A Few Remarks On Selected Institutions Proposed In The Draft Amendments To The Polish Competition Act, Dominik Wolski
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
In this short article, the author mentions key legal institutions proposed in the 2013 Draft Amendment Act to the Polish Competition and Consumer Protection Act. It is the first time for all of these institutions to appear in the domestic competition law system. Key among them is the introduction of two-phase merger control proceedings and protection against abusing merger control rules where a concentration is conducted in multiple steps. Important is also the introduction of managers’ responsibility for competition law breaches as well as voluntary submission to penalties (settlements). Public disclosure of a possible violation of consumer law, that might …

Role Of The Cipa Scaffoldin Protein In Cellulose Solubilization, As Determined By Targeted Gene Deletion And Complementation In Clostridium Thermocellum, Daniel G. Olson, Richard J. Giannone, Robert L. Hettich, Lee R. Lynd
Dartmouth Scholarship
The CipA scaffoldin protein plays a key role in the Clostridium thermocellum cellulosome. Previous studies have revealed that mutants deficient in binding or solubilizing cellulose also exhibit reduced expression of CipA. To confirm that CipA is, in fact, necessary for rapid solubilization of crystalline cellulose, the gene was deleted from the chromosome using targeted gene deletion technologies. The CipA deletion mutant exhibited a 100-fold reduction in cellulose solubilization rate, although it was eventually able to solubilize 80% of the 5 g/liter cellulose initially present. The deletion mutant was complemented by a copy of cipA expressed from a replicating plasmid. In …

“Throwing Out The Baby With The Bathwater” – About Leniency Plus In Poland, Szymon Syp, Piotr Semeniuk
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
This paper aims to assess the planned changes to the Polish Competition Act of 2007 discussing in detail the introduction of a legal institution which is a novum for the Polish legal system – leniency plus. The goal of leniency plus is to grant an additional fine reduction to an entrepreneur that submitted an unsuccessful leniency application (which, under the current law, would not give rise to a fine reduction), but disclosed to the NCA information on another, so far unknown illegal agreement in which that company participates. The paper first discusses the institution of leniency plus and criticizes its …

The “Manager” In The Government’S Draft Amendment Act To The Competition Act, Anna Piszcz
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
This article considers a number of legal provisions concerning “managers” that have been included in the Government’s 2013 Draft Amendment Act to the Competition and Consumers Protection of 2007. The author indicates some potential difficulties that might arise if such provisions were in fact to be introduced into the national competition law system. At the same time, the author attempts to answer questions such as how the Draft could be modified.
Particular Features Of Franchising In Competition Law, Antoni Bolecki
Particular Features Of Franchising In Competition Law, Antoni Bolecki
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
This article aims to identify those special elements of franchising, important to antitrust assessment, which differentiate it from traditional distribution. It is fair to say that some restrictions on the rights of a franchisee contained in franchise agreements will be treated with more leniency than if they were included in a standard distribution agreement. The analysis covers the following areas: a) general restrictions typical to franchising; b) RPM; c) noncompete obligations; d) combining selective and exclusive distribution; e) point-of-sale location requirements.

Directive 2011/83/EU on consumer rights was adopted on 25 October 2011 repealing Directive 85/577/EEC on contracts negotiated away from business premises and Directive 97/7/EC on the protection of consumers in respect of distance contracts. It also amended Directive 93/13/EEC on unfair terms in consumer contracts and Directive 1999/44/EC on the sale of consumer goods and associated guarantees. Directive 2011/83/EU is the next step in the clarification and the adjustment to current market conditions of traditional principles of freedom and sanctity of contracts. At the same time, the new Directive is the result of a compromise, which finalized several years of …

Teckal Doctrine – Exception Which Becomes Rule, Maciej Fornalczyk
internetowy Kwartalnik Antymonopolowy i Regulacyjny (internet Quarterly on Antitrust and Regulation)
Public services are often perceived as extraordinary goods despite the fact that they constitute a normal article of market economy and are subjected to economic mechanisms, like any other. Not unlike other entrepreneur, suppliers of public services bear costs and risks of their economic activity – they compete “on the market” or “for the market”. Free competition allows consumers to receive a fair share of efficiencies and welfare. Yet public services are specific in that they must meet certain (defined) criteria, both qualitative and quantitative. This leads to the conclusion that public authorities play a significant role in the definition …

Developing Deep Understanding About Language In Undergraduate Pre-Service Teacher Programs Through The Application Of Knowledge, Lisl Fenwick, Sally Humphrey, Marie Quinn, Michele Endicott
Australian Journal of Teacher Education
The development of deep understanding of theoretical knowledge is an essential element of successful tertiary-programs that prepare individuals to enter professions. This study investigates the extent to which an emphasis on the application of knowledge within curriculum design, teaching strategies and assessment methods developed deep knowledge about language within the first year of a tertiary-based teacher education program in Australia. Concepts of application from literature on tertiary-based learning informed the design of curriculum, teaching strategies and assessment within a unit on linguistics for pre-service teachers. Questionnaires, provided to students at the end of the unit, and analysis of a final …

Comparative Analysis Of The Memorandum Of Agreement On The Ancestral Domain (Moa-Ad) Aspect Of The Grp-Milf Tripoli Agreement On Peace Of 2001 And Framework Agreement On The Bangsamoro (Fab), Sedfrey M. Candelaria
Ateneo School of Law Publications
Peace processes, which often culminate in the adoption of agreements, have been used traditionally in international law to end armed conflicts. The form within which negotiated settlements have been contained are primarily up to the negotiating parties to determine. However, the legal characterization of these agreements are independently and objectively governed by a set of rules either under the municipal legal system or at the level of international law. A peace treaty is an “agreement or contract made by belligerent powers, in which they agree to lay down their arms, and by which they stipulate the conditions of peace and …

The Quantum Gromov-Hausdorff Propinquity, Frédéric Latrémolière
The Quantum Gromov-Hausdorff Propinquity, Frédéric Latrémolière
Mathematics Preprint Series
We introduce the quantum Gromov-Hausdorff propinquity, a new distance between quantum compact metric spaces, which extends the GromovHausdorff distance to noncommutative geometry and strengthens Rieffel’s quantum Gromov-Hausdorff distance and Rieffel’s proximity by making *-isomorphism a necessary condition for distance zero, while being well adapted to Leibniz seminorms. This work offers a natural solution to the long-standing problem of finding a framework for the development of a theory of Leibniz Lip-norms over C*- algebras.
Forward Model For Temperature Derivation From Atmospheric Lidar, Jaren Hobbs
Forward Model For Temperature Derivation From Atmospheric Lidar, Jaren Hobbs
Physics Capstone Projects
Atmospheric Lidar takes advantage of Rayleigh backscattering to create a relative density profile of the atmosphere. The method for temperature derivation is based on the work of Chanin and Hauchecorne (CH). Beginning with an initial temperature, and utilizing the ideal gas law, a downward integration procedure is applied to create a temperature profile from the density profile down to forty- five kilometers. Since this initial temperature is only a best guess, the temperatures towards the top of the profile may not be accurate. However, so long as the guess is reasonable, within perhaps a fifty Kelvin margin (though hopefully not …
