagogy for maximum effect. We might not need another article decrying the doctrine/skills dichotomy. That conversation seems increasingly old and tired. But like it or not, in conversations about the urgent need to reform legal education, the dichotomy’s entailments confront us at every turn. Is there something more to be said? Perhaps surprisingly, yes. We teach our students to examine language carefully, to question received categories, and to understand legal questions in light of their history and theory. Yet when we talk about the doctrine/skills divide, we seem to forget our own instruction.

The rich mountain of Potosí, with its famed silver mines, has commanded the attention of Europeans, creoles (Americans of Spanish descent), and indigenous Andeans since the Spanish colonizers of Peru were made aware of its existence in 1545. Soon after its discovery, the rich mountain was represented in a variety of written and visual texts created by writers and artists from the Andes, Spain, and other parts of Europe. Independent of its physical form, in these representations the rich mountain assumed a discursive meaning, functioning as an icon that, depending on the context, represented abstract ideas of wealth, immorality, dominance, …

Summary: While rising global temperatures are increasingly affecting both species and their biotic interactions, the debate about whether global warming will increase or decrease disease transmission between individuals remains far from resolved. This may stem from the lack of empirical data. Using a tractable and easily manipulated insect host-pathogen system, we conducted a series of field and laboratory experiments to examine how increased temperatures affect disease transmission using the crop-defoliating pest, the fall armyworm (Spodoptera frugiperda) and its species-specific baculovirus, which causes a fatal infection. Recent studies find that pterostilbene (PTS) exhibits more favorable drug properties and similar chemopreventive effects to its structural analogue resveratrol (RSV). However, few studies describe the activity of PTS in prostate cancer (PCa). Here, we conducted cell count experiments to assess the effects of PTS on metastatic PCa cell viability and to compare the potency of PTS to RSV in this respect. We also performed experiments to assess the effects of PTS on the androgen receptor (AR) and AR-mediated events. The high stress level placed upon medical school students, particularly during their first and second didactic years, may have a negative effect on their health. Although surveys and subjective questionnaires have been used to evaluate the effects medical school has upon a student’s cardiovascular health, there has been little clinical data obtained to confirm this notion. The aim of this longitudinal study was to demonstrate whether any abnormal cardiovascular parameters, specifically QTc wave interval, cardiac axis vector and blood pressure abnormalities, could be documented to occur in two different classes of medical students during their first two years. Heme oxygenase-1(HO-1) is an enzyme that plays a very important role in the resolution of inflammation. HO-1-based therapies are effective in a number of disease conditions. However, HO-1 also increases tumor growth, angiogenesis, metastasis and chemoresistance. Matrix metalloproteinase-3 (MMP-3) is an enzyme involved in physiological and pathophysiological tissue remodeling. Unbalanced expression of MMPs is a key feature of connective tissue destruction in chronic inflammatory conditions. Previously shown in this laboratory, the HO-1 inducer, hemin, increased MMP-3 mRNA expression in some HGF cultures. ESWL is an effective, non-invasive therapy utilized to fragment stones in the kidney and subsequently be cleared in the urinary tract. Although lithotripsy provides a safer alternative to invasive treatments for removing stones, ESWL may cause vasoconstriction after ESWL treatment, reducing renal blood flow, which can cause kidney damage leading to acute to chronic hypertension clinically. This may be due to kidney vascular endothelial dysfunction, which is characterized as increased oxidative stress and decreased endothelial nitric oxide synthase (eNOS)-derived nitric oxide (NO) bioavailability. Periodontitis is a chronic inflammatory disease that is characterized by activation of gingival fibroblasts to produce matrix metalloproteinases and other inflammatory mediators that contribute to destruction of tissues surrounding the teeth. In the United States, 22% of adults have a mild form of periodontal disease and 13% suffer from a severe form of the disease. In addition to tooth loss, periodontitis is associated with increased risk of several conditions, including diabetes, osteoporosis, rheumatoid arthritis and cardiovascular disease. Heme oxygenase-1 (HO-1) is activated by a wide variety of stressful stimuli and levels are increased in inflamed tissues. HO-1 degrades free heme, …

Scholars have long recognized that a Federal Bureau of Investigation wielding robust domestic intelligence-collection powers poses a threat to civil liberties. Yet the FBI’s post-9/11 mandate to prevent terrorist attacks (not merely investigate completed attacks) demands that the agency engage in broad intelligence-collection activities within the United States— activities that can threaten fundamental freedoms. This Article argues that strategies derived from administrative law principles can help alleviate the tendency of threat-prevention efforts to erode civil liberties. Standing At A Constitutional Divide: Redefining State And Federal Requirements For Initiatives After Hollingsworth V. Perry, Scott L. Kafker, David A. Russcol

In Hollingsworth v. Perry, the Supreme Court denied standing to proponents of the California initiative prohibiting same-sex marriage, who wished to appeal a federal district court judge’s decision declaring the initiative unconstitutional. As suggested by the dissent, Hollingsworth has severe consequences for the twenty-four states in which the people can bypass elected officials and legislate directly through the initiative. The Supreme Court has established a clear constitutional divide between state and federal standing requirements for initiatives. Whereas states provide generous standing to proponents so officials do not exclusively control the defense of the people’s initiative process, the Supreme Court …
