After the Supreme Court's decision in Fisher v. UT Austin, the stage has been set for judges to demand more specificity in the articulation of the protected diversity interest. Gone are the days when institutions of higher education could rely on the abstract concept of diversity to support efforts to enroll a diverse student body. Now higher education institutions will need to give serious thought to how they define the sought after diversity interest and how racial diversity improves educational outcomes and enhances the education that is delivered.

Why The United States Cannot Agree To Disagree On Blasphemy Laws, Evelyn Aswad, Rashad Hussain, M. Suleman
Faculty Articles
At the Boston University International Law Journal's symposium "Realigning Western Policy and International Law after the Arab Spring," held on March 25, 2013, Professor Aswad gave the keynote address, where she described the extensive U.S. diplomatic efforts to promote the broadest possible protections for freedoms of expression and religion, even when it comes to speech that is considered blasphemous. A symposium participant asked why the United States cannot just agree to disagree with Muslim-majority countries on the treatment of blasphemy given the religious sensibilities in those countries and the number of other pressing equities the United States has pending with …

Weaving Transnational Identity: Travel And Diaspora In Sandra Cisneros’S 'Caramelo', Tereza M. Szeghi

Sandra Cisneros's Caramelo, or, Puro Cuento: A Novel (2002) dramatizes the functions of travel and tourism for members of the Mexican and Chicana/o diaspora, particularly for second-generation Chicana protagonist and narrator, Lala Reyes. Caramelo showcases travel's critical role in cultural identity formation, maintenance, and contestation for diasporic peoples, while also demonstrating the variability and mutability of diasporic cultural identity as mediated through travel. My explication of the novel's representations of cultural identity formation through travel contributes to critical conversations regarding the relationship between diaspora and tourism, argues for elastic understandings of diaspora itself, and brings needed attention to the particularities …

Stemming A Rising Tide: Why The Clean Air Act Following Massachusetts V. E.P.A. Provides A Sensible Vehicle Through Which To Regulate Greenhouse Gas Emissions, Zachary D. Ludens
University of Miami Law Review
Imagine ocean levels rising because of global ice melt. Imagine the next ice age beginning due to the increase in carbon dioxide and other greenhouse gases in the atmosphere. Imagine global plant life dying as a result of rising global temperatures. Imagine afundamental shift in marine life as a direct consequence of the acidification of the world's waters. Finally, imagine increased greenhouse gases causing no impact on the world's biospheres at all. Scientists have predicted all of these possible results, and, while most reputable scientists agree that global climate change is real, there is far less agreement in the scientific …

Migratory Tactics And Wintering Areas Of Northern Gannets (Morus Bassanus) Breeding In North America, David A. Fifield, William A. Montevecchi, Stefan Garthe, Gregory J. Robertson, Ulrike Kubetzki, Jean-François Rail
Ornithological Monographs
Migration has evolved to allow organisms to undertake life-history functions in the most appropriate place at the most appropriate time. Migration creates seasonal ecological linkages that have important implications for survival, population dynamics, response to climate change, and conservation. Although advances in bird-borne tracking technology have promoted knowledge of avian migratory ecology, major information gaps remain for most avian species, including seabirds. Ours is the first study to electronically track the migration and wintering of Northern Gannets (Morus bassanus; hereafter "gannets") from almost all of their North American breeding range, in multiple years and with multiple tracks from individual birds. …

In recent years, increasing numbers of people have been choosing herbal medicines or products to improve their health conditions, either alone or in combination with others. Herbs are staging a comeback and herbal “renaissance” occurs all over the world. According to the World Health Organization, 75% of the world’s populations are using herbs for basic healthcare needs. Since the dawn of mankind, in fact, the use of herbs/plants has offered an effective medicine for the treatment of illnesses. Moreover, many conventional/pharmaceutical drugs are derived directly from both nature and traditional remedies distributed around the world. Up to now, the practice …

Objective. The correlation between obesity and deficient wound healing has long been established. This review examines the current literature on the mechanisms involved in obesity-related perioperative morbidity. Methods. A literature search was performed using Medline, PubMed, Cochrane Library, and Internet searches. Keywords used include obesity, wound healing, adipose healing, and bariatric and surgical complications. Results. Substantial evidence exists demonstrating that obesity is associated with a number of postoperative complications. Specifically in relation to wound healing, explanations include inherent anatomic features of adipose tissue, vascular insufficiencies, cellular and composition modifications, oxidative stress, alterations in immune mediators, and nutritional …

The conservation of the Speleological Heritage involves bioecological, geomorphological and anthropogenic studies, both from inside the caves and from the external environments that surround them. This study presents a method to rank caves according to their priority for conservation and restoration. Nine caves were evaluated: indicators related to the environmental impacts and the vulnerability status presented by those caves (intrinsic features) and the values scored in a ‘Cave Conservation Index’ (CCI) were established. We also used a rapid assessment protocol to measure cave vulnerability for prioritization of conservation/restoration actions (RAP-cr) comparing natural cavities with the same lithology, due to “strictu …

Prior to this study, there was no information on arthropods, bats, and other vertebrates of caves in northwesternmost Arizona. Based on invertebrate and vertebrate inventory work conducted during 2005 and 2006, we provide future directions for conservation and management for caves on Grand Canyon–Parashant National Monument, northwestern Arizona. Baseline investigations to find and identify arthropods, bats, and other vertebrates were conducted at 7 of the largest known caves on the monument. We identified 52 morphospecies including 44 arthropods, 4 bats, and 4 other vertebrates. Of the cave-dwelling arthropods, we found 10 eisodophiles, 6 troglophiles, 8 questionable troglophiles, 7 trogloxenes, 8 …

