In the hills of Appalachia sing the hymns of the faithful, preaching a belief in the handling of snakes to prove loyalty to God. In West Virginia, persons may take up poisonous reptiles and pass them amidst crowds in the name of religion without legal restraints. While other states prohibit snake- handling in the name of safety, West Virginia law remains void on the issue. This Article introduces the practice of snake-handling and examines the risks posed by taking up poisonous animals whose bite may cause serious injury or death. Most observers agree that it is morally worse to cause harm by engaging in an act than to contribute to producing the same harm by an omission. As a result, American criminal law punishes harmful omissions less than similarly harmful acts, unless there are exceptional circumstances that warrant punishing them equally. Yet there are many cases in which actors cause harm by engaging in conduct that can be reasonably described as either an act or an omission. Think of a doctor who flips a switch that discontinues life support to a patient. If the patient dies as a result, did …

The Paradoxes Of Restitution, Mark A. Edwards
West Virginia Law Review
Restitution following mass dispossession is often considered both ideal and impossible. Why? This Article identifies two previously unnamed paradoxes that undermine the possibility of restitution: the time-unworthiness paradox and the collective responsibility paradox. After developing these ideas, the Article examines them in the context of a particularly difficult and intractable case of dispossession and restitution. The Article draws upon interviews with restitution claimants whose stories reveal the paradoxes of restitution.

Racial differences in the pathophysiology of atherothrombosis are poorly understood. We explored the function and transcriptome of platelets in healthy black (n = 70) and white (n = 84) subjects. Platelet aggregation and calcium mobilization induced by the PAR4 thrombin receptor were significantly greater in black subjects. Numerous differentially expressed RNAs were associated with both race and PAR4 reactivity, including PCTP (encoding phosphatidylcholine transfer protein), and platelets from black subjects expressed higher levels of PC-TP protein. PC-TP inhibition or depletion blocked PAR4- but not PAR1-mediated activation of platelets and megakaryocytic cell lines. miR-376c levels were differentially expressed by race and …

Many small businesses fail after 5 years, having a negative impact on local and national economies. The purpose of this phenomenological study was to explore small-enterprise leader-operators’ experiences regarding practices that aid sustainability beyond 5 years. Twenty small enterprise leaders in the United States Midwest who were identified as having 5 years of longevity in leading organizations with fewer than 500 employees were invited to participate. These participants shared their lived experiences through semistructured interviews conducted in-person and by telephone. The dynamic theory of leadership development was used to underpin the study. This presents projected costs and benefits of a carport style photovoltaic (PV) solar energy system, as well as its potential implementation sited in the City of Arlington. The goal was to estimate the amount of electricity generated from converting the existing sites into PV solar parking lots by assessing spatial, locational, and quantitative analysis, utilizing the available data, tools, and techniques in Geographic Information Systems (GIS) and Google Earth Pro. This study applied data from currently installed and active solar energy systems to meet the goal of this study. The findings showed the City of Arlington could generate 218,403 MWh/year, …

INTRODUCTION: Energy drinks have become the soft drink of this millennium. They are commonly available everywhere including stores, schools and fitness centers. Yet, the effects of energy drinks, on metabolism at rest and during exercise, receive little attention. Ingredients in energy drinks such as caffeine and taurine are sympathetic stimulants and increase heart rate and blood pressure. However, it is unclear as to whether or not these effects actually improve exercise performance. Increasing numbers of customers are installing solar photovoltaic systems on their homes and businesses. As module and system costs decline, customer demand grows, and more businesses organize around the solar opportunity, it is time to revisit the tariff structure under which these systems integrate with and operate on the electric grid. This article details a novel approach to a distributed solar tariff, called the “Value of Solar” tariff (“VOST”), that addresses important utility and customer issues, and offers some significant improvements over traditional net metering approaches. Progress monitoring has been shown to be effective for gauging student growth in the area of mathematics. Likewise, self-graphing has been shown to improve student achievement in education. The present study investigates the effectiveness of progress monitoring as an intervention with a self-graphing component for second-grade students in the area of mathematics. This research examines the impact of progress monitoring on increased math skills, accuracy, and generalization to universal screening assessments. While results were variable, students’ accuracy improved upon implementation of progress monitoring. All-together, results suggest that progress monitoring with selfgraphing can be an effective intervention.

The purpose of this study is to determine the effectiveness of the Corrective Reading program as an intervention for three seventh grade students who are English language learners (ELL). The effectiveness of the Corrective Reading Decoding B2 program on students’ oral reading fluency was examined. A multiple-baseline experimental design was chosen for this research to examine the effects of a direct instruction reading program with three ELL students in the seventh grade. The results indicated that all three participants met their individual goals on the AIMSweb R-CBM progress monitoring fourth grade probes. In these memoirist essays I interweave my life stories with sojourns in nature and my spiritual journey. Not a narrative of horrific abuse and trauma , it is an account similar to those of other women growing up the 1950's, a time of pretense that social problems did not exist, that the United states was a place of upward mobility-except if you were black, poor, female or otherwise removed from a life of privilege.
