Among the increasing number of federal statutes impacting family law two continue to impact child permanency and parental rights. First, the Adoption Assistance and Child Welfare Act of 1980 mandates that state courts find that the state child welfare agency made reasonable efforts to reunite a dependent child with his or her parents prior to termination of parental rights. The child is dependent because a state court held that there was sufficient clear and convincing evidence to remove the child from the parents’ home. Ongoing conflict over the contraceptive mandate promulgated by the Department of Health and Human Services ("HHS") has resulted in more than two dozen lawsuits by profit-making businesses and their owners seeking protection under the Religious Freedom Restoration Act ("RFRA"). To date, the businesses and their owners are winning handily, having obtained preliminary relief in seventeen of the cases, and being denied relief in only six. Last month, in fact, a panel of the D.C. Circuit Court of Appeals took the extraordinary step of reconsidering and reversing its own prior ruling and granting a preliminary injunction to a business seeking RFRA's …

Is there a religious way to pump gas, sell groceries, or advertise for a craft store? Litigation over the HHS contraceptive mandate has raised the question whether a for-profit business and its owner can engage in religious exercise under federal law. The federal government has argued, and some courts have found, that the activities of a profit-making business are ineligible for religious freedom protection.

This article offers a comprehensive look at the relationship between profit-making and religious liberty, arguing that the act of earning money does not preclude profit-making businesses and their owners from engaging in protected religious exercise.

Neutral No More: Secondary Effects Analysis And The Quiet Demise Of The Content-Neutrality Test, Mark L. Rienzi

When the Supreme Court introduced the “secondary effects” doctrine to allow for zoning of adult businesses, critics fell into two camps. Some, like Justice Brennan, predicted dire consequences for the First Amendment, particularly if the doctrine were used in political speech cases. Others, like Professor Laurence Tribe, predicted secondary effects analysis would be limited to sexually explicit speech, and would not threaten the First Amendment. The modern consensus is that the doctrine has, in fact, been limited to cases about sex.

The political and legal campaign for marriage equality rests on the proposition that the Constitution of the United States requires communal recognition of committed, same-sex relationships. The text, structure, and history of the amended Constitution, however, support precisely the opposite conclusion: i.e., that neither the United States nor any state may compel any community, association, or individual to affirm (by word, deed, or policy) the hotly disputed propositions about human sexuality that lie at the core of the debate. The regression rate of the solid fuel is a primary parameter in the performance analysis for a hybrid rocket. Many studies in the past few years have theoretically claimed, or experimentally shown, a dependence of the regression rate on the chamber total pressure. Such behavior is generally traced back to the presence of oxygen below the flame zone and of heterogeneous reactions occurring at the surface and affecting the pyrolysis law. The aim of this study was to obtain nanomechanical properties of living cells focusing on human amniotic fluid stem (hAFS) cell using nanoindentation techniques. We modified the conventional method of atomic force microscopy (AFM) in aqueous environment for cell imaging and indentation to avoid inherent difficulties. Moreover, we determined the elastic modulus of murine osteoblast (OB6) cells and hAFS cells at the nucleus and cytoskeleton using force–displacement curves and Hertz theory. Teaching Care Ethics: Conceptual Understandings And Stories For Learning, Colette Rabin, Grinell Smith

An ethic of care acknowledges the centrality of the role of caring relationships in moral education. Care ethics requires a conception of ‘care’ that differs from the quotidian use of the word. In order to teach care ethics more effectively, this article discusses four interrelated ways that teachers’ understandings of care differ from care ethics: (1) conflating the term of reference ‘care’ with its quotidian use; (2) overlooking the challenge of developing caring relationships; (3) tending toward monocultural understandings of care; and (4) separating affect and intellect. This article reviews using closed group Facebook pages as a social network to create a pedagogical space where counseling students communicate, share resources, and develop cultural sensitivity. The Facebook pages were incorporated into the counseling core course (16 weeks) and the class consisted of four phases: (1) preparation and development of rapport; (2) sharing resources and reviewing key concepts; (3) increasing self-awareness and developing reflective skills; and (4) interfacing of two cultures crossing geographical boundaries. Interactive database exploration is a key task in information mining. However, users who lack SQL expertise or familiarity with the database schema face great difficulties in performing this task. To aid these users, we developed the QueRIE system for personalized query recommendations. QueRIE continuously monitors the user’s querying behavior and finds matching patterns in the system’s query log, in an attempt to identify previous users with similar information needs. Subsequently, QueRIE uses these “similar” users and their queries to recommend queries that the current user may find interesting. ODS alloys, or oxide dispersion strengthened alloys, are made from elemental or pre-alloyed metal powders mechanically alloyed with oxide powders in a high-energy attributor mill, and then consolidated by either hot isostatic pressing or hot extrusion causing the production of nanometer scale oxide and carbide particles within the alloy matrix; crystalline properties such as creep strength, ductility, corrosion resistance, tensile strength, swelling resistance, and resistance to embrittlement are all observed to be improved by the presence of nanoparticles in the matrix. Conrad Susa (b. 1935) is an American composer who has contributed over thirty choral works that are of high quality incorporating texts written by well-known literary figures. His choral works are usually spiritual in nature though not strictly liturgical. Discovery and Praises is a presently unpublished cantata in four movements for mixed chorus, solos for two sopranos, an alto, a tenor, and a baritone. The accompaniment is scored for organ, harp, percussion, flute and handbells. Susa chose to set ancient poetry by Caedmon, Wipo of Burgundy, John Donne, and St. Patrick. Studying the nuclear reaction n(p,d)γ and calculating its cross-section is not only a matter of interest from theoretical particle physics point of view but also from the viewpoint of cosmology. We now know that the universe is made up of only 5% baryonic matter. So, computing the density of baryons is of particular importance to physicists in general and cosmologists in particular. Deuterium production during Big Bang Nucleo-synthesis (BBN) is very sensitive to the density of baryons, thus baryon density can be inferred from the abundance of deuterium.