Caving For "Pink Puffers" And "Blue Bloaters", Garry K. Smith
KIP Articles
The terms “Pink Puffers” and “Blue Bloaters” have been around for many years. They are used in a colloquial sense by speleologists to describe how cavers react to an elevated concentration of carbon dioxide (CO2 ) and reduced oxygen (O2 ) in a cave’s “foul air” atmosphere. Foul air is only found in a small number of Australian caves and is defined as having a noticeable abnormal physiological effect on humans. Pink Puffers hyperventilate when exposed to foul air while Blue Bloaters are slow to react and run the risk of losing consciousness without warning. This paper compares these colloquial …

The Heart Weight–Body Weight Coefficient In Kenyans Aged 14 Years And Above, Mbayah Etabale
Master of Medicine in Anatomic Pathology
Background: The heart size has traditionally been assessed using absolute reference weights. But the heart weight (HW) has been shown to depend on one’s body size hence a better measure is the ratio of the HW to the body weight (BW) – the HW-BW coefficient. Initially noted to be 0.43% and 0.40% in males and females respectively, recent studies have shown an increase of up to 0.51%. Objective: To determine the HW-BW coefficient in Kenyans aged 14 years and above. Methods: One hundred and four deceased Kenyans aged 14 years and above, with no heart or chronic lung disease, were …

The moral foundation that supports the Catholic Church's opposition to the death penalty is wide and deep. This Article proposes that despite the oft-repeated maxim that "death is different," the same foundation that supports efforts to abolish the death penalty can also support those who seek to achieve other reforms in the practice of criminal punishment.

We have previously shown that non-mammary and tumorigenic cells can respond to the signals of the mammary niche and alter their cell fate to that of mammary epithelial progenitor cells. Here we tested the hypothesis that paracrine signals from mammary epithelial cells expressing progesterone receptor (PR) are dispensable for redirection of testicular cells, and that re-directed wild-type testicular-derived mammary cells can rescue lobulogenesis of PR-null mammary epithelium by paracrine signaling during pregnancy. We injected PR-null epithelial cells mixed with testicular cells from wild-type adult male mice into cleared fat-pads of recipient mice. The testicular cells were redirected in vivo to …
Weather And Climate Information Needs Of Small-Scale Farming And Fishing Communities In Western Kenya For Enhanced Adaptive Potential To Climate Change, Esther Onyango, Silas Ochieng, Alex Awiti
Weather And Climate Information Needs Of Small-Scale Farming And Fishing Communities In Western Kenya For Enhanced Adaptive Potential To Climate Change, Esther Onyango, Silas Ochieng, Alex Awiti
East Africa Institute
Hydro-climatic variability owing to climate change is a major driver of vulnerability among subsistence rural farmers in Kenya. Vulnerability is exacerbated by a lack of reliable weather and climate information necessary to support adaptation to more resilient farming practices. In the form that it is currently delivered, weather and climate information does not support the operational decisions that farmers and fishers make such as timing of land preparation, planting time, type of seed or likelihood of severe weather. This paper presents the results of an approach for eliciting perspectives from farmers and fishers on the weather and climate information products …

Distribution, Habitat Preference, And Status Of The Ditch Fencing Crayfish, Faxonella Clypeata (Hay) (Decapoda: Cambaridae), In Arkansas, H. W. Robison, C. T. Mcallister
Journal of the Arkansas Academy of Science
The ditch fencing crayfish, Faxonella clypeata (Hay), is a common and widespread crayfish that inhabits roadside ditches, intermittent first-order streams, shallow sloughs with heavy vegetation, and edges of swamps in Arkansas. Between 1997-2012, we made 55 collections of F. clypeata in 34 counties throughout eastern Arkansas, including 23 counties where F. clypeata had not been previously documented. At most of these locations within the West Gulf Coastal and Mississippi Alluvial Plain provinces, F. clypeata was found to be a locally abundant crayfish. With regard to conservation status, F. clypeata should be considered as “Currently Stable” due to its widespread distribution …

As 3D printing technology improves, the theoretical endpoint comes into view: a machine that, like the “replicators” of Star Trek, can produce anything the user asks for out of thin air from a digital blueprint. Real-life technology may never reach that endpoint, but our progress toward it has accelerated sharply over the past few years—sharply enough, indeed, for legal scholars to weigh in on the phenomenon’s disruptive potential in areas ranging from intellectual property to gun rights. This Article is concerned with the First Amendment status of the digital blueprints. As of August 2014, it is the first law review …

Scientific visualizations of phenomena can enhance the way learners understand scientific concepts (Honey & Hilton, 2011). Scientific concepts can be abstract and difficult for students to understand and visualizations can help make these abstract concepts more concrete for students. For example, chemistry students often struggle with understanding how atoms bond since they cannot directly see atoms. Using a visualization to show students how the electrons are shared or transferred can help students understand these abstract concepts. In addition, many visualizations are freely available online and can be a key element to maintain quality science instruction with limited resources.
Tort Law In The Age Of Statutes, Mark A. Geistfeld
Tort Law In The Age Of Statutes, Mark A. Geistfeld
Faculty Articles
The common law of torts is widely considered to be in conflict with the modern regulatory state. Tort law interacts with regulations and their enabling statutes in different ways that are fully addressed by the doctrines of negligence per se, the regulatory compliance defense, and statutory preemption. According to a substantial body of scholarship, these three statutorily related doctrines are a muddle, lacking any coherent theory that adequately accounts for the competing institutional concerns of the federal regulatory and state tort systems. The problem resides in a mistaken focus on statutory purpose. Due to the supremacy of legislative law, a …
