Federalism As A Preventative Measure: Avoiding State Enforcement Of Federal Anti-Gun Legislation In 2013, Brielle Hunt
Richmond Public Interest Law Review
This comment will delve into this question, seeking to answer whether or not the Constitution allows states to refuse to comply with federal law. This analysis requires the application of a constitutional principle that reaches far beyond the scope of the Right to Bear Arms; it calls into play the vertical separation of powers and the rights belonging to state sovereigns described in the Tenth Amendment. The comment will proceed as follows. Part II will address the constitutionality of House Bill 2340, compared against other kinds of legislation and in light of case law. It will be argued that the …

Village Elections And Their Impact: An Investigative Report Of A Northern Chinese Village, Yusheng Yao
Faculty Publications
This article examines a series of four direct elections and their impact in a poorly governed Chinese village near Beijing. Based on the problems exposed in the elections and governance, it identifies the main contradiction in the village to be that of economic justice between villagers on one side, and the old and elected officials, and village toughs and predatory entrepreneurs, on the other. It illustrates the dynamics of politics in the village, in particular factionalism, since the beginning of direct elections and the rise of village toughs and predatory entrepreneurs in recent years and the damaging effect of the …

When we moved to Boise in the mid-1980s we each found something to love about our new community. For one, it was the historic buildings and neighborhoods, and for the other, the river and the foothills. We believed we were fortunate to settle in a town that valued both cultural and natural resources. In the more than twenty-five years that we have called Boise home, we have observed the ways in which residents and visitors appreciate, value, and advocate for their environment. That appreciation has alternately surprised, disappointed, and delighted us.
Introductory Note To Prosecutor V. Perišić, International Criminal Tribunal For The Former Yugoslavia (Icty), Chris Jenks
Introductory Note To Prosecutor V. Perišić, International Criminal Tribunal For The Former Yugoslavia (Icty), Chris Jenks
Faculty Journal Articles and Book Chapters
This note introduces a controversial ICTY decision which attempted to clarify the requisite elements required to convict the former head of the Army of Yugoslavia with aiding and abetting war crimes committed by other organizations in Bosnia-Herzegovina and Croatia. The Perišić judgment serves as a reminder of the still unsettled nature of international criminal law on even threshold issues like the elements for a mode of liability. Given that the Special Court for Sierra Leone has already affirmatively rejected the Perišić formulation the case may, sadly, signal the fragmentation of international criminal law.

President Obama’s “Educate to Innovate” initiative emphasizes training in the areas of Science, Technology, Engineering, and Math (STEM). More recently, arts have been added to STEM, resulting in the acronym STEAM: Science and Technology interpreted through Engineering and the Arts, based in the Mathematical elements. However, should the arts be used only to cultivate better scientists? Or might the arts be valued apart from of their service to math and science?

The Virtual Watercooler: Influences Of Political Comedy On Social Media Discussion, Andrew Abad
Senior Honors Theses and Projects
With the emergence of social media activity as a daily phenomenon for most Americans, online users are becoming greater consumers of political information, and are choosing to share that information through social media outlets. A virtual "watercooler effect" is created, in the form of online political debates and arguments. This study examines the connection between viewers of political comedy programmings (television shows like The Daily Show With Jon Stewart and The Colbert Report) and political discussion on social media websites such as Facebook and Twitter. Using a survey of EMU undergraduate students that measures political efficacy and media habits, …

What Alex Kozinski And The Investigation Of Earl Bradley Teach About Searching And Seizing Computers And The Dangers Of Inevitable Discovery, Stephen E. Henderson
Faculty Articles
This paper tells two stories. One concerns the investigation of a Delaware physician named Earl B. Bradley that resulted in a conviction and sentence of fourteen consecutive life terms for the sexual abuse of children. The other concerns the computer problems, both judicial and extra-judicial, of Chief Judge Alex Kozinski of the United States Court of Appeals for the Ninth Circuit. Though in a sense unrelated, they share lessons about the practicalities of computers and their search that are worth telling. As courts continue to struggle with how to cabin the searches of computers in order to minimize privacy intrusion …
Using Narrative As A Tool To Locate And Challenge Pre Service Teacher Bodies In Health And Physical Education, Jennifer A. Mcmahon, Dawn Penney
Using Narrative As A Tool To Locate And Challenge Pre Service Teacher Bodies In Health And Physical Education, Jennifer A. Mcmahon, Dawn Penney
Australian Journal of Teacher Education
This paper reports on research that has explored the use of narrative as a pedagogical tool in pre service teacher education. Specifically, we pursue the use of narrative to engage with pre service teachers’ embodied experiences [their lived body] and the ways in which these experiences are in turn currently influencing their ‘living bodies’ in regard to what Health and Physical Education (HPE) is and how it should be taught. Data in the form of an assemblage of pre service teachers’ narratives are presented to show how both the lived and living body contributes to thoughts and ideas about HPE. …
Transforming Narratives, Lucia Weilein
Transforming Narratives, Lucia Weilein
Theses and Dissertations
Narrative, often considered synonymous with “story,” can be viewed from a structuralist perspective and analyzed independent of any particular content. Breaking narrative into categories of story and discourse, this autonomous structure makes possible a translation of content from one form to another. The various media and form types common in graphic design can serve as both recipient and translator of narratives, converting content into a framework that includes the concept of craftsmanship, aesthetic components and specifications, legibility and composition, and the physical form of the designed object. To examine how this framework functions in practice, I have developed a series …
Illegitimate Celebrity In The British Long Eighteenth Century, Melissa Wehler
Illegitimate Celebrity In The British Long Eighteenth Century, Melissa Wehler
Electronic Theses and Dissertations
In the discussions about contemporary celebrities, the femme fatale, the bad boy, the child star, and the wannabe have become accepted and even celebrated figures. In the late eighteenth and early nineteenth centuries, however, actors and actresses who challenged acceptable strategies for celebrity behavior were often punished by exile, debt, disgrace, and humiliation. Some performers even faced a veritable textual and historical oblivion. Illegitimate Celebrity considers the careers of Dorothy Jordan, William Henry West Betty, Edmund Kean, and Margaret Agnes Bunn, and offers a historical genealogy of "illegitimate" performers who dared to break with social convention and struggled to define …
