It is generally believed that states do not have an obligation to investigate incidents involving collateral damage absent a suspicion that a grave breach of International Humanitarian Law (“IHL”) has occurred. This paper argues that, although there is no affirmative investigative duty expressed in any IHL treaty, a general duty to investigate is clearly implied by two requirements contained in IHL treaties: the duty to examine every incident that amounts to a grave breach and the duty to punish offenders who violate IHL provisions. This thesis illustrates how Pompey’s annexations and organizing of the eastern provinces for Rome were more pragmatic than imperialistic. Greek and Eastern specialists are used in order to give a better back story than the imperialist thesis offers in its reasoning for the annexations. By adding more detail from the Greek and Eastern perspective, other dimensions are opened that shed new light upon the subject of Pompey’s eastern settlements. Through this method, the pirate campaign and the annexation of Syria are greatly developed, especially in concern to changes in culture that Pompey’s settlements forced. The purpose of this study was to examine the relations among culture, information sharing, and performance among culturally-homogeneous NATO Officer teams. Forty-eight teams participated from five countries, namely, Bulgaria, Netherlands, Norway, Sweden, and USA. Teams of four participants were randomly assigned to a role and the task was an interdependent computer-based mission using an adapted version of Neverwinter Nights™ (Bioware, 2003), where they had to communicate among teammates and with non-human players to find weapons caches and other mission objectives. Incumbent Violence And Insurgent Tactics: The Effects Of Incumbent Violence On Popular Support For Guerrilla Warfare And Terrorism, Jonathan Williams

Insurgency has two main strategies, guerrilla warfare and terrorism, which should be treated as linked, but distinct, strategies. This thesis examines the role of incumbent violence in leading insurgents to select one, or both, of these strategies. It argues that incumbent violence can create support for insurgency by causing fear and a desire for revenge and reshaping the social structures of a community. It also argues that incumbent violence increases popular support for terrorism in particular by creating outbidding incentives and desires to respond in kind to civilian deaths and as a way of punishing norm violations against attacking civilians …

In 1928 a Syrian peasant farmer stumbled by chance onto a funerary vault of ancient provenance about half a mile from the Mediterranean coastline of Syria and about six miles north of the modern-day city of Latakia. This unforeseen discovery led to an archaeological excavation ofTell Ras Shamra (Cape Fennel) by the eminent French excavator Claude Schaeffer. What Schaeffer's team unearthed was not merely an ancient tomb, but a city complete with palaces, private homes, temples, and streets paved with stone.

The eighty-six years from 1860-1945 was a momentous one in American Indian history. During this period, the United States fully settled the western portion of the continent. As time went on, the United States ceased its wars against Indian tribes and began to deal with them as potential parts of American society. Within the military, this can be seen in the gradual change in Indian roles from mostly ad hoc forces of scouts and home guards to regular soldiers whose recruitment was as much a part of the United States’ war plans as that of any other group. The law of armed conflict provides the authority to use lethal force as a first resort against identified enemy belligerent operatives. There is virtually no disagreement with the rule that once an enemy belligerent becomes hors de combat — what a soldier would recognizes as “combat ineffective” — this authority to employ deadly force terminates. Recently, however, some have forcefully asserted that the LOAC includes an obligation to capture in lieu of employing deadly force whenever doing so presents no meaningful risk to attacking forces, even when the enemy belligerent is neither physically disabled or manifesting surrender. Framing the topic of this symposium as “Human Rights Litigation in State Courts and Under State Law” effectively orients the discussion around the rights of plaintiffs from the outset, the central question being whether they have enforceable rights in U.S. state courts under state law. Standing in the way are various legal doctrines. In broad strokes, the relevant questions become: Which doctrines do, or should, either facilitate or obstruct human rights litigation in U.S. state courts and under state law? A rules of engagement (“ROE”) Review Board should be created in order to provide an impartial review process for service members facing adverse administrative action for violations of ROE. Politicians defining the ROE, rather than military experts, create rules that are so restrictive and confusing that they ultimately run counter to the military objective of victory. A violation of a ROE can be a criminal offense under the Uniform Code of Military Justice, but violations are issued arbitrarily, and often the military does not charge the service member with a crime, instead using adverse administrative measures to impose punishment.

The scope is to fill in a gap of detecting targets using low power, small size radars. The main objective of this thesis is to show, through simulation, that a small, low power radar can be theoretically designed using standard radar principles to accomplish said task. The primary method used in this thesis is to ascertain the conclusion with two separate Matlab Simulations. First, the design of a radar to detect human sized targets moving along the ground and secondly, detection of small arms fire aimed towards helicopters were used as the primary examples. It is becoming more important to detect ultra-low concentrations of analytes for biomedical, environmental, and national security applications. Equally important is that new methods should be easy to use, inexpensive, portable, and if possible allow detection using the naked eye. Detection of low concentrations of analytes generally cannot be achieved directly, but requires signal amplification by catalysts, macromolecules, metal surfaces or supramolecular aggregates. The rapidly progressing field of macromolecular signal amplification has been advanced using conjugated polymers, chirality in polymers, solvating polymers and polymerization/depolymerization strategies. Anyone who has ever suffered a fit of hysterical laughter at precisely the wrong moment, or has begun to laugh spontaneously at an inappropriate joke before stopping short, can attest to laughter’s uniquely uncontrollable force. Beyond all reason and control, laughter interrupts us and reminds us of the limits of the human subject. (First paragraph) In a home with two children under six, managing to find the time and the games that allow for play with a partner who has completely different tastes and capabilities produces compromises both inside and outside the game, as well as a hybrid form that spans the two. This last point highlights the fact that compromise remains a popularly studied topic in considerations of games, but only within very discrete boundaries that do not necessarily have anything to do with play or with players. Numerous epidemiology studies suggest a correlation between exposures to polychlorinated biphenyls (PCBs) and the development and severity of type 2 diabetes (T2D); however, mechanisms remain largely unknown. Previous studies demonstrated that PCBs that are ligands of the aryl hydrocarbon receptor (AhR) promote the expression of proinflammatory cytokines, including tumor necrosis factor-α (TNF-α), that are linked to insulin resistance in adipocytes. To explore potential mechanisms linking PCB exposures to diabetes, we developed a mouse model of glucose and insulin intolerance induced by acute and chronic exposures to PCB-77. We hypothesized that PCB ligands of AhR result in adipocyte-specific elevations in TNF-α …

The primary purpose of this Article is to dispute the moral claims to post-death property rights made by libertarians when they argue against the estate tax. As I will show later in this Article, my argument does not necessarily entail enacting an estate tax, nor does it require a particular level of tax. I am merely trying to demonstrate that those who argue that the estate tax is an immoral violation of the private property rights of the deceased are mistaken. As the nation faces cultural divides over the meaning of the “Founding,” the Constitution, and who owns these meanings, the Court’s embrace of originalism is one strand that feeds the divide. The Court’s valuing of the original interpretation of the Constitution has reinforced the Founder fetishism also found in popular culture, specifically within the politics of those identified as the Tea Party. Vaccines represent the most outstanding success story of modern medicine. In addition to pathogen-derived antigen(s), immune adjuvants are crucial for the development of efficacious new generation vaccines. Most modern vaccines are comprised of purified recombinant proteins, peptides or polysaccharides, which are weakly immunogenic. The incorporation of adjuvants in vaccine formulations not only enhances the immunogenicity of the antigen but also activates various innate and adaptive immune parameters. New-age adjuvants become particularly important in the development of vaccines against some challenging pathogens, such as Staphylococcus aureus, for which vaccines are not yet available or are inadequate.
